AND NOW, Tuesday, August 02, 2011 upon consideration of the attached Compla int,
it is hereby directed that parties and their respective counsel appear before Dawn S. Sunday, Esq. the conciliator,
at__ _ 39 West Main Street, Mechanicsburg, PA 17055 on Tuesday, September 06, 2011 at 9:00 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. Failure to appear at the conference may provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing.

consideration of the attached Custody Conciliation Report,'it is ordered and directed as follows:
1. The prior Order of this Court dated August 31, 2010 shall continue in effect as modified by
this Order.
2. While the parties shall continue to consult with each other in making all major decisions
concerning the Children as provided in the prior Order of this ; Court dated August 31, 2010, in the
event the parties disagree on a major decision for the Children and after addressing the issue with the
Parent Coordinator the decision remains unresolved, the Father shall have the final decision making
authority.
3. In the event a parent schedules a period of vacation custody as provided in the prior Order of
this Court, that parent shall be responsible for making arrangements for the Children's care during the
vacation period if the parent changes his or her mind regarding the scheduling of the vacation period
with less than 30 days advance notice to the other parent. The parent who initially schedules the
vacation period shall be considered to have exercised his or her right to the vacation period during that
period of custody except as otherwise agreed between the parties in the event of an emergency or other
extenuating circumstances justifying the cancellation of the vacation
4. In the event the Mother wishes to review or modify the provisions of this Order, the Mother
may file a petition with the Court to schedule an additional custody conciliation conference.
5. The parties may modify the provisions of this Order by mutual consent. In the absence of
mutual consent, the terms of this Order shall control.

CUSTODY CONCILIATION SUMMARY REPORT
IN ACCORDANCE WITH CUMBERLAND COUNTY RULE OF CIVIL
PROCEDURE 1915.3-8, the undersigned Custody Conciliator submits the following report:
1. The pertinent information concerning the Children who are the subjects of this litigation is as
follows:

2. A custody conciliation conference was held on September 6, 2011, with the following
individuals in attendance: the Father, Gaspere C. Geraci, with his counsel, Susan E. Good Esquire.
Neither the Mother, Tammy M. Geraci, nor her counsel, Marianne E. Rudebusch Esquire, attended the
conference although the Mother's counsel's office indicated, and the Mother's counsel subsequently
confirmed, that the conciliation conference notice and the Father's Petition were provided to the
Mother.
3. The Father filed this Petition for Modification seeking sole legal custody of the Children
pursuant to a recommendation in a supplemental custody evaluation performed by Arnold Shienvold
PhD. The Father and his counsel represented that they have serious difficulty in obtaining the
Mother's cooperation in following agreements reached through the Parent Coordinator, completing
the supplemental custody evaluation and making necessary and timely decisions for the Children.
According to the Father, the Children have been disadvantaged by the Mother's inability or
unwillingness to make and follow through with parenting decisions. The parties share having physical
custody of the Children pursuant to a current Order dated August 31, 2010. Kasey Shienvold
continues to serve in his appointed capacity as Parent Coordinator.
4. Based upon the representations of the Father and his counsel at the custody conciliation
conference and the fact that the Mother did not attend the conference or contact the conciliator, the
conciliator recommends an Order in the form as attached.
