X11-191st WELUBHI HOUSING GROUP LLC Contractor This instrument is executed this 3`d day of August, 2011, by Welubhi Housing Group LLC ("Contractor") in favor of Carlisle Developers, LLC and Yentzer & Yentzer Enterprises, d/b/a School Road Joint Venture ("Owners") Whereas, Owners are about to execute contemporaneously herewith, a contract with Contractor for the erection of a Spec House upon a lot of land situate in Dickinson Township, Cumberland County, Pennsylvania, being known as Lot No. 10, Preliminary Subdivision Plan for Lindenwood, as recorded in Cumberland County at InstrumentNo. 200923453, more fully described as follows: BEGINNING at an iron pin to be set on the right-of-way line of Peyton Place (50' ROW) at the southeast corner of Lot #9 on the above-referenced plan; thence along said Lot #9 North 88 degrees 56 minutes 00 seconds East 441.60 feet to an iron pin to be set; thence along land now or formerly of Harry E. Thompson, et. al, South 15 degrees 11 minutes 19 seconds East 188.89 feet to an iron pin to be set; thence along Lot #11 on the above-referenced plan South 76 degrees 35 minutes 46 seconds West 487.99 feet to an iron pin to be set; thence along the right-of-way line of said Peyton Place on a curve to the right having a radius of 475.00 feet and arc length of 102.28 feet and a chord bearing of North 07 degrees 14 minutes 07 seconds West 102.08 feet to an iron pin to be set; thence along same North 01 degree 04 minutes 00 seconds West 185.96 feet to an iron pin to be set, the point and place of BEGINNING. THE above-described lot of land is all of Lot #10 as shown on said Subdivision Plan for Lindenwood recorded as aforesaid, and contains an area of 2.54 acres, more or less. 1 OOL&k ,,c-A,00 C a01 ct; 1v3a(o (Lit ate az sty Now, August 3, 2011, at the time of and immediately before the execution of the construction contract aforesaid, and before any authority has been given by the said Owners to the said Contractor to commence work on the said building, or purchase materials for the same, in consideration of the Owners making of the said contract with Contractor, and intending to be legally bound hereby, it is agreed that no lien shall be filed against the building by Contractor, or any sub-contractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
