The Defendant now Motions this Court to grant the Defendants a minimal of 3 mots th
r

aforementioned property also known as the Defendants place of residence.
The Defendant pleads to this court for this request so the Defendant can save his place of
residence by filing an appeal to the current Writ and the judgment for foreclosure. The Defendant
has proof that the mortgage company has acted in bad faith and breach of contract. Furthermore,
the Defendant will show in their complaint, that the Plaintiff did not serve the Defendant proper
notices to acquire a foreclosure judgment. This should not cause any harm or financial loss to the
Plaintiff, as the Defendant is willing to pay the previously agreed loan modification monthly
payments, which the Plaintiff did not fulfill their contractual obligations.
PRAYER OF RELIEF
WHEREFORE, the Defendant, Eric Foster prays that this Civil Action by the Plaintiff to be
continued later while the defendant files a complaint against the Plaintiff to save his place of
residence for his family that they have known and lived in for many years now.
