PETITION FOR APPOINTMENT OF VIEWERS
AND NOW, COMES, Petitioner/Condemnee, Richard S. Deitch, by and through
his attornevs, Latsha Davis & McKenna, P.C., and offers the following by way of
Petition for Appointment of Viewers, and represents:
1. Petitioner/Condemnee is Richard S. Deitch who resides at 2212 Newville
Road, Carlisle, Pennsvlvani.a 17015.
2. Respondent/ Condemnor is the Pennsylvania Turnpike Commission with
offices at Exit 247 of the Pennsylvania Turnpike system located in Lower Swatara D

Township, Dauphin County, Pennsylvania. Its post office address is P.O. Box 67676,
Harrisburg, Pennsvlvania 17106-7676.
On or about June 4, 20091 the Pennsvlvania Turnpike Commission
contacted Pet] tioner/Condemnee, Richard S. Deitch, owner of certain property in the
'I ownship of West Pennsboro, Cumberland County, Pernnsvlvania, for the purpose of
acquiring property to make improvements to the Pennsvlvania Turnpike.
T Petitioner is the owner of property subject to this Petition for
Appointment of Viewers which has been de facto condemned by the Pennsvlvania
I'urnpike Commission and which is more full, described in the attached Exhibit "A."
?. Responndent% Condemnor was granted a Right of Entry by Petitioner on or
about October 22, 2010, whereby agents of the Turnpike Commission were granted the
right to enter on to the property for the purpose of surveying their proposed project. A
copy is attached hereto as Exhibit "B."
6. Petitioner/Condemnee gave no further permission to Respondent/
Condemnor to be on said property other than as contained in the above-mentioned
Right of Entry, however, nonetheless, contractors and other agents of the Pennsylvania
'l'urnpike Commission began construction of a roadway project on or about Pebruarv
2011, thereby taking in a de facto manner the property of Petitioner/ Condemnee.
7. Respondent/ Condemnor has not filed a declaration of taking in order to
acquire any property interest in the subject property located in said West Pennsboro
Township, Cumberland County, Pennsylvania.

8. Respondent,' Condemnor has not caused any notice of condemnation or
declaration of taking to have been filed or served as required by law.
9. Petitioner/Condemnee is owner of the premises located at West
Pennsboro To?ynship, Cumberland County, Pennsylvania, which property is tine subject
to and part- of the referenced de facto taking; there are no mortgagees or others who
have any interest other than Petitioner in said premises.
10. Petitioner/Condemnee has been deprived of the beneficial use of
t.,njoyment of his property by the wrongful acts of Respondent/Condemnor without
said Respondent/Condemnor having taken the lawful steps to have properly acquired
a legal title interest or right to the premises.
12. By the wrongful acts of Respondent,'Condemnor,
they have phti-sically
appropriated the property of Petitioner/ Condemnee which is highlighted in the
attached Exhibit "A."
11. Petitioner/ Condemned requests this Honorable Court to appoint a Board
of Viewers to ascertain just compensation under the provisions of the Eminent Domain
Code.
WHEREFORE, Petitioner/Condemnee, Richard S. Deitch, pravs this Honorable
Court to find that a de facto taking has occurred, award reasonable appraisal, attorney
and engineering fees and such other costs and expenses incurred, as well as appoint a
Board of Viewers to determine the just compensation damages that

Petitioner/Condemnee has suffered to his property as a result of the taking pursuant to
Section 502(x) and (c) of the Eminent Domain Code, 26 P.S. § 1-502, ct se(j.

THIS INDENTURE, made on 1 t]1010 , by Richard S Deitch, affected by the construction or
improvement of the above mentioned way, it's heirs, executors, administrators, successors, and/or
assigns, hereinafter, whether singular or plural, called the OWNER, and the Pennsylvania Turnpike
Commission, hereinafter called the COMMISSION,
WITNESSETH:
WHEREAS the amount of just compensation due the OWNER for the property of the OWNER required for
the said transportation project has not yet been agreed upon; and
WHEREAS the OWNER is desirous that construction or improvement of the said transportation project be
undertaken by the COMMISSION without undue delay;
NOW, THEREFORE, in consideration of the COMMISSION'S agreement hereby given to proceed with the
construction, the OWNER hereby grants the COMMISSION, its employees, agents, and/or contractors the right to
enter upon the portion of the Owner's property which is required for the above transportation project as shown on the
plans attached hereto and made a part hereof, for the purpose of undertaking the right to survey a portion of the
property, said right to enter to take effect upon the execution of this instrument.
PROVIDED, HOWEVER, that this instrument shall in no way be construed as affecting the Owner's right to
receive just compensation for the property required for the transportation project, whether such property be eventually
purchased or condemned by the COMMISSION.
IN WITNESS WHEREOF the Parties hereto have executed or caused to be executed these presents, intending
to be legally bound thereby.
