THIS AGREEMENT made the ~ day of ~C~ , 2004,
by and between
(hereinafter referred ~o as "CONT~CTOR"), and CL~SON F.
ZI~E~ and ROS~E ZI~E~,(hereinafter referred to as
"O~ER"). The O~ER is actin~ as his o~ General Contractor
concerning the const~ction of a chicken house on the hereinafter
referred to property, and the O~ER ~ CONT~CTOR have entered
into an a~reement (herein "AGREEMENT") whereby the CONT~CTOR
~dertook and agreed to do the followin~ work:
the erection and const~ction of the buildin~ of O~ER's, which is
situated on that certain lot of ~o~d o~ed by O~ER and situate
in Pe~ To.ship, Cu~erland Cowry, Pe~sylvania, which is more
particularly described in Deed dated J~e 10, 2004, and recorded
in the office of the Recorder of Deeds in and for Cu~erland
Co~ty, Pe~sylvania, on J~e %% 2004, in Deed Book~
Page~ , which is inco~orated herein by reference.
NOW THEREFORE, THIS AGREEMENT WI~ESSETH: That the
CO~TT~CTOR, for and in consideration of the sum of ($1.00) Dollar
to CONT~CTOR in hand paid by O~ER, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the ~ove
referred to A~reement between the par~ies, for CONT~CTOR and all
of CO~CTOR's s~contractors (and all parties actin~ through or
~der them), covenants and a~rees that no mechanic's liens or
claims shall be filed or maintained by it or them or any of them
against the building(s) and the 10t of ground upon which the
building is situated (as referred to above) for or on account of
any work done or materials furnished by them or any of them under
the Agreement or otherwise, for, towards, in~ or about the repair
or renovation or erection and construction of the building(s) on
the lot referred to above, and the CONTRACTOR, for themselves,
their subcontractors and others under them, hereby expressly waive
and relinquish the right to have, file, and maintain any
mechanic's liens or claims against the buildings or lot, and agree
that this instrument, waiving the
independent covenant.
