Bankert, a former client of my father-in-laws, Robert E. Myers, Esq., of New Cumberland, passed away on August 15, 2011. I had assisted Ken and Bob Myers in the drafting and redrafting of Ken's Will through what appeared to be the latest Will executed by Kenneth Bankert, on February 12, 2007. After reviewing Mr. Bankert's 2007 Will and the order of appointment of personal representatives, Inoted that his first named representative, i.e. his sister, Romayne Ragusa, had predeceased Ken, leaving James Samois next in line as substitute executor, to be followed by James Huffer, if need be. I also knew from Bob Myers' file that Kathleen Huffer, James' wife, had been one of the agents appointed by Ken under a Power of Attorney. On August 17, 2011, I called the Huffer residence and left a voicemail on their answering machine advising who I was and that I was in possession a 2007 Will executed by Ken Bankert; I further requested they call me to advise if they had any later Will in their possession or otherwise so that we might arrange for the exchange of various bank and other documents that Kathleen Huffer would have maintained in her role as Ken's attorney-in-fact. I did not receive any reply to this telephone message. In the meantime, over the succeeding days, James Samois advised me that items appeared to be missing from Ken Bankert's residence he expressed concern over the security of that residence as well as the garages Ken leased in the rear of his house. Consequently, our office promptly prepared a Petition for Letters Testamentary for both Mr. Samois and myself as named co-executors. At the same time, in view of the lack of a response from the Hullers, I prepared a letter to them to both advise them of their beneficiary status under the Will and, again, to request the turnover of any property of Mr. Bankert's remaining in their possession. After a second trip to your office on Thursday, August 22, to discuss thde death of Ken's sister, Romayne, so that Letters could be issued and the property secure , I returned to the office only to receive a call from Margie Wevodau within the hour advising that Kathleen Huffer had presented herself at your office with a new Will leading to your revocation of Letters previously issued. This was the same Kathleen Huffer that had not responded to my telephone message. Given the circumstances of the opening of this Estate, I would appreciffee your returning the $883.50 I paid your office approximately an hour before Kathleen Hu showed up to probate a later Will, or at least so much as you deem reasonable under the circumstances, considering your staff was most courteous, helpful and did prepare and provide me with 20 Short Certificates in the process.
