CIVIL ACTION/MORTGAGE FORECLOSURE
1. Plaintiff is Deutsche Bank National Trust Company as Trustee for MSAC 2007-SEA 1, duly
organized and doing business at the above-captioned address.
2. The Defendant is Joy D. Gipe, who is the mortgagor and real owner of the mortgaged
property hereinafter described, and his/her last-known address is 144 3rd Street, Enola, Pennsylvania 17025.
3. On February 6, 2007, Ronald E. Gipe, Sr. and Joy D. Gipe made, executed and delivered a
mortgage upon the premises hereinafter described to Mortgage Electronic Registration Systems, Inc., as
nominee for Decision One Mortgage Company, LLC which mortgage is recorded in the Office of the
Recorder of Cumberland County in Mortgage Book 1982, Page 4796, such Mortgage being incorporated
herein by reference by virtue of Rule 1019(g) Pa. R. C. P.
4. The aforesaid mortgage was thereafter assigned by Mortgage Electronic Registration
Systems, Inc., as nominee for Decision One Mortgage Company, LLC to Deutsche Bank National Trust
Company as Trustee for MSAC 2007-SEA 1, by assignment which will be duly recorded in the office of the
recorder for Cumberland County.
5. On April 15, 2011, Ronald E. Gipe, Sr. departed this life, leaving title vested solely in the
name of Joy D. Gipe by operation of law.
6. The premises subject to said mortgage is described in the legal description attached as
Exhibit "A" and is known as 144 3rd Street, Enola, Pennsylvania 17025.
7. The mortgage is in default because monthly payments of principal and interest upon said
mortgage due December 1, 2010 and each month thereafter are due and unpaid, and by the terms of said
mortgage, upon default in such payments for a period of one month, the entire principal balance and all
interest due thereon are collectible forthwith.
8. The following amounts are due on the mortgage:
Principal Balance $ 130,251.57
Interest through June 22, 2011 $ 5,530.17
(Plus $23.64 per diem thereafter)
Attorney's Fee $ 1,250.00
Late Charges $ 261.66
Recoverable Balance $ 524.10
Escrow Advance $ 379.07
Suspense Balance $ -194.56
GRAND TOTAL $ 138,002.01
9. Notice of Intention to Foreclose as required by Act 6 of 1974 (41 P.S. §403) and
notice required by the Emergency Mortgage Assistance Act of 1983 as amended under 12 PA Code Chapter
13, et seq., commonly known as the Combined Notice of Delinquency has been sent to Defendant by regular
mail with a certificate of mailing and by certified mail, return receipt requested.
WHEREFORE, Plaintiff demands in rem Judgment against the Defendant in the sum of $13 8,002.0 1,
together with interest at the rate of $23.64 per diem and other costs and charges collectible under the
mortgage and for the foreclosure and sale of the mortgaged property. .

ALL that certain piece or parcel of land situate in the Borough of West Fairview, Cumberland County, Pennsylvania, more
particularly bounded and described as follows, to wit:
BEGINNING at a point on the west side of Third Street, said point being at a distance of 70.63 feet measured in a
southerly direction from State Street; thence along Third Street South no degrees 45 minutes West 200.65 feet to a
stake; thence South 88 degrees 44 minutes West 35.63 feet to a point on Pennsylvania State Highway; thence along
State Highway North 23 degrees 01 minute West 108.71 feet to a point; thence along said State Highway North 27
degrees 11 minutes West 100 feet to a stake; thence along lands now or formerly of Lillian M. Fenical, North 84 degrees
26 minutes East 129 feet to a point, the place of BEGINNING.
Being the same property acquired by Ronald E. Gipe, Sr. and Joy D. Gipe, by Deed recorded 04/16/1973, of record in
Deed Book C25, Page 391, in the Office of the Recorder of Cumberland County, Pennsylvania.
