THIS IS AN ATTEMPT TO COLLECT A DEBT
ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE
1. Plaintiff is Susquehanna Bank, successor by merger to Community Banks, corporation
organized and existing under state law, with offices for the conduct of business at 13511 Label
Lane, Hagerstown, MD 21740.
2. Defendants, Ernest E. Bolton and Laurie A. Bolton are the mortgagors and real
owners of premises 40 North Enola Drive, Enola, PA 17025, hereinafter described, whose last
known address is listed in the caption.
3. Plaintiff brings this action in mortgage foreclosure against defendants, mortgagors and
real owners, to foreclose a certain indenture of mortgage made, executed and delivered by the
above named defendants, mortgagors and real owners to Blue Ball National Bank on August 3,
1993, which mortgage is recorded on August 10, 1993 in the Office of the Recorder of Deeds of
Cumberland County in Mortgage Book 1156, Page: 436, secured on premises 40 North Enola
Drive, Enola, PA 17025 a true and correct description of which is attached hereto as Exhibit I.
4. On July 1, 2005 Blue Ball National Bank Aquired Community Banks as evidenced by
Articles of Merger attached hereto as Exhibit Il.
5. On November 17, 2007 Susquehanna Bank acquired Community Banks as evidenced
by Agreement and Plan of Merger attached hereto as Exhibit III.
6. Plaintiff alleges each and every term, condition and covenant in the aforesaid
mortgage, and hereby incorporates them herein by reference thereto.
7. The aforesaid mortgage is in default in that monthly installments of principal and
interest have not been made in conformity with the terms of the mortgage, from December 2009
and each month thereafter, up to and including the present time.
8. Under the terms of the aforesaid mortgage, upon default of payments set forth in the
mortgage documents, the entire principal balance and all interest due thereon are collectible.

9. The following is an itemized statement of the amount due plaintiff under the terms of
the aforesaid mortgage:

10. The attorney's fees set forth above are in conformity with the mortgage documents
and Pennsylvania Law and will be collected in the event of a third party purchaser at Sheriffs
sale. If the mortgage is reinstated prior to the Sheriffs sale, reasonable- attorney's fees will be
charged based on work actually performed.
11. Plaintiff sent to defendants, mortgagors and real owners a combined Notice and
Warning of Intention to Foreclose and Notices of Homeowners' Emergency Mortgage Assistance
Act of 1983 advising of rights available under the statutes. To date payments have not been
received and Act 91 as amended by Act 160 of 1998 assistance has not been granted, although
the applicable time periods provided by statute have expired (Exhibit IV).
WHEREFORE, plaintiff demands judgment for foreclosure and sale of the mortgaged
premises in the amount of $19,120.55, plus per diem interest at $2.37 from September 2, 201,1 to
the date of judgment plus costs thereon.

MERGER OF BLUE BALL NATIONAL BANK WITH AND INTO COMMUNITY BANKS
In compliance with the provisions of Chapter 16 of the Banking Code of 1965, as amended (Title
7, Chapter 16 of Purdon's Statutes), COMMUNITY BANKS, a Pennsylvania banking institution and
wholly-owned subsidiary of COMMUNITY BANKS, INC., a Pennsylvania corporation and bank holding
company ("CMTY"), and BLUE BALL NATIONAL BANK, a national banking association and wholly
owned subsidiary of PennRock Financial Services Corp. ("PRFS"), desiring to effect a merger, hereby
state that:
1. The resulting institution will be COMMUNITY BANKS.
2. The registered office of the resulting institution and its principal place of business in the
Commonwealth of Pennsylvania is 150 Market Square, Millersburg, Dauphin County, Pennsylvania

THE BANK MERGER

conditions of this Bank Merger Agreement and the Holding Company Merger Agr•ment, in

Section 1.2 hereof), CommunityBanks shall merge with and into Susquehanna Bank PA.
Susquehanna Bank PA shall be the surviving entity (sometimes referred to herein as the
"ggt eNiag Bank"} of the Bank Merger and shall continue its vistence as a Pennsylvania state
chartered bank and trust company following consummation of the Batik Merger. Upon
consummation of the Bank :Merger, the separate existence of CommunityBanks shall cease.

Holding Company Merger Agreement, following the execution of this Bank Merger Agreement,
