IAN W. HARVEY and KAREN HARVEY, with an address of 19 Graylyn Drive, Fairview,
North Carolina, hereinafter called "Owner", have entered into a contract with J. W. Mumper
Construction, Inc., with an address of 4 Woodstock Court, Mechanicsburg, Pennsylvania,
hereinafter called "Contractor", for the improvements of a residential dwelling upon land of Owner
having an address of 3 Antietam Court, Lot 67 Hillside Farms, Mechanicsburg, Cumberland
County, Pennsylvania, being more particularly bounded and described in Exhibit "A" attached
hereto.

NOW, this day of 2011, before any authority has been given by the
said Owner to the said Contractor to commence work on the said improvements or purchase
materials for the same, in consideration of the making of the said contract with Owner and the
further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien
shall be filed against said property described in Exhibit "A" by the Contractor, or any sub-
contractor, nor by any of the material-men or workmen or any other person for any labor, or
materials purchased, or extra labor or materials purchased for the installation and construction of
said improvements, the right to file such liens being expressly waived.

LEGAL DESCRIPTION
ALL THAT CERTAIN tract of land situate in Township of Silver Spring
Township, County of Cumberland, and Commonwealth of Pennsylvania,
bounded and described as follows, to wit-
BEGINNING at a point on the westerly line of Antietam Court at the corner of
Lot No. 68 of the hereinafter mentioned Subdivision Plan; THENCE by Lot No.
68, South 69 degrees 09 minutes 05 seconds West, a distance of 271.25 feet to a
point on the westerly line of Harpers Ferry Way; THENCE by the westerly line
of Harpers Ferry Way North 03 degrees 45 minutes 44 seconds East, a distance
of 5.88 feet to a point; THENCE by same by a curve to the left having a radius
of 525.00 feet, an are length of 275.07 feet to a point; THENCE by same by a
curve to the right having a radius of 20.00 feet, an arc length of 29.76 feet to a
point at the comer of Lot No. 66 of the hereinafter mentioned Plan of Lots;
THENCE by Lot No. 66 South 66 degrees 23 minutes 37 seconds East, a
distance of 327.59 feet to a point on the western line of Antietam Court;
THENCE along the western line of Antietam Court by a curve to the left having
a radius of 95.00 feet, an are length of 73.71 feet to a point, the place of
BEGINNING.
BEING Lot No. 67 of the Final Subdivision Plan for Hillside Farms - Phase V,
dated July 10, 2006, last revised December 29, 2006, prepared by H_ Edward
Black & Associates, P.C., and recorded in the Office of the Recorder of Deeds
of Cumberland County, Pennsylvania to basttument No. 200820865.
UNDER AND SUBJECT to a Declaration of Covenants and Restrictions dated
April 30, 1996 and recorded in the Office of the Recorder of Deeds of
Cumberland County, in Misc. Book 529, Page 333, as amended by an
Amendment to Declaration of Covenants and Restrictions, dated September 30,
1997, recorded in the Office of the Recorder of Deeds of Cumberland County, in
Miscellaneous Book 562, Page 52 and as further amended by a Second
Amendment dated June 29, 2000, recorded in the Office of the Recorder of
Deeds of Cumberland County, in Misc. Book 648, Page 702, and as amended by
