Your petitioner, who is 18 years of age or older an the executor named in thc last Will of the above
decedent, dated October 2, 1985 and codicil(s) dated n/a. Mildred G. Getty died August 7, 2002.
Decedent was domiciled at death in Cumberland County, Pennsylvania, with his last family or
principal residence at 3271 Spring Road, Carlisle, PA 17013.
Decedent, then 86 years of age, died July 16, 2004, at Sarah A. Todd Memorial tlome.
Except as follows, decedent did not marry, was not divorced and did not have a child born or adopted
after execution of the Will offered for probate; was not the victim of a killing and was never adjudicated

I, t~NNETH ~. GETTY, of 3271 Spring Road, ~liddlesex Township, Cumberland
County, Pennsylvania, being of sound and disposing mind, memory and understand-
ing, do hereby nmke, publish and declare this as and for my Last Will and Testa-
ment, hereby revoking all other wills and codicils heretofore made by me.
FIRST: I direct that all my just debts and funeral expenses, includin~
my grave marker and all expenses of my last illness, shall be paid from the
assets of my estate as soon as practicable after my decease, as a part of the
expense of the a&ninistration of n~/ estate.
SECOND: I give, devise and bequeath the residue of my estate, of every
nature and wherever situate, to my wife, ?~ldred G. Getty, providing she shall
survive me by thirty (30) days.
THIRD: Should my wife, 5{ildred G. Getty, predecease me or die on or
before the thirtieth day following my death, I then give, devise and bequeath
estate as follows:
I give, devise and bequeath all of my stock to my children who
survive me by thirty (30) days, to be distributed to ~em in
equal shares. Should any of my children predecease me or die
on or before the thirtieth day following my death, then I give,
devise and bequeath the share of my stocks to ~ich the de-
ceased child would have been entitled, to his or her issue,
per stirpes, living on the thirty-first day following n~
death; and in default of such then-living issue, such share of
stocks shall be added to the share or shares for my o~er
children.
I give, devise and bequeath the smn of One Thousand Dollars
($1,000.00) to each of my grandchildren who shall be living
on the thirty-first day following my death.
I give, devise and bequeath the sum of One Thousand Dollars
($1,000.00) to St. John's Episcopal Church of Carlisle,
Pennsylvania.

I direct nF Executor, hereinbelow named, to allow my children
to choose such items of household and personal effects (not
including cash, securities and automobiles) to which they can
~tually agree. As to property about which there is no unani-
mous agreement, I direct my Executor to divide said property
mnong them, in its sole and absolute discretion, in as nearly
equal portions as may be practScable, having due regard to
the personal preferences of my children, and my preferences as
set forth on my last-dated memorandum, with the understanding
that said memorandum shall not be binding, nor form any part
of myWill. All renmining kousehold and personal effects (not
including cash,, securities and automobiles) not distributed to
my children shall be sold, and the proceeds thereof added to
the residue of my estate and distributed in accordance with
Item Third, Paragraph g.
direct and authorize my Executor to sell'my automobile or

the proceeds thereof are to be added to the residue of my estate
and distributed in accordance with Item Third, Paragraph g.

to buy my automobile or automobiles and my personal residence at
a price in accordance with the valuation of the property estab-
lished for payment of the Pennsylvania Inheritance Tax. Shoulc!
none of my children desire to purchase my automobile or automo-
biles and/or my personal residence, or should all of my d~.Idren
be -unable to agree as to which one ~-~dividual chi~ can
any of the above referred to items, or in the event that ~r~y ch~]ld
who desires to purc~nse m~y of the above referred to items (wi~h
the concurrence of the other children) fails to so purchase said
item within ninety (90) days from the date of my death, rhe'n
in that event my F. xecutor is directed and authorized to se] 1 the
same, either at public or private sale, and in such manner ~
in its sole discretion, shall determine.
If, at the tS]ae of 'my death, I own the premises situate at 171
Faith Circle, North Middleton Township, Cumberland County,
sylvania, I give, devise and bequeath said pre~nises, together
with any policies of insurance thereon and subj eot to any mort-
gage encumbrance, to my daughter, 'Kathy G. Holtry, on the condi-
tion' that she execute and deliver within two (2) months from the
date of my death, a demand judgment note irt the Frincipal ~unount
of Five Thousand Dollars ($5,000.00), without interest thereo~:
payable to the order of my. son, Kenneth W. Getty, Jr., or to his
issue should he predecease me ~ said principal sum being due m-~.d
payable upon distribution of the assets of my estate, and cn the
further condition that she execute and deliver within two
months from the date of my death an additional demand note in the
principal sum of Five ~lhousand Dollars ($5,000.00), without
retest thereon, payable to the order of m7 daughter, 3:~3nn G,
man, or to her issue should she predecease me, said principal
being due and paytfule upon distribution of the assets of m7
estate. Should my daughter, Kathy G. Holtry, fail to execute and
deliver both demand judgment notes referred to above ~J.thin
two (2) months from the date of n~/ death,

then I direct and authorize my Executors t.o sell the same,
either at public or private sale, and in such manner as
it, in its sole discretion, shall determine, and the
proceeds from said sale shall be added to the residue
of my estate and distributed in accordance with Item Third,
Paragraph g.
I give, devise and bequeath the residue of my estate, of every
nature and wherever situate, to my children, equally, provided
that the share of any child who predeceases me or dies on or
before tAe thirtieth day following my death shall be distri-
buted to his 6r her issue, per stirpes, Iiving on the thirty-
first day following my death, and in default of such then-
living issue; such shares shall be added to the share er
for my other children or his or her issue; excepting however
that any such share for a child of my dm~ghter, Kathy G.
Holtry, then under the age Of t~enty-five (25) years shall
be held in separate trust for the following uses and
purposes;
(i) Trustee shall accumulate the income; however, as much
of the income, accumulated income and principal of this
Trust 'as Trustee may, from time to time, think a<b~isab].e
for the support and education (including college
education, graduate 'and undergraduate, and vocational
training ~d trade school education) of each beneficiar/,
or during illness or emergency, shall be either paid to
him or her, or else be applied directly for his or her
· benefit by tJ~e Trustee, after taking into consideration
his or her Other readily available assets and sources of
income. 'It is my desire that my Trustee not make m,.y
payments directly to the natural father, of said children~
if in fact, he is their gmardian, but either make pay-
ments directly to said child or children or else apply
funds directly for tJ~e benefit of said children.
(ii)
T~astee shal3 distribute the entire then-remaf2,~i~:g
principal and any accumulated or undistributed ~come
to each beneficiary when he or she attains the age
of twenty-five (25).
~iii) Should any beneficiary otherwise entitled to a share
of any such separate Trust' die Before attaining the age
for final distribution, the' Trustl for that beneficial/
shall terminate at his or her death, and T~astee shall
distribute the share of such deceased beneficiary to
his or her tben-living issue> per stirpes, if may. lin
default of any such then-living'issue, the share for
such deceased c]~ild shall be added to the share or shares
of his or her then-living brothers and/or sisters. The

share 'of any such deceased brother and/or sister shall
be distributed to his or her then~living issue, per
stirpes, if any, and in default of any then-living
brothers and/or sisters, or issue thereof, said share
shall be ~listributed equally to my other children.
The share of any child who is not living on the date
of distribution shall be distributed to his or her
issue, per stirpes, if any, living on the date of
distribution, and in default thereof, said share
shall be added .to the share or shares of my other
children, or his or her issue. The share for any
beneficiary whose original share is then being held in
Trust shall be added to that Trust.
(iv)
All shares of principal and income hereby given shall
be free fr°m anticipation, assignment, pledge or
obligation of the beneficiaries, and any of them,
and shall not be. subject to any execution, attachment,
levy.or sequestration, or. o~her claims of the creditors
of said beneficiaries, or any of them.
(v) The Trustee shall have the power in its sole discretion
to combine separate, trusts into one trust in the event
the Trustee should deem the stone advisable for the
purposes of more convenient an& orderly administration
9f the trust or trusts.
FOURTH: I appoint the Farmers Trust Company, of Carlisle,
Pennsylvania, Trustee of all Trusts established or created in this, .~ Las~'
Will and Testament. No Trustee acting hereunder shall be required to post bond
or enter security in this or any other jurisdiction.
FIFTH: In addition to the provers given to them by law~ my corpor~te
Trustee, the Farmers Trust Company, shall have the following powers app!icablc~
to all property, whether principal or income, exercisable without court approv al
and effective until actual distribution of the property;
(a)
To retain any or all of the assets of my estate, real or persona].,
including stock of Trustee, without regard to any principle
diversification or risk.
To invest in all fo~ns of property (including stock, colmnon
funds and mortgage investment funds, whether operated by- Trustee
or others), without restriction on investments authorized for
Pennsylvania fiduciaries, as they deem proper, and without any
regard to any principle of diversification or risk.
SIXR]-I: I direct that all taxes that may be assessed ~q consequence
of my dearie, of whatever nature and by whatever jurisdiction imposed, shall be
paid from my residuary estate as a part of the expense of the ad~inistratien
of my estate.

SE¥%N~t: I nominate, constitute and appoint my wife, B~ldred G. Getty,
Executrix of this, my Last Will and Testament. In the event of the renunciation
death, resigmation or inability to act For any reason whatsoever of the said
Mildred G. Getty, and should my son, Kenneth W. Getty, Jr., live and reside
within the continental United States, I nominate, constitute and appoint Kemleth
W. Getty, Jr., Executor of this, my Last Will and Testm~ent. Should ~N son,
Kem~eth W. Getty, .Ir., not live and reside within the continental [Mited States,
or in the event of the renunciation, death, resignation or inability to act for
any reason whatsoever of the said Kemleth W. Getty, .Ir., I nominate, constitute
and appoint the Fa~m~ers Trust Company of Carlisle, Pennsylvm]ia, Executor of
this, my Last Will and Testament. I hereby direct that my Executrix m~d her
successors should not be required to give bond for the faithful performance of
their duties in this or any other jurisdiction.

LAST WILL AND TESTAMENT

KENNE1H W. GETTY
I, KENNE'IH W. GETTY, of 3271 Spring Road, Middlesex Township, Cumberland
C01.U1ty, Pennsylvania, being of sOlmd and disposing mind, memory and1U1derstand-
ing, do hereby make, publish and declare this as and for my Last Will and Testa-
ment, hereby revoking all other wills and codicils heretofore made by me.
FIRST: I direct that all my just debts and funeral expenses, includin
my grave marker and all expenses of my last illness, shall be paid from the
assets of my estate as soon as practicable after my decease, as a part of the
expense of the administration of my estate. ~
SEffiND: I give, devise and bequeath the residue of my estate, of every
nature and wherever situate, to my wife, Mildred G. Getty, providing she shall
survive me by thirty (30) days.
1HIRD: Should my wife , Mildred G. Getty, predecease me or die on or
before the thirtieth day following my death, I then give, devise and bequeath my
estate as follows:
a. I give, devise and bequeath all of my stock to my children who
survive me by thirty (30) days, to be distributed to them in
equal shares. Should any of my children predecease me or die
on or before the thirtieth day following my death; then I give,
devise and bequeath the share of my stocks to which the de-
ceased child would have been entitled, to his or her issue,
per stirpes, living on the thirty-first day following my
death; and in default of such then-living issue, such share of
stocks shall be added to the share or shares for my other
children.
b. I give, devise and bequeath the sum of One Thousand Dollars
($1,000.00) to each of my grandchildren who shall be living
on the thirty-first day following my death. .
c. I give, devise and bequeath the sum of One Thousand Dollars
($1,000.00) to St. John's Episcopal Church of Carlisle,
Pennsylvania.
d. I direct my Executor, hereinbelow named, to allow my children
to choose such items of household and personal effects (not
including cash, securities and automobiles) to which they can
mutually agree. As to property about which there is no 1U1ani-
mous agreement, I direct my Executor to divide said property
among them, in its sole and absolute discretion, in as nearly
equal portions as may be practicable, having due regard to
the personal preferences of my children, and my preferences as
set forth on my last-dated memorandum, with the understanding
that said memorandum shall not be binding, nor form any part

in its sole disc'retion, shall determine.
f. If, at tlle time of my death, I own the premises situate at 171
Faith Circle, North Middleton Township, Cumberland County,' Penn-
sylvania, I give, devise and bequeath said premises, together
with any"policies of insurance thereon and subject to any mort-
gl;ge encumbrance, ,to my daughter, 'Kathy G. Holtry, on the condi-
tion'that she execute and deliver, wi thin two (2) months from the
date' of my death, . a demand judgment note mtheprinci.pal amourlt
of Five Thousand Dollars ($5,000.00) ,Witllout interestthereol1, ,
payable to'the order of my, son, Kenneth W. ,Getty, Jr., or to hi.s
issue should he predecease 'me, said principal sum being due ,and
payable upon distribution of 'the assets of my estate" and on the
further condition that she execute and deliver within two (2)
months from the date of my death an additional demand note in the
principal sum of Five T'nousand Dol1ars($5,OOO.OQ), without in-
terest thereon, payable to the order ,of my daughter, J'o.Ann G. Speal.

nature and wherever situate, to my children, equally, provided
that' the share of . any 'child who predeceases me or dies on or

of the income, accumulated income and principal of this
Trust 'as Trustee may, from ,time to time, think advisable
for the support and education (including college
education, graduate 'and.. undergraduate , and vocational
training and trade school education) of each beneficiary,
or during illness or emergency, shall be either paid to
him or her, or else be applied directly for his or her
, benefit by the Trustee; after taking into consideration
his or'her other readily available assets and sources of
income. 'It is my desire that my Trustee not make any
payments directly to .the natural father, of sa.;Ld children,
if in fact, he is their guardian, but either malce pay--
ments'directly to said child or children 'or else apply
'funds directly for the benefit of said c.hildren. '

of distribution shall be distributed to his or her
issue, per stirpes, if any, living on the date of
distribution, and in default thereof, said share

children, or his or he.r .iss1,1e. .The share for any
beneficiary whose original share is .then being held in
Trust shilll be' aclded . to that Trust.
All shares of principal and income hereby gi ven shall
be free froin antiCipation, assigru:nent, pledge or
obligation of the beneficiaries, and any of them,
and shall not be. subject .to any execution, attachment,
levy.or seques.tration, oreotiler .claims of the creditors
'of said beneficiaries, or any of them.
The Trustee shall have the power in its sole discretion
to combine separate. trusts into' one .trust in the event
the Trustee should deem the same advisable for the
purposes of more convenient and. orderly administration
of the trust or truSts.
FOURTH: . r appoint the Fanners' frust Company, of Carlisle,
PennSylvania, Trustee of all Trusts established or created in this, my Last
Will and 'Testament. No .Trustee acting hereunder shall be required to post bond
or enter security in this or any other juris4iction.

or others), without restriction on investments authorized for
Pennsyl vania fiduciaries, as they deem proper, and without any
regard to any principle of diversification or risk.
SIXTH: . I direct that all taxes that may be assessed in consequence
of my death,' of whatever nature and. by whatever jurisdiction imposed, shall be
paid from my'residuary estate as a part of the expense of the, administration
of my estate.

Executrix of this, my Last Will and Testament. In the event of the remmciation
death, resignation or inability to act for any reason whatsoever of the said
Mildred G. Getty, and should my son, Kenneth W. Getty, Jr., live and reside
within the continental United States, I nominate, constitute and appoint Kenneth
W. Getty, Jr., Executor of this, my Last Will and Testament. Should my son,
Kenneth W. Getty, Jr., not live and reside within the continental United States,
or in the event of the renunciation, death, resignation or inability to act for
any reason whatsoever of the said Kenneth W. Getty, Jr., I nominate , constitute
and appoint the Farmers Trust Company of Carlisle, Pennsylvania, Executor of
this, my Last Will and Testament. I hereby direct that my Executrix and her
successors should not be required to give bond for the faithful performance of

Here is the information your letter requested:
Mr. Getty had a joint checking ;iCcount with his daughter, Kathy G. Holtry. It was
opened as ajoint account on August 19,2002. There were no direct retirement deposits
connected to that account.
The account was one of our Senior Citizen accounts, and had no interest accrued at the
time of his death. The balance as ofJuly 16tb was $317.64.
He also had a safe deposit box with us, #36043. Ken Jr. was authorized to enter the box
as appointed deputy. Ken Jr. did enter the box on 7/23/04 to look for the will. The box
will need inventoried.

2. One (1) filter rack.
3. One (1), two (2) stage heating and one (1) stage cooling thermostat.
4. One (1) complete plumbing package to heat pump system.
5. Removal and disposal of existing heat pump and ale system.

Payments to be made in progressive billings.
1. $5,000.00 down payment to schedule job, balance upon completion
1. HMI not responsible for anything more than rough grade only to lawn. Home
owner will need to provide on site disposal of extra ground fill.
2. If easing is required it will be biDed at time and materials with a labor rate of
$125.00 per hour.
3. If substantial water is encountered during drilling process, on site water
management, erosion and sedimentation control will be billed at time and
materials. Labor rate is 565.00 per hour.
4.HMI not responsible for fees or permits required by local municipalities or
agencies in the completion of this contract.
5. No rock, hardpan, or frozen ground excavation of trenches is included in this
contract. Equipment and labor for these circumstlUlces is extra.
6. If diabase rock formations are encountered add S3.00 per foot for drilling.
Options:
1. Steam humidifier at $1,275.00
2. Honeywell media filter at $750.00
3. Ultraviolet PurifYing system for bacteria reduction of indoor air at $975.00
4. Verkon fogging for mold and bacterial elimination at $675.00
We propose to furnish material and labor complete in accordance with the foregoing
specifications. Payment is due within thirty days (30) of the date of each invoice.
Filly unpaid balances after thirty days (30) from the date of each invoice will be
subject to a fmance charge of 1 Y:. per month (18 % per year).

In the event that it should be necessary for Hoffman Mechanical, Inc. to initiate legal
proceedings for the enforcement of this agreement or any valid modifications hereof,
Hoffman Mechanical, Inc. shall be entitled to reasonable counsel fees and reasonable
related expenses incurred. Reasonable counsel fees hereunder shall be defined as
reasonable hours expected at the then hourly rate of counsel for Hoffman Meehanical,
Inc. Such counsel fees shall extend to any independent proceedings necessary to
collect counsel fees.
All materials are guaranteed to be as specified. All work shall be completed in a
workmanlike manner according to standard practices. Any alterations or deviation
form the specifications herein involving extra costs will be executed only after
consultation and appmval by the party accepting this proposal and will become an
extra charge over and above the estimate. All agreements are contingent upon strikes,
accidents or delays beyond our control. Hoffman Mechanical, Inc. will maintain
commercial general liability, business automobile and workers compensation
insurance for the duration of the work Any additional insurance coverage will be the
responsibility of the owner or the party accepting this proposal

ESCROW AGREEMENT
THIS AGREEMENT, made and entered into this 30th day of June, 2005, by and between,
THE ESTATE OF KENNETH W. GETTY, by and through Kenneth W. Getty, Jr., as
Executor, hereinafter known as SELLER, and HEIDI CONNOLE, hereinafter also known as
PURCHASER.
WHEREAS, at the time of settlement of the premises designated as 3271 Spring Road,
Carlisle, Middlesex Township, Cumberland County, Pennsylvania 17013, said premises needs
the following completed.: Geothermal system repair and oil base system and solar system repair;
and
WHEREAS, the parties are desirous of escrowing funds from SELLER until all work is
complete.
NOW, THEREFORE, in consideration of the foregoing and other good and valuable
considerations, it is agreed, as follows:
1. The sum of Sixteen Thousand and no/I 00 ($16,000.00) Dollars will be held in an
escrow account by the law firm of Salzmarm Hughes, P.C. in accordance with the terms and
conditions of this Agreement. The funds held hereunder are for geothermal system repair and oil
base system and solar system to be repaired. The escrow agent hereunder shall be indemnified
and held harmless for any and all claims, demands or liabilities whatsoever in connection with
this Agreement. Nothing herein shall prevent the escrow agent from acting as legal counsel to
the PURCHASER for any dispute arising out of agreement.
2. It is understood and agreed that the funds withheld are for that purpose only.
Once the work is completed to the satisfaction of the PURCHASER the balance of the escrowed
funds shall be retumed to the SELLER. If the costs of the work contemplated hereunder exceed
the amount held in escrow, then in that event, PURCHASER shall be solely responsible for any
and all other costs to complete the same.
3. All improvements must be ascertained within forty-five (45) days of the date
hereof. PURCHASER shall commence with the contemplated repairs and diligently pursue
completion of the same and submit all billing to Escrow Agent for payment.
4. This Escrow Agreement represents the entire agreement between the parties, and
may not be modified or altered except by a subsequent written agreement executed by and
between the parties hereto.
5. The parties hereby agree that the terms and conditions of this Agreement shall
bind and inure to the benefit of their heirs, executors, administrators, successors and assigns.
6. This Agreement shall be interpreted and construed under the laws of the
Commonwealth of Pennsylvania.
IN WITNESS WHEREOF, and intending to be legally bound, the parties hereto have
hereunto set their hands and seals as of the day and year first above written.
