MOTION TO MAKE RULE ABSOLUTE
TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
AND NOW, comes the Petitioner, DAVID H. RADCLIFF, and moves your Honorable Court as
follows:
1. On August 5, 2011, Your Honorable Court issued a Rule in the above captioned
Estate directing Julie F. Gale, Executor, to show cause why an Order should not be entered
permitting the Petitioner to withdraw his appearance as attorney for Julie F. Gale, individually and
as Executor of the Estate of Howard C. Gale, Sr.
2. An Affidavit of Service filed September 9, 2011, set forth service on all beneficiaries
of the Estate of Howard C. Gale, Jr., and on Julie F. Gale.
3. No objections to the granting of the relief requested were filed on or before the
twentieth day after service of the Rule.
WHEREFORE, David H. Radcliff respectfully requests your Honorable Court to make the Rule
absolute and issue an Order permitting the Petitioner to withdraw his appearance for Julie F. Gale,
individually and as Executor of the Estate of Howard C. Gale, Sr.
