Dorothy Deaven currently resides at Golden Living Center, West Shore, 770 Popular Church Road, Camp Hill, Cumberland County, Pennsylvania. 3. On May 12, 2011, a Petition for the Appointment of Permanent Plenary Guardian of the Person and Estate of Dorothy Deaven was filed in the Orphan's Court Division of the Court of Common Pleas, in and for Cumberland County, Pennsylvania to No.21-11- 0579 and on June 14, 2011, after hearing Dorothy Deaven was adjudicated to be an incapacitated person and Cumberland County Aging & Community Services was appointed Permanent Plenary Guardians of the Person and Estate of Dorothy Deaven. A copy of the Final Decree dated June 14, 2011 is attached hereto, marked as Exhibit "A", and incorporated herein by reference. 4. Prior to moving to Golden Living Center, West Shore, Dorothy Deaven resided at 712 Middle Lane, Camp Hill, Cumberland County, Pennsylvania. 5. Public records reflect that Dorothy Deaven is the owner of the real estate situated at 712 Middle Lane, Camp Hill, Cumberland County, Pennsylvania. A copy of the Deed for said property is attached hereto, marked as Exhibit "B", and incorporated herein by reference. 6. Eugene M. Deaven, husband of Dorothy Deaven, died on May 31, 1990 and, by operation of law, title to said premises vested solely in Dorothy Deaven. A copy of the Obituary for Eugene M. Deaven is attached hereto, mazked as Exhibit "C", and incorporated herein by reference. 7. The real estate presently sits empty but is in fair condition. 8. The Cumberland County Tax Assessment on 712 Middle Lane, Camp Hill, identified as Parcel No.: 09-18-1304-114 is assessed at $177,000.00. A copy of the assessment is attached hereto, marked as Exhibit "D", and incorporated herein by reference. 9. An appraisal of said property was conducted on July 22, 2011 by Diversified Appraisal Services of 35 East High Street, Suite 101, Cazlisle, Cumberland County, Pennsylvania and the fair mazket value was determined to be $107,000.00. A copy of the appraisal is attached hereto, mazked as Exhibit "E", and incorporated herein by reference. 10. The Petitioner believes and, therefore, avers that there is an outstanding mortgage of record to Orrstown Bank dated August 11, 2009 in the amount of $28,200.00. 11. Cumberland County Aging & Community Services the appointed Permanent Plenary Guazdian of the Person and Estate of Dorothy Deaven believes and, therefore, avers that the sale of said real estate is in the. best interest of the Estate of Dorothy Deaven and the proceeds from said sale will be needed to pay for her continuing care at Golden Living Center, West Shore. 12. The Petitioner will engage the services of an Auctioneer to sell the property and said sale shall take place on Saturday, Ocotber 8, 2011. 13. If and in the event that the real estate does not sell at auction, then and in such event, the Petitioner will engage the services of a realtor to sell said real estate. 14. Michael J. Whare, Esquire, the attorney who represented Dorothy Deaven in the prior Guardianship Hearing, has been advised that Cumberland County Aging & Community Services would petition the court to sell said real estate and Mr. Whare does not object to the relief requested by Cumberland County Aging & Community Services to sell the properly. WHEREFORE, the Petitioner respectfully requests that this Honorable Court enter an Order directing the sale of 712 Middle Lane, Camp Hill, Cumberland County, Pennsylvania (Parcel No.:09-18-1304-114) owned by Dorothy Deaven, "AS IS - WHERE IS" with all faults and current conditions to an appropriate buyer and that Petitioner be authorized to execute any and all documents relating to the sale by signing as Guardian of the Person and Estate of Dorothy Dea~en. The Court appoints the Cumberland County Aging & Community Services, in and for Cumberland County, Pennsylvania, as Permanent Plenary Guardians of the Pelson and Estate of Dorothy Deaver. Cumberland County Aging & Community Services shall be entitled to charge a fee pursuant to the fee schedule set forth in the Petition and, at such tithe as there are insuFficient assets to continue payment of said fee, Cumberland County Aging & Community Services shall be entitled to receive a Guardian fee subject to a maximum of IOS6 of Dorothy Deaven's gross monthly income or SI00.00 per month, whichever is less, pursuam to Medical Assistance reguhrtions.
