Plaintiff is First National Bank of Omaha, a national bank, with place of business located at 1620 Dodge Street, Omaha, Nebraska. 2. Defendant is Terry Vander Hoeven who resides at 1120 Columbus Avenue Apt 12, Lemoyne, Cumberland County, Pennsylvania. 3. At all times material and relevant hereto plaintiff was a national bank, engaged in various types of banking business, including but not limited to consumer lending through the issuance of credit cards. 4. At defendant's request, plaintiff opened a credit card account (hereafter "the Account") for defendant with account number xxxx-xxxx-xxxx-7962. 5. Plaintiff mailed to defendant a credit card with said account number for the Account together with terms and conditions (the card agreement) which defendant received. A copy of the current card agreement is attached hereto as Exhibit A. 6. Defendant used the Account to obtain credit and agreed to the terms of the card agreement by using the card to obtain credit. 7. In using the credit card, defendant agreed, per the terms of the card agreement, to pay at least the minimum balance due as reflected in the billing statement. 8. Defendant last made a payment on the Account on. 9. Defendant's failure to pay the balance in full or at least the minimum payment due thereafter constituted a breach of the card agreement. 10. As a result of defendant's breach, defendant is liable to plaintiff for the sum of $8,377.36 as set forth in plaintiffs statement for the Account attached hereto, made a part hereof and marked.
