Deitch, makes the following Response, and in support thereof, avers as follows: 1. On June 21, 2001, I presented a Notice of Appeal from the decision_~.f Dis~t Justice ~Jc'~ cz> Ptacey to the Office of the Prothonotary of Cumberland County. 2. The individual at the Prothonotary's Office indicated that she coul~n~t at'pt th~ Appeal, and directed me to file it with the Office of the Clerk of Courts. ~_~ .-:. 3. The Clerk's Office indicated that their office was the correct placebo file~.~y appeal. Wherefore, I ask that the matter proceed under the Rules of Criminal Procedure under the current docket or, in the alternative, that the Court transfer the matter to the appropriate office pursuant to Rule 751 of Appellate Procedure. DE1TCH, Defendant IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA 01-1345 CRIMINAL MOTION TO QUASH APPEAL AND NOW, this l°f~)~ day of July, 2001 comes the Commonwealth of Pennsylvania, through, James, Smith, Durkin & Connelly, LLP, solicitor for the Township of Silver Spring and avers the following: On or about May 23, 2001, a hearing was held before District Justice Thomas A. Placey with regard citations filed by the Township of Silver Spring (the "Township") against the Defendant, Albert J. Deitch ("Deitch") for violations of the Township Zoning Ordinance. Following the hearing, District Justice Placey found in favor of the Township and against Deitch and awarded the Township civil penalties for the above referenced violations in accordance with the Township Zoning Ordinance and the Municipalities' Planning Code, 53 P.S. §10101 et seq. (the "MPC"). On or about June 21, 2001, Deitch filed a Notice of Appeal from a Summary Criminal Conviction with the Cumberland County Clerk of Courts, appealing the decision of District Justice Placey, which appeal is docketed at 01-1345 Criminal. Under Section 617.2 of the MPC, 53 P.S. §10617.2, violations of a zoning ordinance are to be adjudicated in a civil enforcement proceeding, which provision is also included in the Township Zoning Ordinance. An appeal of a decision of a district justice with regard to a zoning violation must be filed as a civil appeal with the Office of the Prothonotary. Deitch has improperly filed the aforementioned appeal of District Justice Placey's decision with the Clerk of Courts as a criminal appeal. WHEREFORE, the Commonwealth of Pennsylvania respectfully requests that this Honorable Court quash the appeal of Albert J. Deitch as being improvidently filed and grant Mr. Deitch fifteen (15) days from the date of an order quashing the appeal to file a civil appeal with the Office of the Prothonotary.
