1) The Petitioner, John J. Gephart, is an Adult individual,

for shared-Custody for his minor children.
7) Efta E. Gephart, is the Natural- Mother, and guardian, of
said minor-child (ren).
A) John J. Gephart II, date Of birth: 3-11-99, residing at
32 West Main Street, Mechanicsburgh, Pennsylvania.
B) Damein R. Gephart, date of birth: 3-20-01.
C) John J. Gephart (was) born, out of Wedlock.
D) Damein R. Gephart (was not) born out, of Wedlock.

10) John J. Gephart and Efta E. gephart, are Currently Separated,
but are still married.
11) Petitioner know's that, by the Court, granting this petition,
would-be, in the best-Interest, and permanent-welfare, of said
minor-child(ren).
12) Ail Judgement's decree's and other document's, shall be
submitted, to the court, at the appointed-Date +time, on this matter.

III.ORDER OR OTHER DETERMINATION
IN OUESTION ORDER OF COURT
AND NOW, this 11~h day of June, 20011], the Court finds by clear and
convincing evidence that the children are dependent. They are placed in the care and
custody of their maternal uncle and aunt, Mr. And Mrs. John Alderson, Sr., subject to
protective supervision by the agency.
Mother shall have joint care and custody of the children. Provided,
however, that mother may not leave the jurisdiction of this Court without specific
Order of Court. Further, mother is not to remove the children from the Alderson
household and relocate to another residence without spedfic Court approval.
Both mother and father are directed to cooperate with the agency in the
formulation of a permanency plan and to comply with the recommendations
contained therein. A minimum component of each plan shall be appropriate
parenting training. A component of father's plan shall include anger management
counseling.
We further find by dear and convincing evidence that aggravating
circumstances exist with regard to father. However, the agency is directed to work
toward reunification with the father.
Ail reasonable efforts were made to prevent this placement. It is not safe for
the children to live with father. It is safe for the children to be in the joint custody of

mother so long as she is living in the household of Mr. and Mrs. John Alderson, Sr.
This Order is in the best interest of the children.

COURT ORDER
AND NOW, this ~ day of February, 2005, upon consideration of the attached
Custody Conciliation report, it is ordered and directed as follows:
1. The Mother, Etta E. Schmidt, shall enjoy legal and physical custody of John J.
Gephart, Jr., born March 11,1999, and Damein R. Gephart, born March 20,2001.
2. The Father, John J. Gephart, Sr., shall enjoy periods of temporary custody with the
minor children as follows:
a. At least once a year when the Mother shall make arrangements for the Father
to have visitation with the children at the prison where Father is incarcerated.
These arrangements will be made through Bob and Linda Kauffman with the
Kauffmans also arranging transportation.
b. At such other times as agreed upon by the parties.
3. The Mother shall also write to Father on an average of a montWy basis to advise
Father of the current status of the two children, and Mother shall provide Father
photographs of the two children at least twice per year.
4. Father shall enjoy telephone contact with the minor children as long as Father is able
to initiate the call with no fmancial consequences to the Mother.
5. Upon Father's release from prison and in the event the parties are unable to reach an
agreement with respect to Father's periods of temporary custody at that time, Father
may again petition the Court to have this case reviewed by the Custody Conciliator.

1. The pertinent information pertaining to the children who are the subject of this
litigation is as follows:

2. A Conciliation Conference was held on February 4, 2005, with the following
individuals in attendance:
The Father, John J. Gephart, Sr., who appeared via telephone along with his
counsel, Student Attorney James Abbott of the Dickinson School of Law Family Law
Clinic, and the Mother, Etta E. Schmidt, with her counsel, Jessica Diamondstone,
Esquire.
3. The Conciliator recommends an Order in the form as attached.
