LAST WILL AND TESTAMENT
OF
JOHN H. REBERT
I, JOHN H. REBERT, of 650 Bemheisel Bridge Road, Middlesex Township, Carlisle,
Cumberland County, Pennsylvania, being of sound and disposing mind, memory and understanding do
make, publish and declare the following as and for my Last Will and Testament, hereby revoking and
making void all previous Wills and Codicils at any time heretofore made by me.
ITEM I
I order and direct my personal representatives, hereinafter named, to pay all my debts and funeral
expenses, including all inheritance taxes that may be assessed against my estate, as soon as convenient
after my death.
ITEM II
I direct that my burial take place in Kutz's Cemetery, Claremont Road, where the Rebert family
plot is located, and that I be given a funeral at First Presbyterian Church commensurate with my station
in life.
ITEM III
I give and bequeath my 1700 Grandfather Clock, which belonged to my grandfather, John Rebert,
to my son, JOHN H. REBERT, JR., if he survives me, with the provision that, because of its height, said
clock remain in the house at 650 Bemheisel Bridge Road until such time as John H. Rebert, Jr., can
provide adequate accommodations for it.

ITEM IV
I give, devise and bequeath my interest in the real estate situate in Middlesex Township, Carlisle,
Cumberland County, Pennsylvania, as identified by the following Tax Parcel Identification Numbers, to
wit 21-05-0433-004; 21-04-0371-044; 21-04-0371-043A; 21-04-0371-043; 21-04-0371-016; 21-04-0371-
015; and 21-04-0371-015A, to my son, JOHN H. REBERT, JR., provided he survives me by thirty (30)
days. If my son, JOHN H. REBERT, JR. fails to survive me, then the gift to him shall lapse and be
distributed as part of my residuary estate.
ITEM V
It is my wish that my son, JOHN H. REBERT, JR., continue to farm the real estate owned by
me, BARBARA KIRK REBERT and MARY JANE R. BLOSSER, as long as he wishes to do so.
ITEM VI
I give, devise and bequeath all the rest, residue and remainder of my property, real or personal,
(including lapsed legacies and devises) whatsoever and wherever situate and whether acquired before
or after the execution of this Will, and in whatever form my personal representatives have placed the
same, in equal shares, share and share alike, to my three children, namely, BARBARA KIRK REBERT,
JOHN H. REBERT, JR., and MARY JANE R. BLOSSER. If any child of mine should fail to survive
me, then and in that event the share of such child shall lapse and be distributed as part of my residuary
estate.
ITEM VII
I nominate, constitute and appoint my three children, BARBARA K. REBERT, JOHN H.
REBERT, JR., and MARY JANE R. BLOSSER, or the survivor of them, Co-executors of this, my Last
Will and Testament, to serve without bond.

ITEM VIII
I give and grant to my Executors in addition to, and not in limitation of, the powers conferred
by law, the following further full powers
(a) The full power to sell at public or private sale or sales, lease, mortgage and convey any and
all property, real or personal, which I may own at the time of my death, and to give good and sufficient
deeds or bills of sale therefore, and to do every other act and thing necessary or appropriate to complete
administration of my estate as my Executors shall, in the exercise of reasonable discretion, deem
advisable.
(b) Subject, however, to the condition that should any beneficiary under this Will wish to sell
his or her interest in any property, the other beneficiaries shall be given the fkst option to purchase said
interest.
ITEM IX
(A) Wherever in this Will the words "Executor" and "Personal Representative" are used, they
shall be construed to mean "Executor, Executors, Executrix, Executrices, and the survivor or survivors
of them and their successor or successors in office".
(B) All references made and all nouns and pronouns used herein shall be construed in the
singular or plural and in such gender as sense and circumstances require.

The statute does not exempt a transfer t~ a survWing spouse from tax, and the statutory requirements for disclosure of assets and filing a tax return are still applicable even if the surviving spouse is the

KNOW ALL MEN BY THESE PRESENTS, that WHERE,&S~i:J, ohn H. Rebert, late of 650
Bemheisel Bridge Road, Carlisle, Cumberland County, Pennsylvania, deceased, died testate on May 20,
2003, having first made his Last Will and Testament, which was duly executed on August 29, 1995, and is
duly recorded at the Register of Wills in Cumberland County, Pennsylvania.
WHEREAS, the said John H.'Rebert, by the aforesaid Last Will and Testament, named Barbara K.
Rebert, John H. Rebert, Jr., and Mary Jane R. Blosser, as Co-Executors of said Last Will and Testament;
WHEREAS, letters testamentary on the estate of the said decede'nt were duly issued by the Register
of Wills of Cumberland County, Pennsylvania, to the said Co-Executors, hereinafter called personal
representative;
WHEREAS, the said personal representative has gathered the probate assets of the estate of the said
decedent and the said assets consist of real and personal property; to a total value of $398,074.78, as set
forth in Exhibit A, which is a statement of account of the said p~rsonal representative, and which is attached
hereto and made a part hereof, and marked Exhibit A;
WHEREAS, the debts and deductions, including tile payment of inheritance tax in the said estate,
amount to $87,668.41, leaving a balance for distribution of $310,406.3 7, also as set forth in the statement
of the said personal representative, which is attached hereto and marked Exhibit A;
WHEREAS, the balance for distribution as shown in the said statement marked Exhibit A has been
distributed as herein indicated in accordance with the terms of the Last Will and Testament of the said
decedent:
NOW, THEREFORE, KNOW YE, that we, Barbara K. Rebert, John H. Rebert, Jr, and Mary Jane
R. Blosser, the heirs under the Last Will and Testament of the said decedent, and being those persons
entitled to inherit tinder said Last Will and Testament, do hereby each of us, acknowledge that we have this
day had and received from the aforesaid personal representatives, in full satisfaction and payment of all sum
or sums of mouey, legacies, bequests, and devises as are given, devised and bequeathed to each of us

respectively by the said Last Will and Testament, the amounts due us under said Last Will and Testament,
which amounts we have received this day, and which amounts are in the amount set opposite our respective
names in the table and schedule of distribution in Laid statement attached hereto and marked Exhibit A:
AND, each of us does hereby stipulate that in order to avoid the expense and time involved in the
filing of a formal account and schedule of distribution, we each agree that no account is necessary and we
do hereby agree that we do consent to distribution being made without the filing of an account and schedule
of distribution, the same to be with the same force and effect as if they had been filed and confirmed by the
Orphans' Court Division of the County of Common Please, Cumberlan;:t County.
THEREFORE, we and each of us, do hereby remise, release, quitclaim and forever discharge the said
personal representatives, Barbara K. Rebert, John H. Rebert, Jr., and Mary Jane R. Blosser, their heirs,
executors, and administrators and assigns, of and from the said estate and from all actions, suits, payments,
accounts, reckonings, claims, and demands whatsoever for or by reason thereof, or for any other use, matter,
cause or thing whatsoever, touching upon the estate of the said decedent, and each of us do further hereby
covenant and agree that should any liability come due to the estate of the said decedent after the signing of
this agreement, we and each of us do hereby covenant and agree with each other and the aforesaid personal
representatives, that we will contribute pro-rata, our share of the estate to satisfy any and all claims,
demands, suits, or causes of action which may be successfull'y prosecuted against the said estate or the
aforesaid personal representatives after the signing, sealing and delivery of this family settlement agreement
and final release.

A refund of a tax credit, ~hich ams not requested on the Tax Return, amy be requested by completing an "Application
for Refund of Pennsylvania Inheritance and Estate Tax" (REV-1215). Applications are available at the Office
of the Register of NiIIs, any of the 22 Revenue District Offices, or by calling the special Iff-hour
answering service for forms ordering: 1-800-562-Z050; services for taxpayers with special hearing and / or
speaking needs: 1-800-~7-2020 (TT only).
Any party in interest not satisfied with the appraisement, allowance, or disallowance of deductions, or assessment
of tax (including discount er interest) as shown on this Notice must object ~ithin sixty (60) days of receipt of
this Notice by:
--mritten protest to the PA Department of Revenue, Board of Appeals, Dept. 281021, Harrisburg, PA 17128-1021, OR
--election to have the matter determined at audit of the account of the personal representative, OR

If any tax due is paid within three (2) calendar months after the decedent's death, a five percent (BX) discount of
the tax paid is allowed.
The 15X tax amnesty non-participation penalty is computed on the total of the tax and interest assessed, and not
paid before January 18, 1996, the first day after the and of the tax amnesty period. This non-participation
penalty is appealable in the same manner and in the the same time period as you mould appeal tho tax and interest
that has been assessed as indicated on this notice.
Interest is charged beginning .ith first day of delinquency, or nine (9) months and one (1) day from the date of
death, to the date of payment. Taxes which became delinquent before January 1, 1982 bear interest at the rate of
six (62) percent par annum calculated at a daily rate of .00016~. Al! taxes mhich became delinquent on and after
January 1, 1982 wiI1 bear interest at a rate which mil! vary from calendar year to calendar year ~ith that rate
