WHEREAS, HUBERT E. TWIGG and SAMI L. CHARLES of 10akmoat Road, Harrisburg,
Pennsylvania, is about to execute contemporaneously herewith, a contract, with THE MCNAUGHTON
COMPANY, INC. of 4400 Deer Path Road, Harrisburg, Pennsylvania, for the erection of a building upon
premises commonly known as 5760 ASPEN~ LANE, Township HAMPDEN, CUMBERLAND County,
Pennsylvania, as set forth in the deed dated ~-~qo.M- I 7 x~LhJDq recorded at Deed Book _ , Page
, in the Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically
described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, August 13, 2004, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being expressly
waived.

ALL that certain piece, parcel or lot of land situat~ in Hampden Township, Cumberland
Couuty, Pennsylvania, and boundext and described as follows:
BEGINNING at a point on the Western right-of-way line of Aspen Lane (50.00 feet
wide), sa/d point being located at the Southeastern comer of Lot No. 129; then along said
right-of~wa¥ ]ine of Aspen Lane, South 18 degrees 34 minutes 15 seconds Est, for a distance of
30A1 feet, to a point on the arc ora ch'cie cundng to the right, w/th a radius of 125.00 feet, and
an arc length of 137.28 feet, to a point at the Southeastern comer of Lot No. 131; then along the
Eastern boundary line of Lo~: No. 131, North 08 degrees 52 roi,utes 08 seconds West, for a
distance of 149.03 feet, to a point along the Southern boundary line of Lot No. 132; then North
~9 degrees 07 minutes 52 seconds East, for a d/stance of 28.40 feet, to a point at.the
Southwestern corner of Lot No. 129; then along the Southern boundary line of LotNo. 129,
South 71 degrees 25 minutes 45 seconds East, for a distance of 110.00 feet, to a point and the
place of BEGINNING.
This piece, parcel or lot of land consists of approximately 12,549.18 square feet of land, has an
address of 5760 Aspen Lane, and is known and numbered as Lot No. 130 on the Final
Subdivision Plan for Westbury- Phases VIB, which is recorded ia Cumberland County in Plan
Book 83, Page 129.
