C O M P L A I N T
1. Plaintiff, U. S. Bank, National Association Trustee for the
Pennsylvania Housing Finance Agency, pursuant to a Trust Indenture
dated April 1, 1982, is a National Association with a servicing agent
of Pennsylvania Housing Finance Agency with an office located at 211
North Front Street, Harrisburg, Pennsylvania 17102.
2. Defendant, Barry Simmons and Walter Brashear, Co-Partners
d/b/b/a Brashear Farms, are adult individual whose last known address
is 295 Pine Hill Road, Enola, Pennsylvania 17025.
3. Plaintiff and its predecessors have owned real estate known as
1607 Holtz Road, Enola, Pennsylvania 17025, prior to April 1972 and
to the present. Plaintiff acquired the property at a Sheriff's Sale
on September 8, 2010, a copy of the Sheriff's Deed is attached hereto
and made a part hereof as Exhibit "A".
4. Defendants' and their predecessors have owned property
adjacent to that of Plaintiff., a copy of the deed attached hereto and
made a part. hereof as Exhibit "B"
5. On April 21, 1972, the Pennsylvania Department of
Transportation (hereinafter "PennDOT") filed a condemnation action to
No. 682 May Term 1972, a copy attached hereto and made a part hereof
as Exhibit "C". The purpose of the condemnation was to acquire
certain property necessary to the construction of Route 81.
6. PennDOT took property as set forth in Exhibit "D" attached
hereto and made a part hereof.
7. PennDOT did not acquire in the condemnation a small strip of
property was left on the north side of Route 81 to the rear of
Plaintiff's property.
8. A copy of the survey of Plaintiff's property is attached
hereto and made a part hereof as Exhibit "E"
9. The description of the real estate to the rear of 1607 Holtz
Road is set forth as follows:
ALL THAT CERTAIN tract of land situate, lying and being in the
East Pennsboor Township, Cumberland County and Commonwealth of
Pennsylvania, and being more particularly described as follows:
BEGINNING at a point on the northerly right-of-way line of State
Road 0081, also known as Interstate Highway Route 81, said point
being the southwesterly corner of lands now or formerly GEMT,
Inc. and being more particularly bounded and described as
follows:
1. Thence along the said right-of-way line of Interstate 81,
said line also being the easterly line of lands now or
formerly of Gertrude Brascher, South 08° 44' 35" East, a
distance of 20.00 feet;
2. Thence continuing along said right-of-way lien of
Interstate 81, said line also being the southerly line of
said lands now or formerly of Gertrude Brashear, South
71° 12' 27" West, a distance of 153.90 feet;
3. Thence through the said lands now or formerly of Gertrude
Brashear, North 14° 20' 00" West, a distance of 21.59
feet to a point at the southeasterly corner of lands now
or formerly of Barry L. Turner;
4. Thence, the northerly line of said lands now or formerly
of Gertrude Brashear, North 71° 51' 00" East, a distance
of 155.78 feet, to a point, the place of BEGINNING.
CONTAINING 3,193 square feet of land or less. Or 0.073 acres
of land, more or less.
10. The portion to the rear of Plaintiff's property has a septic
system and a deck constructed thereon and located on the property
described in Exhibit "A" and the strip of land described in Paragraph
9.
11. For more than twenty-one years, Plaintiff and its predecessors
have been open, exclusive, hostile, adverse and actual possession
under a claim of right to the portion of the real estate described in
Paragrpah 9.
12. Plaintiff requests that Defendants and each and every one of
them be forever barred from asserting any claim whatsoever in and to
said land and premises adverse to Plaintiff.
WHEREFORE, Plaintiff requests that:
(a) Judgment be entered in favor of Plaintiff and against
Defendants;
(b) A decree be issued to declare and adjudge that Plaintiff
owns absolutely and is entitled to the quiet and peaceful
possession of said property specified in Paragraph 9 as
against Defendants and all person claiming under it or
them, and that all Defendants claiming under it or them
have no estate, right, title, lien or interest in or to
said property or any part thereof; and that title to said
property be quieted in Plaintiff against all claims of
Defendants and all persons claiming under them; and
(c) The Court order such further relief as the Court deems
appropriate.
