West Walnut Court Homeowners Association, by its attorney, Martson Law Office, hereby files
its claim for an assessment against the real estate hereinafter describe and sets forth the claim as follows;
STATEMENT OF CLAIM
This claim is filed by the West Walnut Court Homeowners Association with an address for
purposes of this claim as being care of Hubert X. Gilroy, Esquire, 10 East High Street, Carlisle,
Cumberland County, Pennsylvania.

The name of the owners of the property against which this Lien if filed is Helen C. Kelley who
is now deceased. Pursuant to Letters of Administration granted in Cumberland County at Docket No.
21-11-0719, Stephen M. Kachman has been appointed as the Executor of the Estate of Helen C. Kelley.

A description of the property against which this Lien is filed is attached hereto and marked as
Exhibit `A' with an address of 1226 White Birch Lane, Carlisle, Cumberland County, Pennsylvania.

The Authority under and by virtue of which this Lien is filed is the Declaration of Protective
Covenants, Restrictions and Reservations filed on behalf of the West Walnut Court Homeowners
Association pursuant to the Declaration filed in the Cumberland County Recorder of Deeds Office at
Miscellaneous Book 721 Page 3065 and Miscellaneous Book 727 Page 3070, and pursuant to 68
Pa.C.S.A. Section 5315.

This Lien is claimed for unpaid assessment for two months at a total of $30.00 each month for
a total of $60.00 at the time of filing of this Lien. Additionally, this Lien is filed for any future unpaid
assessments.

Interest and filing fees is claimed on the above mentioned fees until paid in full.

WITNESSETH, that in consideration of the sum of ONE ($1.00) DOLLAR, in hand paid, the
receipt whereof is hereby acknowledged, the said grantor does hereby grant and convey to the
said grantee, her heirs and assigns:
ALL THAT CERTAIN tract of land situate in the Borough of Carlisle, Cumberland County,
Pennsylvania, appearing as Lot No. 41 on Drawing No. 5 of the Final Subdivision Plan of
Walnut Court as recorded in Cumberland County Plan Book 48, Page 133, et seq. and being
more particularly bounded and described in accordance with said Subdivision Plan as follows:
BEGINNING at a point at the southwestem comer of Lot No. 40; thence along White Birch
Lane South 83 degrees 45 minutes 00 seconds West 28 feet to a point at the southeastern comer
of Lot No. 42; thence along the said Lot No. 42 North 06 degrees 15 minutes 00 seconds West
160 feet to a point at the northeastern corner of Lot No. 42; thence North 83 degrees 45 minutes
00 seconds East 28 feet to a point at the northwestern corner of Lot No. 40; thence along the said
Lot No. 40 South 06 degrees 15 minutes 00 seconds East 160.00 feet to a point, the Place of
BEGINNING.
BEING Lot No. 41 on the Final Subdivision Plan of Walnut Court as recorded in Cumberland
County Plan Book 48, Page 133, et seq.
HAVING thereon erected townhouse known and numbered as 1226 White Birch Lane, Carlisle,
Pennsylvania.
EXHIBIT 'A'
SUBJECT to and together with the 20 feet wide service drive easement appearing on said
Subdivision Plan.
UNDER AND SUBJECT to the declaration of protective covenants, restrictions and reservations
dated March 8, 1990 and recorded in Cumberland County Misc. Book 380, Page 582.
TOGETHER with and subject to the right of ingress and egress over the common driveway for
Lot Nos. 34 through 39 of the aforementioned subdivision.
SUBJECT to and together with easements shown and listed on all four phases of the plans for the
Walnut Court Subdivision intended for the use by the owners and occupants of the townhome
portion of said subdivision for access and stonn water management.
IT BEING the same premises which Chloe M. Hair, Widow, by her deed dated April 29, 2005
and recorded May 3, 2005 in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania in Deed Book 268 at Page 3596, granted and conveyed unto Helen C. Beard now
known as Helen C. Kelley, the Grantor herein. The said Helen C. Beard has since resumed her
maiden name of Helen C. Kelly as filed July 21, 2006 in the Court of Common Pleas York
County, Pennsylvania to No. 2004-FC-001995-02.
THE GRANTOR AND THE GRANTEE ARE ONE IN THE SAME AND IS THEREFOR
EXEMPT FROM REALTY TRANSFER TAX.
AND the said Grantor does hereby WARRANT SPECL4LLYthe property hereby conveyed.
