PETITION PURSUANT TO SECTION 5101 OF THE PROBATE, ESTATES & FUDUCIARIES CODE TO ALLOW
DISTRIBUTION OF DEATH BENEFITS TO NATURAL MOTHER AS CUSTODIAN FOR MINOR CHILDREN, WITHOUT
THE APPOINTMENT OF A GUARDIAN
TO THE HONORABLE, THE JUDGES OF SAID COURT:
AND NOW, comes your petitioner Mary Whaley on behalf of her son, Jeffery Whaley and her daughter Julia Whaley
respectfully represents as follows:
1. Your petitioner is Mary Whaley an adult individual who resides at 68 Honeysuckle Dr., Mechanicsburg,
Cumberland County, Pennsylvania 17050-3184
2. Your petitioner is the natural mother of Jeffery Whaley a minar born September 27, 1987, Social Security No.
222-74-6020 and Julia Whaley a minor born December 13, 1990, Social Security No. 221-80-4471.
3. Jeffery Whaley and Julia Whaley reside with their natural mother at 68 Honeysuckle Dr. Mechanicsburg,
Cumberland County, Pennsylvania 1 7050-3 1 84.
4. The proceeds are form the estate of Peg Vinsko, step grandmother of Jeffery Whaley and Julia Whaley. Peg
Vinsko died on April 16'x, 2004 in Christiana Hospital located in Wilmington Delaware.
WHERFORE, Your petitioner prays Your Honorable Court to direct as follows:
Mary Whaley shall be made Fiduciary.
Mary Whaley shall have all rights and responsibilities of a fiduciary under the Pennsylvania O.C. Rules 12.5 et
seq. and shall not be required to post a bond or otherwise enter security for the proper performance of her duties.
The Death Benefit for 3effery Whaley and Julia Whaley shall be distributed directly to Mary Whaley as fiduciary.
