Plaintiff is CITIBANK, N.A. with place of business located at 701 East 60th Street North, Sioux Falls, South Dakota. 2. Defendant is Eric T Morgan who resides at 305 Widders Drive, Mechanicsburg, Cumberland County, Pennsylvania. 3. Plaintiff is a national banking association, engaged in various types of banking business including consumer lending through the issuance of credit cards. 4. Defendant obtained extensions of credit from Citibank, N.A., successor in interest to Citibank (South Dakota), N.A., by means of a CITI AT&T UNIVERSAL MASTERCARD credit card account (hereafter the Account) with account number ending in 0431. 5. Citibank (South Dakota), N.A. merged into Citibank, N.A., effective July 1, 2011, as approved by the Office of the Comptroller of the Currency. 6. Accurate records of all debits and credits to the Account were maintained by plaintiff. 7. Defendant was provided with monthly statements for the Account including the billing statement attached hereto as Exhibit A (redacted to remove confidential information). The monthly statements accurately stated the previous balance and the debits and credits to the Account for the prior billing period. 8. Defendant had for many months after receipt of a billing statement made payment on the Account or retained the statement without payment. 9. Defendant retained the Exhibit A statement without making payment by the stated due date. 10. Defendant's assent to the Account balance set forth in the Exhibit A statement is manifested through the prior conduct of defendant either making payment on the Account or retaining the statement without payment, after receipt of the monthly billing statements. 11. As a result of said assent, an account stated for the sum of $25,600.83 exists which sum reflects the Exhibit A statement balance less credits, if any, which were applied subsequent to the date of Exhibit A. Plaintiff failed to specifically state the amount purchased for each item. 8. Plaintiff failed to specifically state the dates of any alleged cash advances. 9. Plaintiff failed to specifically state the amounts of each alleged cash advance. 10. Plaintiff failed to specifically state the dates that Plaintiff alleges that Defendant made payment on the alleged account. 11. Plaintiff failed to specifically state the amounts of the payments that Plaintiff alleges were made by Defendant. 12. Plaintiff has failed to provide sufficient documentation and allegations to permit the Defendant to calculate the total amount of damages that are allegedly due, and there for Plaintiff's complaint fails to conform with the requirements of Pa.R.C.P. 1019(a) and Pa.R.C.P. 1019 (f). 13. On or about January 7, 2002, Universal Bank, N.A., merged with Citibank (South Dakota), N.A.. 6. On or about July 1, 2011, Citibank (South Dakota), N.A. merged into plaintiff Citibank, N.A. 7. From the inception of the account and continuing through on or about December 11, 2010, defendant used the credit card. Attached hereto, made a part hereof and collectively marked Exhibit A are copies of monthly billing statements for the billing period ending on December 20, 2007 through billing period ending on March 18, 2011. As can be seen from Exhibit A, prior to the billing statement for billing period ending on December 20, 2007, the account had a balance of less than zero. (Credit balance) 8. Accurate running records of all debits and credits to defendant's account were kept. 9. Defendant was provided with the aforesaid monthly billing statements which accurately stated the previous balance, the debits and the credits to the account for the prior billing period, the new balance and minimum amount due. 10. As noted in the statements, defendant's conduct after receipt of certain statement reflected by his making payment to plaintiff with the entry "PAYMENT THANK YOU" and amount of the payment. 11. Defendant last made a payment to plaintiff which was posted on January 17, 2011. 12. The last statement plaintiff.' mailed to defendant had a payment due date of April 1 2011. 13. In using the credit cards he received from plaintiff, defendant agreed to pay in full the new balance reflected on the billing statement or pay the minimum amount due reflected the statement. The Exhibit A statements reflect the payments made by defendant. 14. Defendant after receipt of the statement with payment due date of April 16, 2011 failed to pay either the balance in full or minimum amount due. Count I - Breach of Contract (In the Alternative to Count II) 15. Plaintiff incorporates by reference the averments of paragraphs 1 through 14. 16. Defendant's conduct in failing to pay the balance in full or pay the minimum amount due reflected in the billing statement constituted a breach of the card agreement, a copy of which is attached hereto, made a part hereof, and marked Exhibit B. 17. As reflected in the Exhibit B card agreement, its terms did not require the signature of the parties; rather as set forth in Exhibit B "This agreement is binding upon you unless you cancel your account within 30 days after receiving the card and you have not used or authorized use of the card." (Exhibit B, page 2 under "Your Account") 18. The exhibit A statements reflect defendant's use and acceptance of the Exhibit B card agreement. 19. Having breached the agreement defendant is liable to plaintiff for the balance due as reflected in the billing statement with payment due date of April 16, 2011 in the sum of $25,600.83 WHEREFORE, plaintiff prays that judgment be entered on its behalf and against defendant on Count I in the sum of $25,600.83 and the cost of this action. Count II - Account Stated (In the alternative to Count I) 20. Plaintiff incorporates by reference the averments of paragraphs 1 through 19. 21. As aforesaid, plaintiff maintained a running account of the activity in defendant's credit card account. 22. As aforesaid, each month plaintiff mailed defendant a billing statement which reflected the account activity. 23. As aforesaid, each month until the time of default defendant received the billing statement and after reviewing the same, either made a payment to plaintiff or retained the statement without payment thereby assenting to the account. 24. Defendant's actions as set forth above constituted an account stated between the parties for the sum of $25,600.83 being the balance in the statement with payment due date of April 16, 2011 which was the last statement plaintiff provided to defendant. WHEREFORE, plaintiff prays that judgment: be entered on its behalf and against defendant on Count H (in the alternative to Count I) in the sum of $25,600.83 and the cost of this action.
