MOTION TO SET ASIDE SALE
AND NOW come Defendants, Valerie Hartman and David Bosak, by and through their
attorney, Allen C, Welch, and file the following Motion asking the Court to set aside the
Sheriff's Sale currently scheduled in this matter, and respectfully representing as follows:
1, The parties entered into a rental agreement for pro~~rty known as 5 Addams Street,
Apartment # 3, Enola, Cumberland County, PA 17025, which began December 11,
2002,
2, Subsequently there were problems that resulted in the Defendants moving from that
leased property,
3. Defendants have known of no action against them as a result of the dissolution of the
rental agreement until a copy of the Writ of Exec uti 011 in the above-captioned action
was posted at their current address at 356 Hollowbrook Drive, Carlisle PA.
4, Defendants were never served with any pleadings or process in any action between
these parties prior to the posting ofthe Notice of Writ of Execution on their door on
or about August 20, 2004,
5, Subsequently a Notice of Sheriff's Sale was also served upon them,
6, As of this filing, Defendants still have not seen any complaint against them,
7, Absent any service, actual or otherwise, the judgment against defendants cannot
stand,
8, Pennsylvania Rule of Criminal Procedure 3132 allows the Court to set aside any sale
and enter any order "which may be just and proper under the circumstances,"
9, An order staying all further action in the matter until such time as defendants can be
served the original process, review the Complaint, and determine any appropriate
response would certainly be "just and proper" under these circumstances.
WHEREFORE Defendants pray this Honorable Court will enter an Order immediately
staying all further action in this matter, including the Sheriffs Sale scheduled for July 25,
2005, and directing Plaintiffs counsel to serve, by first class mail, a copy of the
Complaint in this matter on the Defendants' attorney.
