Ephl:ata, Pennsylvania, hereinafter referred to as Contractor, AND
SHELDON B. BI{YMESSER and MARY ANN BRYMESSER, of ~463 Leidlgh
Drive., Boiling Springs, ?ennsylvania, hereinafter referred to as
Owner, wheroby the former undertook and agreed to erect and
coz~struct a milking parlor and appurtenant structures on those
certain lots of ground situate at 1.458 Leidigh Drive, Boiling
~:D1;ings, in Monroe Township, Cumberland County, Pennsylvania,
being the sam~ promises which Sheldon B. Brymesser and Mary Ann
Brymessor, by deed dated Febr~lary 2, 1999 and recorded
SeDl;ember 15, 1999 in the Con%borland County Recorder of Deeds
Office in Deed Book 207, Page 800, granted and conveyed unto Mary
Azu~ Brymesser; and tho~.e certain two (2) tracts located at 1480
Lo].dioh Drive, Boil~.ng Springs, in Monroe Township, Cumberland
County, Penusylvania, being the same premises which James B.
Brymesser and Sons, a partnership, by Deed dated January 31, 199~
and recorded January 31, 1992 in the Cumberland County Recorder
of. Deeds Office in Deed Book "M", Volume 35, Page 712, ~ranted
and conveyed un%o Sheldon B. ~rymesser.
NOW T~E~FO~, THIS AGREF_~NT WITNE~BETH~ That the said
Contracgor, for and in considuration of the sum of Oho ($1.00)
Dollar to h~.m in hand paid by Owner, the receipt whereof is

hereby acknowledged, and the further consideration mentioned in
tho agreement aforesaid, for themselves and their subcontractors,
and all parties aching ~hrough or under them, covenant and agree
that no mechanic's lien~ or claims shall be filed or maintained
by them or any of thm-r~ 9~ainst the said buildings and the lot of
ground appurt~)nant thereto for or on account of any work done or
materials f~lrnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of ~he said buildings on the lot above described,
and tho said Contractor, for themselves, their subcontractors and
others undar them hereby expressly waive and relinquish the righ~
ho have, ~ile, and maintain any m~chanic's liens or claims
against hbo said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant. ,
