STIPULATION AGAINST I.II~.N,R
WHEREAS, David L. Schultz, of Cumberland County, Pennsylvania, is about to
execute contemporaneously herewith, a contract with Starnet Enterprises, Inc., d/b/a Caledonia
Construction Services o f C amp H ill, Cumberland County, Pennsylvania, for t he erection o f a
dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN tract of real estate situate in the Borough of Camp Hill,
Cumberland County, Pennsylvania, bounded and described as follows:
BEGINNING at a point on the southern right-of-way line of Ches~ut Street at an
iron pin at the northeastern corner of lands now or late of David S. Bayne; thence along said right-of-
way, North 82 degrees 27 minutes 33 seconds East, 75.00 feet to an iron pin at the northwest corner
of property now or late of Winton and Audrey Hewitt; thence along Hewitt land, South 11 degrees
18 minutes 53 seconds East, 93.72 feet to a concrete monument; thence along land of Park, South
82 degrees 27 minutes 33 seconds West, 75.61 feet to a proposed concrete monument at lands now
or late of Bayne; thence North 10 degrees 56 minutes 25 seconds West, a distance of 93.68 feet to
a point, the place of BEGINNING.
BEING Lot No. 2 on the Final Minor Subdivision Plan for property located at 3434
Green Street, prepared by Akens Engineering Associates, Inc., last revised December 19, 2003 and
recorded in Plan Book 88, Page 100, Cumberland County Recorder of Deeds Office.
UNDER AND SUBJECT, nevertheless, to easements, conditions, restrictions and
other matters of record and any and all matters which an inspection or survey of the property would
disclose.
BEING THE SAME premises which Robert David Park and Barbara Ann Park, Co-
Trustees of the Robert David Park and Barbara Ann Park Living Trust dated June 16, 1999, by its
deed dated March 30, 2004 and recorded April 2, 2004 in the Office of the Recorder of Deeds in and
for Cumberland County, Pennsylvania in Deed Book 262, Page 1705, granted and conveyed unto
David L. Schultz, an adult individual.
NOW, the '~'0~day of July, 2004, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said David L.
Schultz, to the said Stamet Enterprises, Inc., d/b/a Caledonia Construction Services to commence
work on the said building, or purchase materials for the same in consideration of the making of the
said .contra. ct with Stamet Enterprises, Inc., d/b/a Caledonia Construction Services and the further
consideration of One Dollar, to Stamet Enterprises, Inc., d/b/a Caledoma Construction Services paid
by David L. Schultz, it is agreed that no lien shall be filed against the building by the contractor, or
any sub-contractor, nor by any of the material men or workmen or any other person for any labor,
or materials purchased, or extra labor or materials purchased for the erection of said building, the
right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
