CIVIL ACTION - LAW
COMPLAINT
AND NOW, comes the Plaintiff, Rohrer Transport, by and
through its counsel, Goldberg, Katzman & Shipman, P.C., and files
this Complaint by respectfully stating the following:
1. Plaintiff is a business entity with a professional
address of P.O. Box 83, Route 340, Old Philadelphia Pike,
Smoketown, Pennsylvania 17576.
2. Defendant, Cornelius P. Lehane, Jr., is an adult
individual who has a last-known address of 220 Sycamore Road,
Elkton, Maryland 21921.
3. Defendant, Estes Express Lines, regularly conducts
business in Cumberland County, Pennsylvania, and has a
professional address of 6848 Mt. Herman Road, Morrisville, North
Carolina 27560.
4. On May 7, 2001, at approximately 2:20 a.m., Gerald C.
Rohrer was operating a Kenworth tractor trailer with Pennsylvania
Registration Number AE45905, which was owned by Plaintiff.
5. Mr. Rohrer had exited Interstate 95 northbound and was
turning left onto Pennsylvania State Route 132 westbound when
Plaintiff's tractor trailer was struck by a tractor trailer
operated by Defendant Lehane and which was owned by Defendant
Estes Express Lines.
6. The incident occurred when Defendant Lehane failed to
keep his vehicle in the appropriate lane of travel, crossed over
into the lane of travel of Mr. Rohrer and struck Plaintiff's
tractor trailer.
7. As a result of the collision, Plaintiff suffered
damages to his vehicle in the amount of $10,772.39.
COUNT I
ROHRER TRANSPORT v. CORNELIUS P. LEHANE, JR.
8. The above-referenced accident was directly and
proximately caused by the negligence of Defendant Lehane in that
he:
(a) Failed to use reasonable care in
the operation of his tractor trailer;
(b) Operated his tractor trailer at a
speed excessive under the circumstances then
and there existing;
(c) Failed to keep a proper and
diligent lookout on the highway;
(d) Operated his vehicle without proper
and adequate control so as to stay within his
lane of travel;
(e) Failed to keep his vehicle in its
lane of travel, crossing into Plaintiff's
lane of travel; and
(f) Failed to yield the right-of-way.
9. It is believed and therefore averred that Defendant
Lehane was the servant, agent and/or employee of Defendant Estes
Express Lines.
10. As a direct and proximate result of Defendant Lehane's
negligence, Plaintiff has suffered property damage in the amount
of $10,772.39.
WHEREFORE, Plaintiff demands judgment against Defendants,
jointly and severally, in the amount of $10,772.39, together with

interest from the date of the accident, costs of suit, and delay
damages pursuant to Pa. R.C.?. 238, which is an amount requiring
this matter to submitted to compulsory arbitration.
COUNT II
ROHRER TRANSPORT v. ESTES EXPBESS LINES
11. Plaintiff incorporates herein by reference Paragraphs
Nos. 1 through 10 above as though fully set forth herein at
length.
12. At the time and place aforesaid, Defendant Lehane was
the agent, servant and/or employee of Defendant Estes Express
Lines, and Defendant Lehane was acting within the course and
scope of that agency or employment.
WHEREFORE, Plaintiff demands judgment against Defendants,
jointly and severally, in the amount of $10,772.39, together with
interest from the date of the accident, costs of suit, and delay
damages pursuant to Pa. R.C.?. 238, which is an amount requiring
this matter to submitted to compulsory arbitration.
