II 1. I direct the payment of my debts and expenses of my last illness and funeral from my estate as soon after my death as conveniently may be done. To the extent that the assets of my residuary estate are insufficient to pay the expenses of my last illness and funeral and administrative expenses of my estate and any estate and inheritance taxes payable by reason of my death, my Executor may seek payment from the trustee of the Trust hereinafter referred to. 2. I give all my articles of personal or household use, including any automobiles I own at the time of my death, in equal shares, to my children, MARGARET A. LOPATA and JOEL A. LOPATA, or their issue, per stirpes. In the event either one of my children should predecease me and no issue survive him or her, then his or her share of my estate shall be given to the survivor of my two children, or to his or her issue, per stirpes. 3. I give, devise and beQueath all the rest, residue and remainder of my estate, whether real or personal, and wherever the same may be situate or located, as an addition to the ANNE F. LOPATA REVOCABLE TRUST AGREEMENT, under my Trust Agreement dated --~~~7 ~~~ t~T`', 1995 previously executed by me, as amended, to be added to any principal held thereunder subject to that Agreement as it exists at the time of my death. 4. In addition to the powers conferred by law, I authorize my personal representative in its absolute discretion: ~ A. To retain in the farm received or to sell at either public or private sale, any real or personal property, and to make distributions of personal property as set forth in this Last Will and Testament. B. To manage real estate. C. To invest and reinvest in all forms of property without being confined to legal investments, and without regard to the principal of diversification. D. To exercise any option or rights arising from ownership investments. E. To compromise claims without court approval, and without the consent of any beneficiary. 5. I nominate, constitute and appoint DAUPHIN DEPOSIT BANK AND TRUST COMPANY of Harrisburg, Pennsylvania as Executor of this, my Last Will and Testament. 6. I hereby relieve my personal representative from the ,necessity of posting security in connection with its duties as such in any jurisdiction in which it may be called upon to act insofar as I am able by law to do so.
