GOODLING CONSTRUCTION hereinafter referred to as Contractor, AND WILLIAM H. GOODLING AND KELLY J. GOODLING, husband and wife hereinafter referred to as Owner, whereby the former undertook and agreed to construct a single family dwelling, in LOT #82, Phase III, Meadowbrook Farms, North Middleton Township, Cumberland County, PENNSYLVANIA, more fully described in attached exhibit "A~, NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of OME Dollar to it in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. G©@DL~NG (SEAL) (SEAL) (SEAL) ALL THAT CERTAIN tract of land situate in Middlesex To~nship, Cumberland Count', Pennsylvania, being Lot No, 82, as shown on the Plan entitled Meadowbrook Farms Final Subdivision P}an Phase III dated October 17, 2000, revised August 12, 2003, and recorded August 21, 2003, in Cumberland County Plan Book 87, Page 99, more particularly bounded and described as follows: BEGINNING at an iron pin, being a westerly comer of Lot No. 81 and lying in an easterly Right of Way line of Country Side Drive (50'R/W); thence along said Right of Way, N20°40'58"W, 73.88 feet to an iron pin; thence continuing along said Right of Way, along a curve to the right, having a chord bearing of N14°39'03"W, a chord distance of 42.03 feet, a radius of 200.00 feet mid an arc length of 42.11 feet to an iron pin; thence continuing along said Right of Wa5,, N08°37'09"W, 14.74 feet to an iron pin, lying in an easterly line of said R/W and being a southerly comer of Lot No. 83; thence along said lot, N Sl°22'51"E, 155.95 feet to an iron pin, being an easterly comer of said lot, a southerly comer of Lot No. 4 and being a westerly comer of Furore Phase 8; thence along said lands, S20°40'58"E, 97.50 feet to an iron pin, lying in a westerly line of said lands and being a northerly comer of Lot No. 81; thence along said lot, S69°19'02"W, 160.00 feet to an iron pin, being the place of BEGINNING, containing 0.417 acres. BEING THE SAME premises which Worthington Development, L.P., A Pennsybania limited parrnership bv its Deed dated August 10, 2004 and about to be recorded in the Office of the Recorder of Deeds in and tot' Cmnbedand County, Pennsylvania, granted and conveyed unto William H. Goodlmg and Kelly J. Goodling, h~ Mortgagors hereto.
