Plaintiff, CACH, LLC, is a Colorado limited liability company doing business at 4340 South Monaco Street 2nd Floor, Denver, CO 80237. 2. Defendant, JEREMY B LATHROP, is an individual residing at 126 HERMAN AVE, LEMOYNE, PA 17043. 3. The claims raised in the complaint are subject to an agreement to submit these claims to arbitration. <Exhibit C> 4. Defendant, JEREMY B LATHROP, is indebted to BANK OF AMERICA, N.A. on an account stated by and between them in the amount of $9,140.94 which balance was due and unpaid as of July 31, 2010, for credit card account number 4264287216907770. <Exhibit A> 5. Upon charge-off, the above account number was changed to 4264287998696245. 6. On or about August 16, 2010, FIA CARD SERVICES, N.A. sold the debt for good and valuable consideration to plaintiff, CACH, LLC <Exhibit B> 7. The Defendant, Jeremy B Lathrop, last tendered a payment on December 19, 2009. 8. A copy of the credit card agreement is attached hereto. <Exhibit C> 9. Plaintiff is entitled to charge-off account finance charges of $0.00. <Exhibit A> 10. Plaintiff is entitled to pre-litigation charge.-off interest of $3.5036 per day from the default date ( 13.990% annual percentage rate x $9,140.94 / 365 days) or $3.5036 x 420 days = $1,471.52; which is accrued interest through the date of filing. <Exhibit A> Plus an award of late fees 0.00, court costs $192.00 and reasonable attorneys fees of $1,828.19 as stated in the Cardholder Agreement attached hereto as <Exhibit C>. 11. The defendant, being indebted to the plaintiff in the sum of $12,632.65 upon the account stated by and between them did promise to pay said sums upon demand. Demand has been made for payment of $12,632.65 and the defendant has failed to remit payment. WHEREFORE, plaintiff demands judgment against the defendant for $12,632.65 together with other interest and costs of suit. We include the fees for credit card debt cancellation or credit insurance purchased through us in calculating the beginning balance for the first day of the billing cycle after the billing cycle in which such fees are billed. TOTAL INTEREST CHARGE COMPUTATION Interest Charges accrue and are compounded on a dailybasis. To determine the Interest Charges we multiply each Balance Subject to Interest Rate by its applicable Daily Periodic Rate and that result by the number of days in the billing cycle. To determine the total Interest Charge for the billing cycle, we add the Periodic Rate Interest Charges together. A Daily Periodic Rate is calculated by dividing an Annual Percentage Rate by 365. HOW WE ALLOCATE YOUR PAYMENTS If your account has balances with different APRs, we willallocate the amount of your payment equal to the Total Minimum Payment Due to the lowest APR balances first (including transactions made after this statement).
