Gilligan, Jr., by and through his counsel, Walter J. Timby, III, ~` Esquire respectfully states that: 1 ~ Margaret Josephine Gilligan ("Decedent") died on August 6, 2011, a resident of Cumberland County, Pennsylvania. 2• Petitioner, Paul J. Gilligan, Jr. ("Petitioner"), whose address is 901 N. Arch Street, Mechanicsburg, Pennsylvania 17055, is the husband of the Decedent and was a member of the Decedent's household. 3. Decedent died intestate. 4• Decedent is survived by her husband, Petitioner herein, and three children, Christine Donato, Paul Gilligan, III and Brendan Gilligan, whom are all the biological children of Petitioner. 5• The Decedent had no probate estate when Decedent died other than the following: (a) Members 1St Federal Credit Union Account #227946 with a balance of Thirteen Thousand Eight Hundred Thirty Two Dollars and 60/100 ($13,832.60) 6• All other assets of the Decedent were owned as joint tenants with right of survivorship with the Petitioner. 7~ Pursuant to 20 Pa.C.S.A. 2102 et. seq. Petitioner is entitled to the first thirty thousand dollars ($30,000.00) of Decedent's probate estate. Accordingly, the Decedent's Estate -„ 5 ,T; --~, ,~ ~`~., Ij will not be subject to Pennsylvania Transfer Inheritance Tax since the rate of tax for spousal transfers is 0%. 8. Petitioner is the only beneficiary entitled to receive the property held in the account at Members 1St Federal Credit Union according to the intestate laws. 9. There are no creditors of the Decedent and no claims unpaid known to the Petitioner. 10. The Petitioner requests distribution of the Members 1St Federal Credit Union Account be made to him for reimbursement of funeral and luncheon expenses of $10,796.65 as follows: King's Funeral Service, Inc $8,695.35 Llanerch Country Club $2,101.30 11. The balance of the fund from Members 1St Federal Credit Union will be available to make payments and reimbursement of headstone and cemetery expenses that have not yet been finalized and received. WHEREFORE, Paul J. Gilligan, Jr., Petitioner, requests that an Order be made directing that Members 1St Federal Credit Union Account Number 227946 be distributed to Paul J. Gilligan, Jr. and further that a certified copy of said Order shall serve as authority to Members 1St Federal Credit Union, and that Petitioner Paul J. Gilligan, Jr., be authorized to execute any and all documents required by Members 1St Federal Credit Union, to carry out the Order of the Court.
