DIETZ, of Hampden Township, Cumberland County, Pennsylvania, being of sound and disposing mind, memory, and understanding, do hereby make, publish, and declare this as and for my Last Will and Testament hereby revoking and making void any and all wills by me at any time heretofore made. 1. I direct that all my debts and funeral expenses be paid as soon as practicable after my death by my Executor hereinafter named. 2. I give and bequeath the sum of Five Thousand ($5,000.00) Dollars to my brother, T. PAUL HARDING, absolutely. 3. I give and bequeath my pearls with diamonds clasp and earrings and all my other remaining jewelry to my daughter, MARY BEZILLA, absolutely. 4. I give and bequeath the sum of One Thousand ($1,000.00) Dollars to SISTER MARGARET JOHN, ORDER OF THE IMMACULATE HEART OF MARY, St. Philomena Convent, 13 North Highland Avenue, Lansdowne, Pennsylvania 19050, absolutely. 5. Ail the rest, residue and remainder of my estate, real, personal and mixed, and wheresoever the same may be situate, I give, devise, and bequeath to my children, G. PAUL BELL, GAIL MARIE KEEN, GARY T. BEZILLA, and MARY BEZILLA, and my granddaughter, ANNE ELIZABETH LEISTER, as hereinafter set forth: (a) 75% of the residue and remainder of my estate shall pass in equal shares to my children G. PAUL BELL, in trust as hereinafter provided, and GAIL MARIE KEEN and GARY T. BEZILLA, absolutely. (b) Two-thirds of the remaining twenty-five percent of the residue shall pass to my daughter, MARY BEZILLA, absolutely, and one-third of the remaining twenty- five percent of the residue shall pass to my granddaughter, ANNE ELIZABETH LEISTER, in trust, as hereinafter provided. The bequests in subparagraphs (a) and (b) above, if applicable, are subject to the following terms and conditions, which may alter the percentages as follows: (c) The note and mortgage to MARY BEZILLA will be forgiven, which was entered into to assist her in purchasing a home in Hilton Head, South Carolina, if the mortgage balance exceeds 16.7% of the total of my taxable estate which will change the percentage of my estate which my other beneficiaries will receive, as follows: 30.5% to G. PAUL BELL, in trust; 30.5% to GAIL MARIE KEEN, absolutely; 30.5% to GARY T. BEZILLA, absolutely; 8.5% to ANNE ELIZABETH LEISTER, in trust. (d) If the balance on the note and mortgage to MARY BEZILLA is less than 16.7% of my taxable estate, then my beneficiaries will receive the following percentages of my estate: 25% to G. PAUL BELL, in trust; 25% to GAIL MARIE KEEN, absolutely; 25% to GARY T. BEZILLA, absolutely; 8.3% to ANNE ELIZABETH LEISTER, in trust; 16.7% to MARY BEZILLA, absolutely, which will comprise the balance due on the note and mortgage plus whatever cash is necessary to make the total 16.7%. The taxable estate which is the basis for computing the percentages to the beneficiaries will include the balance due on the mortgage and note and any trust monies to which I may be entitled as well as all other assets in my estate subject to Pennsylvania inheritance tax. 6. I give, devise and bequeath the percentage share of my estate as set forth in Paragraph 5 herein for my son, G. Paul Bell, to William R. Keen, in trust, as trustee for G. Paul Bell, subject to the following terms and conditions: (a) The earnings only on the corpus of the trust shall be distributed quarterly to G. Paul Bell for ten years beginning with the date of my death; (b) Beginning with the eleventh year and each year thereafter, the trustee shall distribute to G. Paul Bell 10% of the corpus of the trust which shall include 10% of the accumulated earnings. The distribution hereunder shall be made quarterly and the distribution of earnings as provided in subparagraph (a) herein shall cease. (c) In addition to the withdrawals as provided in subparagraphs (a) and (b) above, the trustee, William R. Keen, may expend out of principal of G. Paul Bell's trust, such sums as the trustee may deem proper for the support, sickness and welfare of G. Paul Bell. 7. I give, devise and bequeath the percentage share of my estate as set forth in Paragraph 5 herein for my granddaughter, Anne Elizabeth Leister, to Gary T. Bezilla, in trust, as trustee for Anne Elizabeth Leister, subject to the following terms and conditions: (a) Gary T. Bezilla, as Trustee, shall have full power and authority to invest the principal of the trust in a prudent and financially reasonable manner and to dispense the earnings and principal of the trust as he deems necessary and appropriate for the welfare and education and benefit of my granddaughter, Anne Elizabeth Leister. (b) Should any principal and earnings of the trust remain at the time my granddaughter, Anne Elizabeth Leister, attains the age of twenty-three years, the Trustee shall pay over to my granddaughter the remaining principal and earnings of the trust absolutely, the trust shall terminate and the duties of the Trustee shall cease. 8. In the event that any of the beneficiaries named herein shall predecease me, I direct the share of such beneficiary shall pass in equal shares to the surviving beneficiaries. G. Paul Bell's share and Anne Elizabeth Leister's share shall pass free of any trust involvement. 9. I hereby nominate, constitute and appoint my son- in-law, WILLIAM R. KEEN, as Executor of this Last Will and Testament, but should he predecease me or fail to qualify, then in such event, I nominate, constitute and appoint my son, GARY T. BEZILLA, as Executor of this my Last Will and Testament, and I further direct that no person serving as Executor shall be required to post any bond to secure the faithful performance of his duties in the Commonwealth of Pennsylvania or in any other jurisdiction.
