Oq CIVIL ACTION - LAW COMPLAINT AND NOW, comes the Plaintiff~ Ritner Steel, Inc., by and through its attorneys, Butler Law Firm, and files this Complaint against Defendant, Barrett Company, Inc., and in support thereof avers as follows: 1. The Plaintiff, Ritner Steel, Inc., is a corporation registered to do business in the Commonwealth of Pennsylvania with its principal place of business at 131 Stover Drive, Carlisle, Cumberland County, Pennsylvania 17013. 2. The Defendant, Barrett Company, Inc., is a corporation registered to do business in the Commonwealth of Pennsylvania with its principal place of business at 1525 Cedar Cliff Drive, Camp Hill, Cmnberland Comity, Pem~sylvania 17011. 3. On or about May 7, 2003, Plaintiff and Defendant entered into a written agreement whereby Plaintiff was to furnish various materials and labor for the construction of the Hampton Inn, Bedford, New Hampshire. The total contract price was $70,540.00. A true and correct copy of said written agreement is attached hereto and made a part hereof as Exhibit 4. Plaintiff submitted to Defendant Invoice # 986-1 in the amount of $9,700.00 dated June 20, 2003. A true and correct copy of Invoice #986-1 is attached hereto and made a part hereof as Exhibit "B". $9,700.00. Defendant tendered payment for Invoice #986-1 to Plaintiff in the amount of 6. Plaintiff submitted to Defendant Invoice #986-2 in the amount of $60,840.00 dated July 21, 2003. A true and correct copy of Invoice #986-2 is attached hereto and made a part hereof as Exhibit "C". 7. Defendant made a payment in the amount of $45,840.00 leaving a balance due and owing for invoice #986-2 in the amount of $15,000.00. 8. Plaintiff provided to Defendant the materials and services described herein in a timely and workmanlike manner. 9. The prices charged for said materials and services are reasonable and the market prices therefor. 10. Despite demand for payment, Defendant has failed and refused to pay the balance due and owing to Plaintiff in the total amount of $15,000.00.
