THIS AGREEMENT made this ~ day of ~C,~, 2004, by and
between Strickland Brothers Construction, of Carlisle,
Cumberland County, Pennsylvania, hereinafter referred to as
Contractor,
Strickland Brothers Construction, LLC, hereinafter referred to as
Owner, whereby the contractor undertook and agreed to erected and
construct a dwelling on the certain lot of ground situate in Penn
Township, Cumberland County, Commonwealth of Pennsylvania, and more
fully described in Exhibit "A" which is attached hereto and made a
part hereof known as Lot #28 Prickly Pear Drive, North Middleton
Township, Carlisle, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00} Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under'them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

Notary Public, the undersigned officer, personally appeared
Matthew Strickland and M. Jeffrey Strickland, who acknowledged
themselves to be the Members of Strickland Brothers Construction,
LLC and that they as such Members being authorized to do so,
executed the foregoing instrument for the purposes therein
contained by signing the names of the said LLC by themselves as
such Members.

Cumberland County, Pennsylvania, being more fully bounded and described according to a
Final Subdivision Plan for Phase I of Hilicrest Farms West, prepared by R.J. Fisher &
Associates, Inc., being recorded in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Plan book 86, Page 57, as follows:

All that certain unimproved tract of land situate in North Middleton Township,
Cumberland County, Pennsylvania, being more fully bounded and described according to a
Final Subdivision Plan for Phase I of Hillcrest Farms West, prepared by R.J. Fisher &
Associates, Inc., being recorded in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Plan book 86, Page 57, as follows:
BEGINNING at a point along the southern side of a 50.00 foot wide right of way known as
Prickly Pear Drive, along the dividing line between Lots Nos. 27 and 28 of the hereinafter
mentioned subdivision plan; thence continuing along same, North 76 degrees 02 minutes 45
seconds West, a distance of 229.76 feet to a point; thence continuing along the dividing line
between Lots N os. 28 a nd 29 oft he he reinafter mentioned subdivision plan, South 11
degrees 15 minutes 12 seconds West, a distance of 218.47 feet to a point on the southern side
of said Prickly Pear Drive; thence along same by a curve to the left, having a radius of
235.00 feet, an arc length of 337.85 feet on a chord bearing of North 59 degrees 07 minutes
01 second East, and a chord length of 309.50 feet to a point, the place of BEGINNING.
BEING Lot No. 28 of the Final Subdivision Plan for Phase I of Hillcrest Farms West,
prepared by R.J. Fisher e& Associates, Inc. being recorded in the Office of the Recorder of
Deeds in and for Cumberland County, Pennsylvania, in Plan book 86, Page 57.
