WHEREAS, WILLIAM J. LUMADUE, JR. of 6990 Wentzville Road, Enola, Pennsylvania, is
about to execute contemporaneously herewith, a contract, with MILLER CONSTRUCTION & HOME
IMPROVEMENT of 512 West Broad Street, Williamstown, Pennsylvania, for the erection of a building
upon premises commonly known as 11 KEYSTONE DRIVE, Township SILVER SPRING,
CUMBERLAND County, Pennsylvania, as set forth in the deed dated August 15, 2003, recorded at Deed
Book 258, Page 3814, in the Recorder's Office for CUMBERLAND County, Pennsylvania, as more
specifically described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, August 26, 2004, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being expressly
waived.

ALL THAT CERTAIN lot of unimproved land situated in the Township of
Silver Spring, County of Cumberland and Commonwealth of Pennsylvania
more particularly bounded and described as follows:
BEGINNING at a poizit on the southern dedicated right of way line of
Keystone Drive at the dividing line between Lots Nos. 25 and 26 as shown
on the hereinafter mentioned plan of lots; theACe along said dividing
line between Lots Nos. 25 and 2&, South 5 degrees 14 minutes Weat, a
distanoe of 262.14 feet to a point at the dividing line between Lots
Nos. 25 and 1 as shown on said plan of lots; Chance along said dividing
line between Lots Nos. 25 and 1, South 63 degrees 28 minutes West, a
distance of 276.61 feet to a point, being a corner common to Lots Nos.
25, 1, 37. and 24 as shown on said plan of lots; thence along the
dividing line between Lota 25 and 24, North 19 degrees l7 minutes East,
a distance of 425.47 feet to a point on the southern dedicated right of
way Iine of Keystone Drive; thence long said southern dedicated right of
way line of Keystone Drive, the following courses and distances: (a) in
a eastwardly direction on a curve to the left having a radius of 250
feet, an arc distance of 67.44 feet to a monument; and (b) South 84
degrees 46 minutes Eaat, a distance of 6Q feet to a point on the same at
the dividing line between Lots Nos. 25 and 26 as shown on the
