For dates of death on or after July 1, 1994, and before Jan. 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is
3 percent [72 P.S. §9116 (a) (1.1) (i)].
For dates of death on or after Jan. 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0 percent
[72 P.S. §9116 (a) (1.1) (ii)]. The stahrte does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and
filing a tax return are stiN applicable even if the surviving spouse is the onty beneficiary.
For dates of death on or after July 1,2000:
• The tax rate imposed on the net value of transfers from a deceased child 21 years of age or younger at death to or for the use of a natural parent, an
adoptive parent or a stepparent of the child is 0 percent [72 P.S. §9116(aK1.2)].
• The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneflclaries is 4.5 percent, except as noted in
72 P.S. §9116(1.2) [72 P.S. §9116(a)(1)).
• The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is 12 percent [72 P.S. §9116(a)(1.3)]. Asibling is defined, under
Seclion 9102, as an individual who has at least one parent in common with tl1e decedent, whether by blood or adoption.

Pennsylvania, declare 'this to be my last will and revoke any will previously made by me.
I. I devise and bequeath all my estate of every nature and wherever situate in
equal shares to such of my daughters, KATHRYN ARNOLD, JUDITH
DAMS and LINDA DOYLE, as survive me by thirty days.
II. Should any of my daughters, Kathryn Arnold, Judith Davis or Linda
Doyle,.predecxase me or die on or before the thirtieth day following.,my
death, I devise and bequeath the share of such daughter to her issue per
stirpes living on the thirty-first day following my death; and should any of
my said daughters leave no such issue living on the thirty-fast day
following my death, I devise and bequeath the share of such daughter to
my other daughters or their respective issue per stirpes living on the thirty;

otherwise to a minor and with respect to which I am authorized to appoint
a guardian and have not otherwise specifically done so, provided that this
appointment of a guardian shall not supersede the. right of any fiduciary in
its discretion to distribute a share where possible to the minor or to another
for the minor's benefit. Such guardian shall have the power to use
principal as well as income from time to time for the minor.'. s, support and
education (including college education, both graduate and undergraduate)
without regard to his or her parent's ability to provide for such support and
education, or to make payment for these purposes, without fiuther
responsibility, to the minor or to the minor's parent or to any person taking
care of the minor, and shall distribute to the minor upon his or her
attaining the age of 18 years the remaining balance, if any, of said share.
IV. All federal, state and other death taxes payable because of my death, with
respect to the property forming my gross estate for tax purposes, whether
or not passing under this will, including any interest or penalty imposed in
connection with such tax, shall be considered a pert of the expense of the
administration of my estate and shall be paid out of the principal of my
estate without apportionment or right of reimbursement.
V. I appoi~ my daughters, KATHRYN A~tNOLD, JUDITH DAMS and
LINDA DOYLE, or the survivors of them, executrixes of this my last
will.
Vt , I direct that my executrixes and my guardian or their successors shall not
be required to post bond or other security for the faithful performance of
their duties in any jurisdiction.

BETWEEN KATHRYN F. ARNOLD, Executrix of the Last Will and
Testament of Kenneth E. Fanus, late of South Middleton Township,
Cumberland County, Pennsylvania, Deceased, party of the first
part, hereinafter called
GRANTOR,
AND ELSIE RENEE ALLEN, single woman, of 785 Bull Valley Road,
Aspers, Pennsylvania 17304, party of the second part, hereinafter
called
GRANTEE,
WHEREAS, the said Kenneth E. Fanus died a widower on the
30th day of March ,2006, seized in fee of the hereinafter
described real estate, and by his Last Will and Testament dated
March 22, 2003, which since his death has been duly proved and
remains of record in the Office the Register of Wills in and for
Cumberland County, at Carlisle, Pennsylvania; and filed to Estate
No. 21-06-0379, provided, inter alia, as follows:
"V. I appoint my daughters, Kathryn Arnold, Judith
Davis, and Linda Doyle, or the survivors of them, executrixes of
this my Last Will.
VI. I direct that my executrixes and my duardian or
their successors shall be required to post bond or other security
for the faithful performance of their duties in any
jurisdiction."
WHEREAS, Letters Testamentary in the Estate of Kenneth E.
Fanus, Deceased, were issued by the Cumberland County Register of
Wills to Kathryn F. Arnold on the 28th day of April, 2006,
without the requirement that any bond be posted by her, which
Letters Testamentary remain in full force and effect; and
WHEREAS, Section 3351 of the Probate, Estates and
Fiduciaries Code (20 P.S. § 3351) gives a personal representative
power to sell at public or private sale any property not
specifically devised; and
WHEREAS, the hereinafter described premises were not
specifically devised.
NOW THIS INDENTURE WITNESSETH, that the said Grantor
for and in consideration of the sum of One Hundred Forty thousand
and No/100 ($140,000.00) Dollars lawful money of the United
States, to them in hand paid by the said Grantee at and before
the sealing and delivery hereof, the receipt whereof is hereby
acknowledged have granted, bargained, sold, aliened, released and
confirmed, and by these presents, do grant, bargain, sell, alien,
release and confirm unto the said Grantee, her heirs and assigns,
ALL THAT CERTAIN lot or parcel of land with improvements
erected thereon situate in the Township of South Middleton,
County of Cumberland and State of Pennsylvania, bounded and
described as per the magnetic bearings of 1951 as follows, to
wit:
BEGINNING at a point in the center line of the Frost Road,
said point being also a corner of land now or formerly of Donald
Haskell; thence South 8~ degrees West a distance of 6.1 rods to a
point in the center line of said road; thence by other land now
or formerly of Edwin T. Fanus et ux, of which the herein
described premises was a part, North 74 degrees West a distance
of 12.2 rods to an iron pin; thence by the same North 8~ degrees
East a distance of 6.0 rods to an iron pin; thence by land now or
formerly of Donald Haskell South 74~ degrees East a distance of
12.2 rods to the place of BEGINNING.
CONTAINING 73 perches, more or less.
BEING improved with a one-story residential dwelling known
as and numbered 120 Frost Road, Gardners, Pennsylvania 17324.
AND BEING the same premises which Kenneth E. Fanus and Helen
C. Fanus, husband and wife, by their deed dated November 5, 1966,
and recorded on the same date in Cumberland County Deed Book D,
Volume 22, Page 1040, granted and conveyed to themselves. Helen
C. Fanus died December 29, 2002, thus vesting all right, title
and interest by operation of law in her surviving spouse, the
decedent herein.
TOGETHER with all and singular the buildings,
ways, water, water-courses, rights, liberties, privileges,
hereditaments and appurtenances whatsoever thereunto belonging,
or in anywise appertaining, and the reversions and remainders,
rents, issues and profits thereof; and also, all the estate,
right, title, interest, use, trust, property, possession, claim
and demand whatsoever, of the said Kenneth E. Fanus at the time
of his death, in law, equity or otherwise howsoever, of, in, to
or out of the same:
TO HAVE AND TO HOLD, the said hereditaments and premises
hereby granted and released, or mentioned and intended so to be,
with the appurtenances, unto the said Grantee, her heirs
and assigns, to and for the only proper use and behoof of the
said Grantee, her heirs or assigns, forever.
And the said Grantor does covenant, promise and agree, to
and with the said Grantee; her heirs and assigns, by these
presents, that the said Grantor has not done, committed, or
knowingly or willingly suffered to be done or committed, any act,
matter or thing whatsoever whereby the premises hereby granted,
or any part thereof, is, are, shall or may be impeached, charged
or incumbered, in title, charge, estate, or otherwise howsoever.
AND the said Grantor covenants and agrees that she will
warrant specially the property hereby conveyed.

first above written.
