Report from Guardian of Estate and Person ~-'~ ` ~ , Cumberland County Aging and Community Services ~ ~' ~`: ~'== n' Priscilla Whitman, Aging Care Manager 3 ~, `~ On August 27, 2009 Judge Kevin Hess appointed the Cumberland County Aging and Community Services as the permanent Plenary Guardian of Person and Estate for William Gallagher. PERSON Upon appointment, Bill was transported to the Carlisle Manor Care Home. He had been staying in a trailer at a nearby car dealership prior to this. Mr. Gallagher was diagnosed with diagnoses include dementia, anxiety, osteoporosis, mild degenerative joint disease, depression, gastroenterology reflux disorder. Mr. Gallagher continues to suffer from delusions. Sometimes he believes he is married and buying a truck or camper or house. He also believes his job is that of a security officer there at the Home. Nursing staff assists with dressing, grooming, personal care and toileting. He requires one assist of supervision with transfers. He is on a mechanical soft diet. One of the main activities he enjoys is the monthly lunch out with other residents. When there are activities in the Home he usually observes what is going on for 20-30 minutes and then leaves. He is often in the lobby and likes to greet visitors to the facility. He also enjoys looking through car magazines. His ambulation has improved to the point that he is able to walk short distances and to get up out of his wheelchair. He had been having problems with decaying teeth that became infected. There was some difficulty in finding a dentist that would accept his insurance. Finally one was found and he had several teeth extracted. After a few months, he was able to get dentures. Christmas presents were donated by Home Instead Home Health and were delivered by Aging Staff. He receives $203 in social Security and $1840.19 in federal government pension. Mr. Gallagher, prior to our agency becoming guardian, had under-reported his income on his federal income taxes or failed to file any tax forms. We worked with the IRS for many months until March of this year they placed him in a "non-collectable status." Because of this the IRS began to levy his income from both sources. Because of this, he was unable to pay the required amount to the home as determined by Medical Assistance. We appealed to MA and this issue has yet to be completely resolved at this time. We are paying the home $1000 a month until the problem can be resolved. We had his 2010 Federal Income taxes done by AARP. He was due a refund fo $668 from taxes withheld on his pension but this was kept by the IRS for the back taxes due. We will request no monies to be withheld from his pension. The balance in his checking account at the end of July was $3500.54. Attached is a financial summary of William Gallagher's income and expenses. Also attached is a spread sheet representing his checking account register. It is the request of the Cumberland County Aging and Community Services that the agency retain Guardianship of Person and Estate for William Gallagher. Forest Park has demonstrated an adequate quality of care for his medical and mental problems. We believe, therefore, that Mr. Gallagher should continue to reside in that nursing facility.
