On June 15, 2010 Judge Guido appointed the Cumberland County Aging and
Community Services as the Permanent Plenary Guardian of Person and Estate of Philip
Wayne Messinger. Following the hearing he returned to the Shippensburg Health Care
Center where he had been residing. Prior to his admission to the nursing home he had
been living in a group home in Hanover, PA.
PERSON
At the time off his admission, Mr. Messinger was diagnosed with hypertension,
cardiovascular disease, atrial fibrillation, dementia, anemia, Type 2 diabetes, and
ambulation dysfunction. He seemed to adapt well except for sleeping in a bed. Once
they got him a geri chair to sleep in he did better. Throughout the year he had several
falls but without injury. He attends activities and especially enjoys morning exercise,
games, cooking activities and picnics. He is one person assist for all ADL's with
extensive assistance with dressing. The nursing home staff monitors his blood pressure
and pulse every shift and Accu checks are done twice on two days per week to monitor
blood sugar.
At one point there was a sever change in his behavior and he became more aggressive
with care, actually growling at staff. There was a diagnosis of a respiratory infection and
an antibiotic was ordered. He received physical-therapy to try to increase his leg
strength, gait and transfers. He still laughs inappropriately and continues to have
periods of crying, although these are decreasing. He eats about 75% of his meals and
his weight is currently 194.
The Agency was able to sign Wayne up for a Medicare D program with Medco-
Medicare Prescription Plan. Christmas presents were prov ided by Home Instead and
delivered by staff. Also during the holidays he was visited by his 90 year old aunt who

had not seen him for some time. Wayne continues to be seen by him York County
MH/MR caseworker on an annual basis.
He began to develop increased leg pain which has been treated by medication. In May
he began to experience a decrease in weight so he was assessed by the speech
therapist to check his ability to chew and swallow, his position, and any assistance he
may need. He was later fitted for a brace that helps him sit up straighter and was given
a different wheel chair. These changes seemed to help. He is on a mechanical soft diet.
ESTATE
At the time of the appointment, Mr. Messinger's social security check was direct
deposited to an account at Susquehanna Bank in Hanover. The authorized signers from
Aging were placed on the account. Since there were no such banks in the Carlisle area,
a guardianship account was opened at MB~T Bank. When all the automatic withdrawal
for his funeral pre-arrangements with A Forethought and the direct deposits are
changed to M&T the account at Susquehanna Bank will be closed. Aging also took his
2009 income taxes to AARP to be done.
Wayne receives $940 in Social Security. The monthly bill from the Shippensburg Health
Care Center is currently $795.08. Attached is a copy of his check register for his
account at M&T which was started by transfers from the Susquehanna Bank account.
The balance at the end of May 2011 was $3277.98. Cumberland County Aging receives
a $100 monthly guardianship fee as agreed upon by the court. Enclosed is an

It is the request of the Cumberland County Aging and Community Services that the
agency retain Guardianship of Person and Estate of Philip Wayne Messinger. The
Shippensburg Health Care Center has demonstrated an adequate quality of care for his
medical and mental problems. We believe, therefore, that Mr. Messinger should
continue to reside in that nursing facility.
