Your Petitioners, Kelly Ray and Sandra Louise Hockgfi~erry,:. 0~4e the _ personal representatives for the Estate of Nathan Hockenberry~ho is the deceased father of the minor, Ladah-Ann Made Wilson. ~ 2. The minor child, Lariah-Ann Wilson, was bom on September !:~ 2003. Her Social Security Number is 162-82-2217. 3. On May 14, 2004, Nathan Hockenberry was killed in a motor vehicle accident. At the time of his death he was single and had one minor child, Ladah-Ann Made Wilson. 4. Kelly Ray and Sandm Louise Hockenberry were appoimed the administrator and administratrix of the estate of Nathan Hockenberry on May 28, 2004, by Glenda Farner Strasbaugh, the Register of Wills of Cumberland County. 5. At this time, the only outstanding bill due is for the funeral services in the amount of $4,935.00. 6. The respondent Darlene Hall is covered by a policy of automobile liability insurance in the amount of $100,000.00. Said policy was issued by the Progressive Insurance Company. 7. Progressive Insurance Company has agreed to pay the full policy amount of $100,000.00, as the result of the death of Nathan Hockenberry. 8. At the time of the death, LrllVff~ coverage in the amount of $55,000.00 was available through the Nationwide Insurance Companies and Nationwide Insurance Company has agreed to pay the full $55,000.00 for the wrongful death action of Nathan Hockenberry. 9. All sums set forth above constitute damages on account of personal injury/wrongful death, arising from the occurrence, within the meaning of § 104 (a) (2) of the Internal Revenue Code of 1986, as mended. 10. It is requested that the Court authorize that $5,000.00 be paid to Kelly Ray and Sandra Louise Hockenberry for the wrongful death of their late son. 11. It is further requested that $5,000.00 be paid to Tasha Wilson, the natural mother of Lariah Marie Wilson. 12. It is requested that $4,935.00 dollars be made available to pay the funeral bill. Which is attached as Exhibit "A". 13. Further, your petitioners requests that this Court allow the $55,000.00 from the Nationwide Insurance Company to be placed in a structure for the minor child to paid as follows: (a) in annual payments from the ages of eighteen to twenty-one (18-21 ) in the amount for each of those years be $12,917.25 for a total of $51,669.00. (b) The three lump sum payments payable as follows: (i) $35,389.00 at twenty-five (25), (ii) $64,614.43 at thirty-five (35), (iii) $53,886.61 at age fifty (50), (iv) the total cost of the structure of $55,000.00, and (c) total payout over the life of the child guaranteed being $405,559.72. Which is attached as Exhibit "B". 14. The total value of the settlement to the child is thus $505, 554.72. 15. The parents of the minor child and the personal representatives of the Estate of Nathan Hockenberry, have entered into a Contingency Fee Agreement with Rominger, Bayley and Whare for twelve (12%) percent of the first $55,000.00 of the recovery made on behalf of the aforesaid minor, and for twenty-five (25%) percent of recovery made on behalf of the aforesaid amount in excess of the same. Which is attached as Exhibit 16. The total fee to be authorized is $31,600.00, which is 20.38% of $155,000.00 17. Tasha Wilson, mother of minor child, and Kelly Ray Hockenberry, Administrator and Sandra Hockenberry, Administratrix of the Estate of Nathan Hoekenberry signed Settlement Statements regarding this matter. Which is attached as Exhibits "D" and "E". 18. The Estate will be executing the Joint Tort Feasor Releases which will preserve the fight of the estate or other interested parties to pursue additional legal remedies and to bring suit or other cause of action deemed appropriate against any other responsible parties. It is specific intent in seeking Court approval the Court approve payment under the Joint Tort Feasur Releases required by the Rules of Civil Procedure since a minor is involved, not that Court approval in any way limit the rights of Petitioner to seek any other relief from any other party. Any and all remaining monies will be placed in a federally insured bank or saving institution as permitted by the Rules of Civil Procedure, and it is requested that the Court specifically authorize said federally insured bank or savings institution to invest the same in any federally insured vehicle and to pay income tax on behalf of the minor in said account or accounts. JOINT PRORATA TORT-FEASOR RELEASE KNOW ALL BY THESE PRESENTS: That the undersigned (hereinafter "Releasor"), being of lawful age, for the sole consideration of One Hundred Thousand ($100,000.00), receipt of which is hereby acknowledged, have for myself and my heirs, executors, administrators and assigns remised, released and forever discharged, and covenant to hold harmless, Darlene Hall, Randy Hall, their heirs, administrators, executors, successors, agents, employees, subsidiaries, affiliates and assigns (hereinafter collectively referred to as "Releasees") from any and all claims, actions, and causes of action, including any claims or actions for wrongful death, or any survival actions or claims, demands, liens, workers compensation liens, costs, loss of services, loss of consortium, expenses, compensations and all consequential, punitive and exemplary damages, or damages of any kind sustained or that may be hereafter sustained on account of or in any way arising out of an accident that occurred at or near the intersection of S.R. 0011 (Ritner Highway) and S.R. 0233, on or about May 14, 2004. To procure the payment of the stated consideration, the Releasor hereby declares: that no representations about the nature and extent of the said injuries, disabilities or damages made by any physician, attorney or agent of Releasees, nor any represerttations regarding the nature and extent of legal liability or financial responsibility of any of the parties released, have induced the Releasor to make this Release & Indemnity Agreement; that this Release is entered into in consideration of all known and unknown injuries, disabilities and damages, and also the possibility that the injuries sustained may be permanent and progressive and recovery therefrom uncertain and indefinite, so that consequences not now anticipated may result from the said accident. In order to avoid inconvenience and expense to the released parties, in any action in which any of the Releasees are or may become a defendant or additional defendant or third-party defendant with other alleged tort-feasors, it is further agreed by Releasor that any verdict rendered against any other alleged tort-feasor shall be reduced by the pro rata share of the released party, and any judgment entered on the verdict shall be in the amount of the verdict reduced by the share of the released party, whether or not the released party was in fact a joint tort-feasor. This provision is intended to eliminate the need and expense of having the released party remain a party on the record and participate at Releasees' expense in a trial merely for the purpose of C determining whether or not any of the Releasees were joint tort-feasor, so as to entitle the other tort-feasors to a pro rata reduction of any verdict. This provision in no way constitutes an admission of liability by the parties released herein. The payment made to the undersigned is upon Releasor's warrant that no consideration has been received heretofore from any person, firm or corporation, nor has Releasor released heretofore any person, firm or corporation from any claim or liability for the said accident, and Releasor agrees to hold harmless and indemnify said Releasees and insurer of any of the Releasees from any loss, expense, or liability growing out of any claim against Releasees for contribution of any alleged tort-feasor under the Uniform Contribution Among Tort-feasors Act for injuries or damages sustained by the Releasor. POWER OF ATTORNEY AND CONTINGENCY FEE AGREEMENT I, Kelly Hockenbcrry, individually and Sandra Hockenberry, individually and as Administrator and Administratrix of the Estate of Nathan Hockenberry, the undersigned, hereinafter called "client(s)" hereby retain, appoint, and nominate ROMINGER, BAYLEY & WHARE LAW OFFICES, its members and associates, hereinafter called "attorney" to represent client(s) as legal counsel for all purposes and against all parties in connection with the death of Nathan Hockenber~y that occurred around or about May 14, 2004. Client(s) and attorney hereby agree as follows: 1. Initial Evaluation - Attorney will undertake an initial investigation and evaluate the merits of this case. No attorney fee will be charged for attorney work in connection with the evaluation. Client(s) shall provide in advance a retainer of 0 to be used for the purposes of paying the costs associated with the initial investigation. Attorney will review the pertinent records and will advise the client(s) concerning the probable merits of the case. If the initial evaluation of the merits of the claim is favorable, attorney v~ill advance the costs of prosecuting the case. These costs shall be repaid by client(s) as specified in paragraph 5 below. Attorney reserves the right to terminate the Agreement after the initial evaluation if the case is determined not to have merit, at which time any balance remaining in the trust account after payment of expenses shall be returned to client(s). 2. Attorney Fees - In payment for the services performed by the attorney for work as Plaintiff's Attorney for the Estate, client(s) hereby agree that attorneys fees shall be paid as follows: (a) A fee of twelve pement (12%) of the first Fifty-five Thousand ($55,000.00) Dollars uninsured/underinsured motorist coverage, anything in excess of that amount is to be billed under paragraphs b and c below; (b) Prior to the filing ora Complaint or a request for arbitration, payment for services shall be twenty-five (25%) percent contingency fee on the total amount paid settlement of the claim or claim(s); (c) Ifa Complaint is filed or arbitration is requested, payment for services shall be thirty- three (33%) percent contingency fee on the total amount paid by either settlement or verdict; and (d) In addition to the fees in capacity as Plaintiff's Attorney, the aforementioned, the undersigned agree to pay a ten percent (10%) estate administration fee on the services by attorney, including the handling of all estate matters and the filing of an estate tax return if required, for any approval of any estate or the filing of any accounting in the estate or any other work performed on the estate. However, the attorney agrees to waive this fee if the attorney is able to collect fully under paragraphs a through c above. In the event of or for any reason, the fee specified by a through c does not apply, or are reduced by Court or Court Order, the estate administration fee would become immediately due and payable. In the event of a settlement in the form ora structured settlement, it is agreed that attorney fees shall be paid according to the above terms based on the cost of the structured settlement to the settling party(s). It is further understood and agreed that the mount to be paid as the attorney fees on the structured settlement shall be paid on a lump sum basis at the time the structured settlement is entered into by the client(s). 3. Settlement - No settlement of this case may be made without the client(s) prior approval. 4.. Distribution of Proceeds - Client(s) further agrees that from the proceeds of any recovery, whether by settlement, judgment or otherwise, the attorney may deduct the attorneys fees to which it is entitled, together with ail costs and expenses which have been advanced or remain unpaid; and client(s) further agree that the attorney may deduct the amount of all unpaid bills for professional services and make disbursements of such funds directly to the creditors involved. 5. Cost Advance - Attorney shall have the authority to make advances and to incur such costs as the attorney determines necessary in the processing of the client(s) case. Such advances and costs include but are not limited to: (a) Fees for physicians, psychologists, accountants and other experts which attorney deems necessary to assist in handling of client(s) case; (b) Copying charges, travel expenses, court costs, deposition expenses, long distance telephone cails, postage. In the event of a monetary recovery, client(s) agree to reimburse attorney for the above- referenced expenses incurred. After the attorneys fees are deducted from the settlement and/or verdict, the expenses shall be repaid to attorney out of the remaining baiance of the settlement and/or verdict. If client(s) rejects a settlement offer that attorney believes is reasonable and equitable under the circumstances, client(s) agree to be responsible for any and all out-of-pocket expenses . incurred during the pursuit of their claim, irrespective of a monetary recovery. 6. Withdrawal - If, during the pursuit of this case, the attorney determines that under the existing circumstances, it is not feasible or practicable to prosecute this case, upon notification to the client(s) of such facts, the attorney may withdraw from representation under this agreement. Client(s) agree to execute all documents and take all steps requested by attorney that are necessary to facilitate the withdrawal of representation. 7. Appeal - If the client(s) authorizes an appeal of this case, or the attomey must defend an appeal taken by the other side, attorney fees shall be increased by 10% more than the fee set forth above to cover the additional work involved in handling of the appeal. Thus in paragraphs a through d in subsection 2, it is the intent that 10% be added to each of the figures outlined therein. 8. Fee Division - In the event that Client(s) were referred to Rominger and Bayley Law Offices by a referring attorney, Client(s) do not object to the division of the attorneys fees being charged the client(s) between the attorney and the referring attorney. Client(s) understand that they will not pay any additional fee as a result of the division of the fee between attorney and referring attorney. 9. Termination of Agreement by Client(s) - In the event that the client(s) seek legal representhtion elsewhere regarding the incident described herein and after the instant fee agreement is executed, client(s) agree to immediately reimburse attorney for all expenses incurred to date. Moreover, for the work performed by the attorney up to the date of separation of attorney and client(s), client(s) agrees that, in the event of an ultimate monetary recovery, attorney is entitled to reasonable compensation (quantum merit) from any verdict or settlement. 10. Arbitration. - Any dispute between the attorney and the client(s) shall be resolved by arbitration. The arbitrators shall be members of the Pennsylvania Bar Association. DJ - !I' N (:) (:) ..... -. - CIl "2- ;::;: I~ o ,C ~ - I~ ,~ Ig POWER OF A TTOR1~EY AND CONTINGENCY FEE AGREEMENT I, Kelly Hockenberry, individually and Sandra Hockenberry, individually and as Administrator and Administratrix of the Estate of Nathan Hockenberry, the undersigned, hereinafter called "client(s)" hereby retain, appoint, and nominate ROMINGER, BAYLEY & WHARE LAW OFFICES, its members and associates, hereinafter called "attorney" to represent client(s) as legal counsel for all purposes and against all parties in connection with the death of Nathan Hockenberry that occurred around or about May 14,2004. Client(s) and attorney hereby agree as follows: 1. Initial Evaluation - Attorney will undertake an initial investigation and evaluate the merits of this case. No attorney fee will be charged for attorney work in connection with the evaluation. Client(s) shall provide in advance a retainer of 0 to be used for the purposes of paying the costs associated with the initial investigation. Attorney will review the pertinent records and will advise the client( s) concerning the probable merits of the case. If the initial evaluation of the merits of the claim is favorable, attorney will advance the costs of prosecuting the case. These costs shall be repaid by client( s) as specified in paragraph 5 below. Attorney reserves the right to terminate the Agreement after the initial evaluation if the case is determined not to have merit, at which time any balance remaining in the trust account after payment of expenses shall be returned to client(s). 2. Attorney Fees - In payment for the services performed by the attorney for work as Plaintiffs Attorney for the Estate, client(s) hereby agree that attorneys fees shall be paid as follows: (a) A fee of twelve percent (12%) of the first Fifty-five Thousand ($55,000.00) Dollars uninsured/underinsured motorist coverage, anything in excess of that amount is to be billed under paragraphs b and c below; (b) Prior to the filing of a Complaint or a request for arbitration, payment for services shall be twenty-five (25%) percent contingency fee on the total amount paid settlement of the claim or claim(s); (c) If a Complaint is filed or arbitration is requested, payment for services shall be thirty- three (33%) percent contingency fee on the total amount paid by either settlement or verdict; and (d) In addition to the fees in capacity as Plaintiffs Attorney, the aforementioned, the undersigned agree to pay a ten percent (10%) estate administration fee on the services by attorney, including the handling of all estate matters and the filing of an estate tax return if required, for any approval of any estate or the filing of any accounting in the estate or any other work performed on the estate. However, the attorney agrees to waive this fee if the attorney is able to collect fully under paragraphs a through c above. In the event of or for any reason, the fee specified by a through c does not apply, or are reduced by Court or Court Order, the estate administration fee would become immediately due and payable. In the event of a settlement in the form of a structured settlement, it is agreed that attorney fees shall be paid according to the above terms based on the cost of the structured settlement to the settling party(s). It is further understood and agreed that the amount to be paid as the attorney fees on the structured settlement shall be paid on a lump sum basis at the time the structured settlement is entered into by the client(s). 3. Settlement - No settlement of this case may be made without the client(s) prior approval. 4. Distribution of Proceeds - Client(s) further agrees that from the proceeds of any recovery, whether by settlement, judgment or otherwise, the attorney may deduct the attorneys fees to which it is entitled, together with all costs and expenses which have been advanced or remain unpaid; and client(s) further agree that the attorney may deduct the amount of all unpaid bills for professional services and make disbursements of such funds directly to the creditors involved. 5. Cost Advance - Attorney shall have the authority to make advances and to incur such costs as the attorney determines necessary in the processing of the client(s) case. Such advances and costs include but are not limited to: (a) Fees for physicians, psychologists, accountants and other experts which attorney deems necessary to assist in handling of client( s) case; (b) Copying charges, travel expenses, court costs, deposition expenses, long distance telephone calls, postage. In the event of a monetary recovery, client(s) agree to reimburse attorney for the above- referenced expenses incurred. After the attorneys fees are deducted from the settlement and/or verdict, the expenses shall be repaid to attorney out of the remaining balance of the settlement and/or verdict. If client(s) rejects a settlement offer that attorney believes is reasonable and equitable under the circumstances, client(s) agree to be responsible for any and all out-of-pocket expenses incurred during the pursuit of their claim, irrespective of a monetary recovery. 6. Withdrawal - If, during the pursuit of this case, the attorney determines that under the existing circumstances, it is not feasible or practicable to prosecute this case, upon notification to the client(s) of such facts, the attorney may withdraw from representation under this agreement. Client(s) agree to execute all documents and take all steps requested by attorney that are necessary to facilitate the withdrawal of representation. 7. Aopeal- If the client(s) authorizes an appeal of this case, or the attorney must defend an appeal taken by the other side, attorney fees shall be increased by 10% more than the fee set forth above to cover the additional work involved in handling of the appeal. Thus in paragraphs a through d in subsection 2, it is the intent that 10% be added to each of the figures outlined therein. 8. Fee Division - In the event that Client(s) were referred to Rominger and Bayley Law Offices by a referring attorney, Client(s) do not object to the division of the attorneys fees being charged the client(s) between the attorney and the referring attorney. Client(s) understand that they will not pay any additional fee as a result of the division of the fee between attorney and referring attorney. 9. Termination of Agreement by Client(s) - In the event that the client(s) seek legal representation elsewhere regarding the incident described herein and after the instant fee agreement is executed, client(s) agree to immediately reimburse attorney for all expenses incurred to date. Moreover, for the work performed by the attorney up to the date of separation of attorney and client(s) , client(s) agrees that, in the event of an ultimate monetary recovery, attorney is entitled to reasonable compensation (quantum merit) from any verdict or settlement. 10. Arbitration - Any dispute between the attorney and the client(s) shall be resolved by arbitration. The arbitrators shall be members of the Pennsylvania Bar Association. The attorney shall select one arbitrator. The client(s) shall select one arbitrator. The two arbitrators shall select a third arbitrator. The arbitrators shall, by majority vote, establish all rules pertaining to the arbitration, including determining how the cost of arbitration shall be paid. If the dispute is not resolved, the rules of the American Arbitration Association in effect at the time shall apply and control. 11. Termination - This agreement applies only to the attorney's pursuit of the claim specified above. This agreement terminates upon the final distribution of proceeds recovered on behalf of the client( s) through verdict, settlement or otherwise, if not terminated before such time. In the event client(s) desires additional services performed by attorney, whether related to the above-described incident or not, the fees and costs to be charged by the attorney in the event representation is undertaken, is subject to other agreement.
