Atherton by and through her attorneys, Cunningham & Chernicoff, P.C., and seeks to obtain a Decree in Divorce from the Defendant and in support thereof avers as follows: 1. The Plaintiff, Lesli A. Atherton resides at 126 Furman Road, Dillsburg, York County, Pennsylvania. The Plaintiff is a citizen of the United States of America. Plaintiff's Social Security Number is 186-60-1603. 2. The Defendant, John W. Atherton resides at 400 East Coover Street, Mechanicsburg, Cumberland County, Pennsylvania. The Defendant is a citizen ofthe United States of America. Defendant's Social Security Number is 174-46-5808. 3. The Plaintiff has been a bona fide resident in the Commonwealth of Pennsylvania for at least the last six (6) months immediately previous to the filing of this Complaint. " 4. The Defendant has been a bona fide resident in the Commonwealth of Pennsylvania for at least the last six (6) months immediately previous to the filing of this Complaint. 5. The Plaintiff and Defendant were married on October 2, 1997, in Monroe County, Pennsylvania. 6. The Plaintiff avers as the grounds on which this action is based that: a. The Defendant has offered such indignities to the person of the Plaintiff, the injured and innocent spouse, as to render her condition intolerable and life burdensome; and b. Furthermore, the marriage is irretrievably broken. 7. There has been no prior action for divorce or annulment of marriage between the parties in this or any other jurisdiction. 8. The Plaintiff has been advised of the availability of counseling and that the Defendant may have the right to request that the Court require the parties to participate in counseling. WHEREFORE, the Plaintiff prays your Honorable Court to enter a Decree in Divorce from the bonds of matrimony. COUNT II 9. The averments in Paragraphs I through 8, inclusive, are incorporated herein by reference thereto. II " 10. During the course of the marriage, the parties acquired marital property. WHEREFORE, the Plaintiff requests the Court to equitably determine, divide, distribute and assign the marital property of the parties pursuant to Section 3501 of the Divorce Code. COUNT III II. The averments in Paragraphs 1 through 10, inclusive, are incorporated herein by reference thereto. 12. One (1) child ofthe parties was adopted during the course of the marriage, namely, Alex A. Atherton born November 15, 1992. 13. The aforesaid child resides with the Plaintiff, Lesli Atherton, and the best interests of the child demand that Plaintiff be awarded an Order of Custody providing for Plaintiff having primary physical custody of the minor child. 14. Since the birth of the aforesaid minor child, he has continuously resided with the Plaintiff and Defendant at the following address: a. 400 East Coover Street, Mechanicsburg, P A 17055 b. With Plaintiff only since March 1,2004, at 126 Furman Road. Dillsburg, P A 17019 15. Plaintiff has not participated as a party, witness or in any capacity whatsoever in any other litigation concerning the custody of her child. Plaintiff has no information of any custody proceeding concerning this child pending in a court of this or any other state. " 16. The Plaintiff is in all respects a fit and proper person to have permanent and physical custody of the minor child and the best interests of the child demand that Plaintiff be awarded custody of the minor child.
