The Plaintiff herein is PROVIDIAN NATIONAL BANK, a national banking association organized and existing under the laws of the United States of America, located at 295 Main St., Tllton, NH 03276. 2. The Defendant herein is AUDREY J FRITZ, an adult individual located at 128 W GARFIELD ST, SHIPPENSBURG, PA 172571736. 3. Plaintiff is the owner of Defendant's credit account number 4428002700067723. 4. The Defendant, at all times relevant hereunder, knowingly requested the funds at issue, and knowingly and voluntarily accepted the benefits bestowed and the terms and conditions linked thereto. 5. The balance due and owing on said account as of December 26, 2001 was $10882.33. A tree and correct copy of an account summary is attached hereto and marked Exhibit 6. Under the texms of the parties' agreement, additional interest has accrued, and continues to accrue, from December 26, 2001, at the rate of 19.3% per annum. A true and con'ect copy of the relevant account agreement terms is attached hereto and marked Exhibit "B". 7. In addition, Defendant agreed to be liable for Plaintiff's actual costs of collection, including court costs and attorney's fees. See Exhibit "B". 8. The actual attorney's fees in this case are contingent on recovery, at 10% of amounts recovered before entry of judgment and 30% of amounts recovered after entry ofjudgmem. 9. Plaintiff has in all respects fulfilled ail conditions precedent to its obligations on the contract and for bringing this Complaint for damages. 10. 11. There is no offset known to Plaintiff on the amount set forth in Paragraph 5. Despite repeated demand by Plaintiff, Defendant has refused and continues in failure and refusai to pay Plaintiff. WHEREFORE, Plaintiff demands judgmem in its favor against Defendant, in the amount of $10882.33, plus interest at the contract rate of 19.3% per annum commencing on December 26, 2001, plus attorney's fees at the rote of 10% pre-judgment/30% post-judgment, and costs of this action. P. 1034 provides a mechanism for motions for judgment on the pleadings. Case law which supports this rule follows the following standard: [a] motion for judgment on the pleadings may be granted in cases which are so free from doubt that a trial would clearly be a fruitless exercise. Such a motion is in the nature of a demurrer; all of the opposing party's well pleaded allegations are viewed as tree but only those facts specifically admitted by him may be considered against him. Citations omitted. Gallo v. J.C. Penney Cas. Ins. Co. 476 A.2d 1322,1324 (Pa. Super 1984); cited with approval in .Scipio v. Braton Glen Club, Inc., 633 A.2d 213 (Pa. Super. 1993). In the case at hand, Plaintiff pleads that "[t]he balance due and owing on said account as of December 26, 2001 was $10,882.33." See Plaintiff's Complaint, attached Exhibit "A" paragraph 5. Defendant simply states "Admitted" to this paragraph. See Defendant's Answer, attached Exhibit "B" paragraph 5. Further, Plaintiff pleads that interest accrues at the rate of 19.3% per annum from December 26, 2001. See Plaintiff's Complaint, attached Exhibit "A" paragraph 6. Defendant simply states "Admitted" to this paragraph. See Defendant's Answer, attached Exhibit "B" paragraph 6. Also Plaintiff pleads that "[D]efendant agreed to be liable for Plaintiffs actual cost of collection.". See Plaintiff's Complaint, attached Exhibit "A" paragraph 7. Defendant simply states "I Agree" to this paragraph. See Defendant's Answer, attached Exhibit "B" paragraph 7. This case should end at this point, with a judgment for Plaintiff on the pleadings in the amount of $15,512.21.
