Cumberland County, Pennsylvania, make, publish and declari:this.

as and for my Last will and Testament, hereby revoking all-" other
Wills and Codicils heretofore made by me.
FIRST: I direct the payment of all my just debts and
funeral expenses, including my grave marker and all expenses of
my last illness, shall be paid from my residuary estate as soon
as practical after my decease as a part of the expenses of the
administration of my estate.
SECOND: I give and bequeath to THE GOOD SHEPHERD
~CATHOLIC CHURCH, of 3435 Trindle Road, Camp Hill, Pennsylvania,
~ the sum of Five Thousand and No/100 ($5,000.00) Dollars. I
~ further direct that the GOOD SHEPHERD CATHOLIC CHURCH use this
~ gift for the purchase and/or continued maintenance of the second
~~ stained glass window and, further, to memorialize this bequest if
, appropriate and possible.
THIRD: I give and bequeath to CHARLES A. KOCH, JR. , of
25 Orion Road, Boiling Springs, Pennsylvania, the following: the
framed French Carrousel silk print entitled "Le Carrousel" by

Bruce Johnson, Serial No. 103/250; framed picture of "Old Barn"
~ by David Lenker, Serial Number XXVII/C; hand carved wooden figure
,,~ of a deer; hand carved wooden figure of a hunter; hand carved
wooden ashtray; hand carved wooden plank measuring 34" X 11",
with four hand carved men digging and pulling a tree stump from
the ground.
FOURTH: I give and bequeath to ALBERT INTRIERI and
ANGELINE INTRIERI, his wife, or the survivor thereof, of 3866
Rutherford Street, Harrisburg, Pennsylvania, the sum of Five
Thousand and No/100 ($5,000.00) Dollars.
FIFTH: I give and bequeath to the PEMBROKE WELSH CORGI
RESCUE, all of the following items: Pembroke Welsh Corgi in
America; Welsh Corgi League Handbook - England; Our Corgi World _
England. The PEMBROKE WELSH CORGI RESCUE is presently managed by
BETTY DELFOSSE, of 34681 Iris Lane, East Lake, Ohio 44095-2461.
It is my wish that BETTY DELFOSSE be charged with the responsi-
bility of selling these items with the proceeds thereof going to
the PEMBROKE WELSH CORGI RESCUE. In the event that BETTY
~ELFOSSE predeceases me, I direct that the then existing Business
Manager of the PEMBROKE WELSH CORGI RESCUE dispose of these items
forth herein.
SIXTH: I give and bequeath to RICHTER L. VOIGHT and
VOIGHT, his wife, or the survivor thereof, of 45 Windsor
Way, Camp Hill, Pennsylvania 17011, the following: framed
prismacolor picture entitled "The Forest Primeval" by may Ireland
Voight; framed poster entitled "Welcome Exhibitors and Guests"
dated 1987 by May Ireland Voight and Richter L. Voight; framed
tile "Independence Hall" by May Ireland Voight.
SEVENTH: I give and bequeath to CLIFFORD L. KREISER
and BERNADETTE KREISER, his wife, or the survivor thereof, of

entitled "Italian Dancing Scene"; picture named "Moyers", paint-
ing framed and signed by Art Smith, artist.

Maple Avenue, Marysville, Pennsylvania 17053, the sum of Two
Thousand and No/100 ($2,000.00) Dollars.
NINTH: I give and bequeath to NEIL H. McLAIN and
KATHRYN McLAIN, his wife, or the survivor thereof, of 940 Cayuga
Heights Road, Ithaca, New York 14850, the following: framed pen
and ink picture entitled "Name Tag Original" by Tasha Tudor;

Memorandum, which dated and signed Memorandum shall be placed

individuals designated therein, if any. It is my intent that the

) TWELFTH: Unless specifically indicated to the con-
trary, should any of the individuals named in Clauses THIRD,
FOURTH, SIXTH, SEVENTH, EIGHTH, NINTH, and TENTH predecease me, I
direct that their share under this, my Last Will and Testament,
be and become part of my residuary estate to be disposed of as
~ set forth in Clause THIRTEENTH, hereinbelow.
THIRTEENTH: I give, devise and bequeath to the Trust-
ees of the University of Pennsylvania, a non-profit corporation
organized and existing under the laws of the Commonwealth of
Pennsylvania, all the rest, residue and remainder of my Estate of
whatever nature and wherever situate, including any property over
which I hold power of appointment and together with any insurance
policies thereon, to establish the Mildred G. and Vance G. Moyer
Scholarship Fund in small animal medicine.
It is my desire and preference that the endowment funds
be used to create one or more Dean's Scholarships at the School
of Veterinary Medicine (depending on the level of investment
needed to establish such Dean's SCholarships). Further, although
I want to support students in small animal medicine, I give the
School the right to direct the funds to any needy student who

meets the requirements for a Dean's Scholar. In that way, I can
be assured that the needs of future students will be met.
FOURTEENTH: In addition to all powers granted to them
by law and by other provisions of this Will, I give the fidu-
ciaries acting hereunder the following powers, applicable to all
property, exercisable without court approval and effective until
\ actual distribution of all property:
(A) To sell at public or private sale, or to lease,
period of time, any real or personal property and to give
options for sales, exchanges or leases, for such prices and upon
such terms (including credit, with or without security) or
conditions as are deemed proper. This includes the power to give
legally sufficient instruments for transfer of the property and
to receive the proceeds of any disposition of it.
(B) To partition, subdivide, or improve real estate
and to enter into agreements concerning the partition, subdivi-
sion, improvement, zoning or management of real estate and to
impose or extinguish restrictions on real estate.
(C) To compromise any claim or controversy and to
~ abandon any property which is of little or no value.
(D) To invest in all forms of property, including
stocks, common trust funds and mortgage investment funds, without
restriction to investments authorized for Pennsylvania fiduci-
aries, as are deemed proper, without regard to any principle of
diversification, risk or productivity.
(E) To exercise any option, right or privilege granted
in insurance policies or in other investments.
(F) To exercise any election or privilege given by the
Federal and other tax laws, including, but not necessarily being
limited to, personal income, gift and estate or inheritance tax
laws.
(G) To make distributions to my herein named benefici-
aries in cash or in kind or partly in each.

(H) To borrow money from themselves or others in order
to pay debts, taxes, or estate or trust administration expenses,
to protect or improve any property held under my will, and for
investment purposes.
(I) To select a mode of payment under any qualified
retirement plan (pension plan, profit sharing plan, employee
stock ownership plan, or any other type of qualified plan) to the
extent the plan or the law permits them to do so, and to exercise
any other rights which they may have under the plan, in whatever
manner they consider advisable.
FIFTEENTH: I direct that all inheritance, estate,
transfer, succession and death taxes, of any kind whatsoever,
which may be payable by reason of my death, whether or not with
respect to property passing under this Will, shall be paid out of
the principal of my residuary estate.
SIXTEENTH: I nominate and appoint CLIFFORD L. KREISER,
BERNADETTE KREISER and JAMES D. BOGAR, Co-Executors of this, my
Last Will and Testament. I direct that my CO-Executors, and
their successors, shall not be required to post security or a
bond for the performance of their duties in any jurisdiction.

AGREEMENT OF SALE FOR REAL ESTATE
THIS AGREEMENT is entered into this ~~ndday of October,
2004, by and between CLIFFORD L. KREISER, BERNADETTE KREISER, and
JAMES D. BOGAR, CO-EXECUTORS OF THE ESTATE OF MILDRED G. MOYER,

late of East Pennsboro Township, Cumberland County, Pennsylvania,
hereinafter called "SELLER",
AND
DONALD A. JOHNSON and SANDRA K. JOHNSON, husband and wife, of
241 N. 33rd Street, Camp Hill, Pennsylvania 17011, hereinafter
called "PURCF.ASER".
IT IS MUTUALLY AGREED AS FOLLOWS:
1. PREMISES. The Seller agrees to sell, grant and convey
to the Purchaser, and the Purchaser agrees to purchase and accept
the conveyance of the following described real estate situate in
East Pennsboro Township, Cumberland County, Pennsylvania,
described as follows:
Being all those two (2 ) certain pieces or parcels of
real estate having erected thereon a dwelling house
being known and numbered as 15 Golfview Road, Camp
Hill, Pe~~sylvania 17011, a copy of the legal
description being attached hereto, marked Exhibit "A"
and incorporated herein.
Tax Parcel No.: 09-20-1850-061
2 . PURCHASE PRICE. The Purchaser agrees to pay the sum of
$215,000.00 to the Seller, as the full purchase price and
consideration for the premises, payable as follows: $21,500.00

down on the signing of this Agreement, receipt of which is hereby
acknowledged, said down payment to be held by James D. Bogar,
Esquire, said account to be a non-interest bearing IOLTA account;
and $193,500.00 in cash unless otherwise herein provided at
settlement of this transaction as scheduled and provided
hereinbelow.
3 . SETTLEMENT. Final settlement of this transaction shall
be made at the Law Offices of James D. Bogar, One West Main
Street, Shiremanstown, Pennsylvania, or any other mutually agreed
upon location, and shall be made on or before November 19, 2004,
at which time of settlement the Seller shall tender to the
Purchaser a properly drawn and executed deed of special warranty,
conveying to the Purchaser a good and marketable title in fee
simple, clear of all liens and encumbrances, except easements or
building and use restrictions visible on the ground or of prior
record, title to be such as will be insured by a reputable title
insurance company in the central Pennsylvania geographical area
without exception or reservation at regular rates. Should Seller
be unable to deliver such title, Purchaser shall have the option
of either cancelling this Agreement of Sale for Real Estate and
receiving back any monies paid as a deposit or accepting such
title as Seller can give without offset, adjustment, or abatement
of the purchase price. Time is of the essence of this Agreement
of Sale for Real Estate.

4. TRANSFER TAXES AND APPORTIONMENT OF REAL ESTATE TAXES,
RENTS ~~ EXPENSES. All realty transfer taxes shall be paid
equally by the Seller and Purchaser, with Purchaser paying one
percent (1%) and Seller paying one percent (1%) . Current real
estate taxes, utility charges and any municipal service fees or
rents will be prorated at and to the date of settlement.
S . POSSESSION. Seller shall deliver possession of the said
premises to Purchaser at the time of final settlement.
6. CONDITION OF PROPERTY AND RISK OF LOSS. The Seller
agrees that the property shall remain in substantially its
present condition until date of settlement, and if it is not, the
Purchaser may rescind this contract. Seller shall bear the risk
of loss from fire or other casualty until time of settlement.
7. DEFAULT. Should Purchaser default in performing this
Agreemen t , any sum or sums paid on account of the purchase price,
by way of down-payment or otherwise, shall be retained by Seller,
as liquidated damages, whereupon this Agreement shall become null
and void.
Should Seller default in performing this Agreement,
Purchaser shall have the right of having this Agreement declared
null and void and, further, having any sum or sums paid on
account of the purchase price, by way of down-payment or
otherwise, returned in full to Purchaser, whereupon this
Agreement shall become null and void.

8 . CONTINGENCIES. This Agreement of Sale for Real Estate
is not subject to nor contingent upon the Occurrence or
nonoccurrence of any event. Furthermore, Purchaser understands
that they have the option to request that the property be tested
and certified free from termites and/or wood-boring insects; to
have the buildings located on the~roperty inspected and/or
certified by a licensed or otherwise qualified professional; to
have the property tested for radon gas. Purchaser waives the
opportunity to conduct all of these inspections and tests.
Furthe=more, Seller has no reports, records or knowledge of
lead-based paint and/or lead-based hazards to the property.
Seller warrants that the dwelling unit in question, as well as
all outbuildings, were constructed prior to 1978. Purchaser
waives the opportunity to conduct a lead-based paint and/or lead-
based paint hazards risk assessment or inspection for the
presence of lead-based paint and/or lead-based paint hazards.
9 . SURVEY. If the Purchaser should determine the need for
a current survey of the premises, the cost and expense thereof
shall be borne exclusively by the Purchaser.
10. STATUS OF SEWER AND WATER. The property is served by
municipal sewer and public water.
11. MUNICIPAL IMPROVEMENTS. Seller has no notice of
municipal improvements including, but not being limited to,
sidewalk and curbing.

12. ZONING OR DEED RESTRICTION. Seller warrants that the
present use of the property violates no existing zoning ordinance
or regulation or deed restrictions. Furthermore, Seller has no
notice of any proposed zoning change or change in use or
restrictions.
13. INSPECTION/~~TY. It.is understood that Purchaser
has inspected the above-referred to property and is not relying
upon any representations made by Seller or by Seller's agent(s).
Seller agrees to sell and Purchaser agrees to purchase the above-
described property "as is", there being no warranties, either

expressed or implied, as to the condition of the property.
Furthermore, Purchaser expressly represents that Purchaser has
had ample opportunity to inspect the above-referred to property
and to investigate and have answered by third parties any
questions Purchaser has regarding the property and the present
condition of same and that Purchaser has not, in entering into
this Agreement of Sale for Real Estate, accepted or relied upon
any statements or representations made to Purchaser by Seller.
Purchaser ac~,owledges that Seller, who is the Executor of an
estate, is not obligated and, in fact, has not completed a
Seller's Property Disclosure Statement. This provision shall
survive settlement.
14. PERSONALTY. The following specifically enumerated items
of personalty or personal property are included in the within

sale: washer, dryer, two (2 ) refrigerators, all window
treatments; fireplace set for the first floor fireplace.
15. BROKERS AND AGENTS. Seller and Purchaser both represent
that they have dealt with no real estate brokers or agents in
connection with this sale and that no brokers or real estate
agent's commission is due any per~on on account of this sale.
Each party shall indemnify and hold harmless the other party from
the claim or demand of any broker or agent for any commission
which any such broker or agent may claim to be due him or her as
a result of this sale.
16. MISCELLANEOUS. Seller agrees to have the furnace
serviced before settlement, provided, however, that the furnace
was not serviced on or after June 1, 2004.

I want to support students in small animal medicine, I give the
School the right to direct the funds to any needy student who

to an Agreement of Sale for
real Estate dated October 22,

policies thereon, to establish the Mildred G. and Vance G. Moyer
Scholarship Fund in small animal medicine.
It is my desire and preference that the endowment funds
be used to create one or more Dean's Scholarships at the School
of Veterinary Medicine (depending on the level of investment
needed to establish such Dean's Scholarships). Further, although
I want to support students in small animal medicine, I give the
School the right to direct the funds to any needy student who

meets the requirements for a Dean's Scholar. In that way, I can
be assured that the needs of future students will be met.
FOURTEENTH: In addition to all powers granted to them
by law and by other provisions of this will, I give the fidu-
ciaries acting hereunder the following powers, applicable to all
property, exercisable without court approval and effective until

any period of time, any real or personal property and to give
options for sales, exchanges or leases, for such prices and upon

to pay debts, taxes, or estate or trust administration expenses,

FIFTEENTH: I direct that all inheritance, estate,
transfer, succession and death taxes, of any kind whatsoever,
which may be payable by reason of my death, whether or not with
respect to property passing under this Will, shall be paid out of
the principal of my residuary estate.
SIXTEENTH: I nominate and appoint CLIFFORD L. KREISER,
BERNADETTE KREISER and JAMES D. BOGAR, Co-Executors of this, my
Last will and Testament. I direct that my Co-Executors, and
their successors, shall not be required to post security or a
