3 percent (72 P.S. §9416 (a) (1.1) (i)].
For dates of death on or after Jan. 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0 percent
[72 P.S. §9116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and
filing a tax return are still applicable even if the surviving spouse is the only beneficiary.

unremarried widow of the said decedent, of Monroe Township, Cumberland
County, Pennsylvania, Grantce.
WHEREAS, the said David Donald Heckert ak.a David D. Heckert a.k.a. David E.
Heckert, was vested in his lifetime with title to the premises hereinafter described, in the
Township of Monroe, County of Cumberland and Commonwealth of Pennsylvania; and
WHEREAS, the said David Donald Heckert ak.a David D. Heckert ak.a David E. Heckert,
departed this earthly life, testate, on the 14th day of July, 2011, and Letters Testamentary were
duly issued to the said Mildred K Heckert ak.a Mildred K. Koons, by the Register of Wills of
said Cumberland County, docketed to No. 21-11-0912; and
WHEREAS, the lands herein-mentioned were not specifically devised: and
WHEREAS, the Grantce heroin is the sole residuary beneficiary of the said Last Wi1L

BEING THE SAME PREMISES which Elmer Hertzler, widower, by his deed dated
December 17, 1984 and recorded in the Office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania, in Deed Book "A", Volume 31, Page 1032, granted and conveyed unto
David D. Heckert and Mildred K. Koons, then unmarried and thus each taking an equal
undivided interest therein as tenants in common The said David D. Heckert, as above set forth
has since departed this earthly life. His said Estate is the Grantor of his undivided interest in the
said premises.

ALL THAT CERTAIN piece or parcel of land, with the improvement erected thereon,
situate in the Monroe Township, Cumberland County, Pennssylvanis, bounded and described as
follows, to wit:
BEGINNING at a point marked by an iron pin in the southeast corns of otha lands of
David D. Heckert and Mildred. K. Koons; thence extending along the division line between Lots
Nos. 3 and 4 on the hereinafter mentioned Plan of Lots, South 02 degrees 39 minutes 11 seconds
East, a distance of 25.00 feet to an imn pin; thence along the southem line of Lot No. 4 on the
hereinafter mentioned Plan of Lots, North 89 degrees 51 minutes 03 seconds West, a distance of
88.44 feet to an iron pin; thence along the western line of Lot No. 4 on the hereinafter mentioned
Plan of Lots, North 02 degrees 39 minutes 11 seconds West, a distance of 5.00 feet to an iron pin
at the southwest corner of said other land.of David D. Heckert and Mildred K. Koons,

BEING THE SAME PREMISES which Arlene I. Ebersole, et al, by then deed dated
June 10, 1987 and recorded in the Recorder's OtEce aforesaid, in Deed Book "T", Volume 32,
Page L015, granted and~conveyed unto David E. Hxkert (being one and the same as the
aforesaid David D. Heckert) and Mildred K. Koons, then unmarried and thus each taking an
equal undivided interest therein as tenants is common. The said David E. Heckert (also (mown
as David D. Heckel), as above set forth has since departed this aartldy Gfe. His said Estate is the
Grantor of his undivided iatere~ in the said premises.

ALL THAT CERTAIN piece or parcel of land situate in the Monroe Township,
Cumberland County, Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a point makked by an iron pin in the southeast corner of other lames of
David D. Heckert and Mildred K Koons; thence extending along the Eastern line of said other
lands of David D. Heckert and Mildred K. Koons, the same also being the dividing line between
said other lands of David D. Heckert and Mildred K. Koons and Lot No. 3 on the hereinafter
mentioned Plan of Lots; North 02 degras 39 minutes I 1 seconds West, a distance of 199.58 feet
to an iron pia; thence along the line of Iands now or formerly of Frank E. Failor and Katharine
M. Failor, his wife, of which this was formerly a part, being also along the division line between
Lots Nos. 1 and 3 on the hereinafter mentioned Plan of Lots, South OS degrees l l minutes 33
seconds East, a distance of 225.29 feet to an iron pin; thence by the same, North 89 degrees 51
minutes 03 seconds West, a distance of 10.00 feet to an iron pin in the southeast comer of Lot
No. 4 on the hereinafter mentioned Plan of Lots; thence along the division lute betwcen Lots
Nos. 3 and 4 on said Plan, North 02 degrees 39 minutes 11 sa;onds West, a distance of 25.00
feet to an iron pin in the southeast comer of other lands of David D. Heckert and Mildred K.
Koons, first above mentioned, at the point and place of BEGINNING.

BEING THE SAME PREMISES which Frank E. Failor and Katharine M. Failor, his
wife, by their decd dated June 2, 1987 and recorded in the Recorder's Office aforesaid, in Deed
Book `T", Volume 32, Page 1019, granted and conveyed to David D. Haclcert and Mildred K.
Koons, then unmarried and thus each taking an equal undivided interest therein as tenants is
common. The said David D. Heckert, as above set forth has since departed this earthly life. His
said Estate is the Grantor of his undivided interest in the said premises.
FOR PURPOSES OF ADDITIONAL INFORMATION AND CLARIFICATION:
The above described throe (3) tracts were deeded in 1984 and 1987 while the then
Grantces were unmarried. Thus, as above set forth, each took an undivided ono-half (Yz) interest
in and to each of the said three (3) tracts. Subsequently, at least as early as March of 1991, the
said David D. Heckert and the said Mildred K. Koons, began to openly hold themselves out to
the public as husband and wife, and intending to be and agreed to be husband and wife became
such under the then effective Laws of the Commomvealt6 of Pennsylvania regarding common
law marriages. For record proof of the same sce the duly probated Last Will and Testament of
the said David D. Heckert available in the Estate file in the Register's Office aforesaid docketed
to No. 21-11-0912. Additionally, the said couple were formally and officially confirmed in their
marriage by the Reverend Sharon Marquart on the 29th day of Apri12011 at Mechanicsburg,
Cumberland County, Pennsylvania under the official names of David Donald Heckert and
Mildred Kay Koons, in accordance with the marriage license issued by Glenda Fanner
Stra46augh, Clerk of the Orphans' Court of Cumberland County, Pennsylvania, No. 20l 1-
0000242.
In view of the fact that the subsequent marriages did not work a conversion of the
tenancy in common ownership into a tenancy by the entirety, the Purpose of this deed of
conveyance is to unify the ownership of both halves of the ownership of said premises into one
whole owned by the said umemarried widow and Grantee herein.
THIS GRANT AND CONVEYANCE IS REALTY TRANSFER TAX EXEMPT IN THAT
1T IS A TRANSFER FOR NO OR NOMINAL CONSIDERATION OF PROPERTY
PASSING BY TESTATE SUCCESSION FROM A PERSONAL REPRESENTATIVE OF
A DECEDENT TO THE DECEDENT'S DEVISEE OR HEIR PER SECTION 1102-C.3 (7)
OF THE REALTY TRANSFER TAX ACT.
TO HAVE AND TO HOLD the said messuage or tenement and tract of land,
hereditaments and Premises hereby granted and released, or mentioned and intended so to be,

Z, DAVID D. HECI(ERT, of the Township of Monroe, County of
Cumberland, and Commonwealth of Pennsylvania, being of sound and
disposing mind, memory and understanding, do make, publish and
declare this to be my Last Will and Testament, hereby revoking
and making void all former Wills by me at any time heretofore
made.
1.
I direct the payment of all my just debts and funeral
expenses as soon as conveniently may be after my decease.
2.
All the rest, residue and remainder of my Estate, real,
personal and mixed, whatsoever and wheresoever situate, I give,
devise and bequeath to my wife, Mildred K. Koons.
3.
in the event, however, that my said wife should predecease
me or should die at about the same time as I do, such as in a
.disaster common to both of us, i direct that my estate shall be
divided as follows:
A. Thirty (303) percent thereof to my daughter,
Sharon Rittle.
B. Thirty (303) percent thereof to my daughter,
Lorraine Sanden.
C. Thirty (303) percent thereof to my son,
David A. Heckert.
D. Ten (103) percent thereof to my wife~s sister,
Shirley L. Snyder.
4.
Should Shirley L. Snyder predecease me, then her share shall
be equally divided among my three (3) children oer stirpes.
Should any of my said children predecease me and not be survived
by children, then their share shall be equally divided between
their surviving brother and sisters as the case may be. Should
any of my said children predecease me and be survived by
children, then their share shall qo to their children Aer

stiroes.
5.
I direct that my personalty (excluding my clothing,
toiletries, and the like and any items specifically bequeathed by
me upon a separate piece of paper enclosed herewith) and realty
be sold by my Executrix at public auction. Any of my children
including my Executrix shall be free to bid upon such items. My
Executrix, in conjunction with my auctioneer, shall have the
right to keep a reserve bid and do other things which are
considered customary in connection with auctions of personalty or
realty.
6.
I nominate, constitute and appoint my wife, Mildred K.
Koons, to be the Executrix of this, my Last Will and Testament.
If she should predecease me, or for any other reason be unable to
act as Executrix, I appoint my son, David A. Heckert, to be the
Executor in her place and stead. if he should predecease me, or
for any other reason be unable to act, or to continue to act, as
such Executor, I appoint my daughter, Sharon Kittle, to be the
Executrix in his place and stead. I further direct that they
shall not be required to file bond or other security in the
Office of the Register of Wills for the purpose of administering
my Estate.
7.
I authorize and empower my personal representative, in her
sole and absolute discretion, to purchase or otherwise acquire
and retain any investments of which I die seized, or any real or
personal property of any nature; to sell, lease, pledge,
mortgage, transfer, exchange, dispose of, or grant options in
regard to any or all property oP any kind forming a part of my
Estate for such terms and such prices as she may deem advisable;
to borrow money for any purposes connected with the protection
and preservation of my Estate; to mortgage or pledge any real or
personal property forming a part of my Estate; or to join in or
secure the partition of same; to compromise any claims or demands

of my Estate against others or of others against my Estate; to
make distribution in kind and to cause any share to be composed
