Williams entered into a Property Settlement Agreement dated June 22, 2000 providing for the entry of a Qualified Domestic Relations Order; and WHEREAS, a Qualified Domestic Relations Order was entered with a date of February 22, 2006, providing upon the retirement of Deborah L. Williams, Thomas E. Williams would receive $350.00 per month for 10 years and $150.00 per month for the next 10 years. WHEREAS, the parties wish to amend the Settlement Agreement to provide for the lump sum payment of $60,000.00 now and to vacate the QDRO in its entirety. Now therefore, the parties hereby agree and stipulate as follows: The Qualified Domestic Relations Order dated February 22, 2006, shall be vacated. WITNESS: ~j . D ah L. illiar~~ V ' < . Deborah L. WILLIAMS, • Defendant : IN DIVORCE AMENDMENT TO PROPERTY SETTLEMENT AGREEMENT This Agreement, made and entered into this day of N'~ ~~h X~- , 2011, between Deborah L. Williams, n/k/a Deborah L. Cingcade, hereinafter referred to as "V`Jife," and Thomas E. Williams, hereinafter referred to as °Husband." WHEREAS, the parties entered into a Property Settlement Agreement dated June'22, 2000; and WHEREAS, said agreement provided for, inter alia, the entry of a Qualified Domestic Relations Order, paying Husband upon the retirement of Wife, $350.00 per month for 10 years and $150.00 per month for the next 10 years; and WHEREAS, the parties wish to amend the Property Settlement Agreement to provide for the payment of $60,000.00 lump sum now instead of periodic payments from Wife's rerirement account when she retires. NOW, THEREFORE, the parties hereto intending to be legally bound do hereby mutually agree as follows: l. T'he following portion of Paragraph 5 is hereby deleted: "Husband shall receive $60,000.00 of Wife's Civil Service Retirement System (CSRS) benefit as follows: At the time of Wife's retirement, Husband sha11 receive $350.00 each month for 120 months, then $150.00 each month for the next 120 months. , . • 2. Said paragaph shall be replaced with the following: Wife sha11 transfer $60,000.00 from her Thrift Savings Plan account directly to Husband as soon as practical. 3. WILLIAMS, Defendant : IN DIVORCE i.,,, ~ ~p tn STIPULATION FOR ENTRY OF RETIREMENT BENEFITS COURT E*-- Zo CO wC WHEREAS, Deborah L. Williams, now known as Deborah L. Cingcade, (hereinafter "Participant") and Thomas E. Williams (hereinafter "Payee"), have agreed to a division of Imarital property which agreement includes a distribution from Participant's Thrift Savings Plan (hereinafter "Plan"); and WHEREAS, the parties wish to secure an Order of Court directing said distribution. NOW THEREFORE, it is stipulated and agreed as follows: 1. The parties intend for this Stipulation to be entered as a Retirement Benefits Court Order for the transfer of funds from the Plan of a federal civilian employee. 2. This Order applies to the Thrift Savings Plan of the aforementioned Participant, Social Security No. 146-40-1131, date of birth March 19, 2952, and whose address is 118 West Harmon Drive, Cazlisle, Cumberland County, Pennsylvania. 3. This Order applies to the aforementioned Payee, Social Security No. 143-48-6547, date of birth March 29, 1953, and whose last known address is 506 Peachtree Lane, Bowling Green, Kentucky, 42103. 4. The parties were married on September 11, 1977 in Lakewood, New Jersey, and were divorced by a Decree in Divorce entered by the Court of Common Pleas of Cumberland County on Apri127, 2005. 5. A portion of the Participant's account in the Plan is marital property subject to distribution by the Court of Common Pleas of Cumberland County, Pennsylvania. The Court has jurisdiction over the parties' divorce proceedings. 6. Payee is a retired federal civilian employee. 7. Participant continues in her employment with the federal government at the time of entry of this Stipulation and requested Order. Payee is a retired federal civilian employee. 8. Pursuant to the parties' Agreement, the sum of $60,000.00 is to be paid from Participant's TSP account to Payee directly immediately upon receipt of this Stipulation and the resulting Order of Court by the TSP Services office in Fairfax, Virginia. 9. No other benefits are designated to be received by the Payee from the Participant and no additional claims will be made against the Participant's TSP account by the Payee from the time of this distribution. 10. This transfer of funds maybe a taxable transfer. 11. The parties intend that this Stipulation shall be entered as an Order of Court and that a true and attested copy of this Order shall be forthwith served upon the TSP Legal Processing Unit 12210 Fairfax Town Center, Fairfax, VA, 22033. Said Order shall be effectuated immediately upon release of the Order by the TSP Service Office. IN WITNESS WHEREOF, the parties hereto have set forth the day and year hereinafter written. No. 143-48-6547, of 506 Peachtree Lane, Bowling Green, Kentucky 42103, is awarded the sum of $60,000.00 from the Thrift Savings Plan account of Deborah L. Williams, now known as Deborah L. Cingcade (hereinafter "Participant"), S. S. No. 146-40-1131 or 118 West Harmon Drive„ Carlisle, Cumberland County, Pennsylvania, 17013, as of this date. IT IS FURTHER ORDERED AND DIRECTED that this sum shall be paid directly from the Participant's Thrift Savings Account to the Payee as promptly as reasonably possible by the Thrift Savings Plan or TSP Service Office upon receipt of a true and attested copy of this Order.
