NO. AMANDA FREEZE, CIVIL ACTION - LAW Defendant JURY TRIAL DEMANDED COMPLAINT 1. Plaintiff Constance Ross is an adult individual and citizen of the Commonwealth of Pennsylvania who resides in Camp Hill, Cumberland County, Pennsylvania. 2. Defendant Amanda Freeze is an adult individual and citizen of the Commonwealth of Pennsylvania who resides at 352 Ringneck Drive, Harrisburg, Dauphin County, Pennsylvania, 17110. 3. The facts and occurrences hereinafter took place on or about March 24, 2010, at approximately 1:30 p.m. near the intersection of Main Street and Railroad Avenue in Shiremanstown, Cumberland County, Pennsylvania. 4. At that time and place, Plaintiff Constance Ross was operating her 1991 Chevrolet Lumina traveling west on Main Street. 5. At the same time and place, Defendant Amanda Freeze was operating a 1998 626 Mazda traveling south on Railroad Avenue. 485010 6. Defendant Amanda Freeze pulled from the stop sign at the intersection of Railroad Avenue and Main Street, intending to turn left or east onto Main Street and pulled her vehicle directly into the path of Mrs. Ross's Chevrolet Lumina, causing a collision. 7. The foregoing collision and all of the injuries and damages set forth herein sustained by Plaintiff Constance Ross are the direct and proximate result of the negligent, careless, wanton, and reckless manner in which Defendant Amanda Freeze operated her motor vehicle as follows: a. failure to keep alert and maintain a proper watch for the presence of other motor vehicles; b. failure to look to her left to see a vehicle approaching that had the right-of- way; C. failure to see Mrs. Ross's oncoming vehicle; and d. driving her vehicle in a manner endangering persons and property and in a reckless manner with careless disregard to the rights and safety of others and in violation of the Motor Vehicle Code of the Commonwealth of Pennsylvania. 8. Plaintiff Constance Ross sustained painful and severe injuries, which include but are not limited to, chronic low back pain, left leg pain, an aggravation of a pre-existing right knee condition necessitating a right total knee arthroplasty, left shoulder pain, lumbosacral radiculopathy, post-traumatic adhesive capsulitis, left shoulder pain aggravating pre-existing arthritis and possible rotator cuff tear. 9. By reason of the aforesaid injuries sustained by Constance Ross, she was forced to incur liability for medical treatment, hospitalization, surgery, and therapy in an effort to restore herself to health, and claim is made therefor. 485010 2 10 Because of the nature of her injuries, Constance Ross has been advised and therefore avers that she may be forced to incur similar expenses in the future, and claim is made therefor. 11. Constance Ross has undergone and in the future may undergo physical and mental suffering, inconvenience in carrying out her daily life's activities, loss of life's pleasures and enjoyment, and claim is made therefor. 12. Constance Ross continues to be plagued by chronic pain and limitation and therefore avers that her injuries may be of a permanent nature, causing residual problems for the remainder of her lifetime, and claim is made therefor. 13. By reason of the aforesaid injuries sustained by Constance Ross in the subject motor vehicle accident, she has sustained a serious impairment of bodily function. 14. By reason of the aforesaid injuries sustained by Constance Ross in the subject motor vehicle accident, as well as the right knee arthroplasty, she has sustained serious permanent disfigurement. WHEREFORE, Plaintiff Constance Ross demands judgment against Defendant Amanda Freeze in an amount in excess of Fifty Thousand Dollars ($50,000.00), exclusive of interest and costs and in excess of any jurisdictional amount requiring compulsory arbitration.
