Your Petitioner, Kenneth A. Dapp, is an adult individual who resides at 7 Timberlane New Cumberland, PA 17070. 2. Kenneth B. Dapp is a twenty-two (22) year old incapacitated male, born on November 1, 1980 and presently residing at CLAREMONT NURSING & REHABILITATION CENTER 375 Claremont Drive, Carlisle, PA 17013 since August 21, 2001. 3. Kenneth B. Dapp suffers from sever mental retardation and multiple medical problems, including congenital left ventricular heart dysfunction, severe scoliosis which causes frequent aspiration pneumonia, seizure disorder, attention deficit disorder, obsessive/compulsive disorder and impulse control disorder. 4. Kenneth B. Dapp is under the physical medical treatment by Dr. Ernest M. Josef, M.D., who's report is attached hereto and marked as Exhibit "A". 5. Kenneth B. Dapp is an incapacitated adult person who needs a court appointed guardian for his person and estate. 6. A guardian is necessary to facilitate Kenneth B. Dapp's continuing medical care and treatment, and to handle his personal and financial affairs in a responsible fashion. 7. Your Petititoner, Kenneth A. Dapp, is the father of Kenneth B. Dapp and is requesting that he be appointed Guardian of the person and property of Kenneth B. Dapp. Kenneth A. Dapp has agreed to act as Guardian over his son's person and property as evidenced by the attached acceptance of proposed Guardian. WHEREFORE, you Petitioner prays that a Citation be issued to show cause why he should not be adjudged to be incapacitated and plenary guardian for his estate and person be appointed, and that the Court schedule a hearing on this Petition. If the Court decides that you are an Incapacitated person, the Court may appoint a Guardian for you, based on the nature of any condition or disability and your capacity to make and communicate decisions. The Guardian will be of your person and/or your money and other property and will have either limited of full powers to act for you. If the court finds you are totally incapacitated, your legal rights will be affected and you will not be able to make a contract or gift of your money to other property. If the court finds that you are partially incapacitated, your legal rights will also be limited as directed by the Court. If you do not appear at the heating (either in person or by an attorney representing you) the court will still hold the hearing in your absence and may appoint the Guardian requested. Dapp should be adjudicated an incapacitated person and, if so, whether Petitioner, Kenneth A. Dapp, should be appointed permanent plenary guardian of his person and his estate. A hearing was held in this matter on August 27, 2003. For the reasons stated in this opinion, the petition will be granted. FINDINGS OF FACT 1. The allegedly incapacitated person is Kenneth B. Dapp, a domiciliary of Cumberland County who resides at the Claremont Nursing & Rehabilitation Center, 375 Claremont Drive, Carlisle, Cumberland County, Pennsylvania; Mr. Dapp was born on November 1, 1980, and is 22 years old. 2. Petitioner is Kenneth A. Dapp, an adult individual who resides at 7 Timber Lane, New Cumberland, Cumberland County, Pennsylvania; Kenneth A. Dapp is the father of Kenneth B. Dapp. 3. The allegedly incapacitated person suffers from severe profound mental retardation, originating at birth, as well as several medical and personality Specifically, in the words of his treating physician, Ernest M. Josef, Mr. Dapp is an ambulatory individUal who has severe mental retardation and has an expressive aphasia, meaning that he cannot express himself either verbally or non-verbally. Otherwise his health has been fairly poor with severe respiratory difficulties, with recurrent pneumonias from aspirations secondary to his severe scoliosis. He basically has numerous aspiration pneumonias, again, from the scoliosis. He's had congenital left ventricular dysfunction. He has a cardiomyopathy. He also has been unable to swallow efficiently and, therefore, has a peg tube inserted into his stomach for feeding surprises. 4. As a result of his condition, the allegedly incapacitated person's ability to receive and evaluate information effectively and communicate decisions in any way is impaired to such a significant extent that he is totally unable to manage his financial resources and totally unable to meet essential requirements for his physical health and safety. 5. There is no indication at the present time that the allegedly incapacitated person's condition will significantly improve. 6. The allegedly incapacitated person is in need of a plenary guardian of his person and his estate. 7. The duration of the necessary guardianships must be considered at best indefinite and, for practical purposes, permanent. 8. Petitioner is found to be a person qualified under 20 Pa. C.S. §551 l(f) to serve as plenary guardian of his son's person and estate. 9. The foregoing Findings of Fact are made on the basis of clear and convincing evidence. DISCUSSION The provisions respecting an adjudication of incapacity are contained in 20 Pa. C.S. §§5501 et seq. Petitioner has substantially complied with these provisions, and based upon the foregoing Findings of Fact the following Order of Court will be entered: 2 ORDER OF COURT AND NOW, this 8th day of October, 2003, upon consideration of the Petition Pursuant to Section 5511 of the Probate, Estates and Fiduciary Code To Adjudicate Kenneth B. A petition pursuant to Section 5511 of the Probate, Estates, and Fiduciary Code has been filed seeking the appointment or the determination that Kenneth B. Dapp be declared to be incapacitated and to appoint a guardian to his person and estate. That petition has been docketed to 21-03-585 in the Court of Common Pleas of Cumberland -- I'm sorry. Strike that. In the Court of Common Pleas, the Orphan's Court Division of Cumberland County. We're here to take the deposition of Dr. Ernest M. Dapp. Dr. Josef, we're going to ask you certain questions under oath pertaining to your treatment and observations and opinion of Kenneth B. Dapp. These -- this testimony is being given in lieu of your live testimony at the incapacity proceedings of Mr. Dapp. Would you please state your name for the record? Q Yes. Ernest Michael Josef. Q And your profession, please? A Physician. Q And how long have you been a physician? A I have to think about it. 15 years. Q Okay. Could you briefly for the record describe your medical education and training, please? A Yes. I graduated from the Medical College of Virginia in 1988 with an M.D. Degree., and completed residency at Harrisburg Hospital in Harrisburg, Pennsylvania. In a family practice residency for three years, and I've been practicing with Good Hope Family Practice since 1992. Q Are you licensed to practice medicine in the State of Pennsylvania? A specialty? Q I'm going to turn your attention specifically to Kenneth B. Dapp. 2001. A Um-hum. Is Mr. Dapp a patient of yours? He is a patient of mine. And how long has he been a patient of yours? He's been a patient of mine since August 21st, Q And does that date coincide with his admission to the Cumberland Nursing Home? A Yes, it does. Q And how old is Mr. Dapp? A He is 22 years old. Q Okay. And would you describe the -- the physical condition of Mr. Dapp, please? A Mr. Dapp is an ambulatory individual who has severe mental retardation and has an expressive aphasia, meaning that he cannot express himself either verbally or non-verbally. Otherwise his health has been fairly poor with severe respiratory difficulties, with recurrent pneumonias from aspirations secondary to his severe scoliosis. Q Does he have physical problems as well? He's had congenital left ventricular dysfunction. He has a cardiomyopathy. Q So he's dependent upon someone for purposes of assisting him in feeding and regular digestion? A Yes, it requires specialized care. Q Now, you talked about his severe, profound mental retardation? A Um-hum. Q Could you elaborate on that a little bit? A His mental retardation I am not certain as to how it occurred. I don't have documentation of that. But from what I understand from his parents, it's been pretty much from -- from birth. He is unable to, again, express himself either verbally or non-verbally and is unable to take or do any commands. Q Okay. So he's not responsive to verbal instructions or decisions of any particular kind?
