BYERB, of 501 East Mulberry Street, Elizabethtown, Lancaster County, Pennsylvania, being of sound and disposing memory, realizing the uncertainty of this life, but with confidence in God and trust in His Son, my Lord and Savior, Jesus Christ, who died for my sins upon the cross, and rose again to justify me and give me eternal life, do hereby make, publish and declare this to be my Last Will and Testament, and hereby revoke any and all prior Wills and Codicils made by me. ITEM I. EXPENSES AND TAXES. I direct that as soon as may be convenient after my decease there be paid from my estate all of my just debts, expenses incident to my illness, my funeral expenses and, from the principal of the residue of my estate, all of my state and federal inheritance and estate taxes. ITEM II. TAN(iIBLB PERSONAL PROPERTY. If John A. Byers, my spouse, survives me, I give my tangible personal property in the nature of household goods, personal effects and motor vehicles, owned by me at my death, together with insurance thereon, to my spouse. If my spouse fails to survive me, I give such of my tangible personal ~,~d4:~1~f/ Esther H. yens property as is set forth in a separate unsigned memorandum, which I shall place with my will, to the persons therein designated. I give the remainder of my tangible personal property in the nature of household goods and personal effects owned by me at my death, together with insurance thereon, per stirpes to my lineal issue who survive me. My Personal Representative, without further responsibili- ty, may distribute the share of a minor to the minor or to any person to hold for the minor. To the extent my Personal Representative deems it impractical or unwise to make distribution in kind, my Personal Representative may sell said assets and make distribution of the proceeds thereof to or for the benefit of my said lineal issue. As a matter of information, my lineal issue living as of the time of the execution of this will are my children, Brenda Cox, Pamela Noel, Sheryl•~ and Randall Byers. ITEM IZI. DIBTRIBUTION OF RESIDUE. I give the residue of my estate of whatsoever nature and wheresoever situate to my spouse, John A. Byers, if he survives me. ITE1[ IV. DISTRIBUTION OF RESIDIIE. If my spouse, John A. Byers, fails to survive me, I direct the residue of my astate of whatsoever nature and wheresoever situate be distributed as follows: (A) Ten (10$) percent thereof I give to the Board of Administration of the Brethren in Christ Church, P. (B) Ninety (90$) percent thereof per stirpes to my lineal issue who survive me.
