Ladies and Gentlemen,
PNC Bank, N.A., as Trustee of the Trust Agreement dated October 16, 1996,
between Albert L. Allen, Jr., as Settlor and PNC Bank, N.A., as Trustee, as amended
(the "Trust"), has filed a Petition for Adjudication /Statement of Proposed Distribution, a
First and Final Account for the Trust, and a First and Final Account for the Estate of
Albert L. Allen, Jr., with the Court of Common Pleas, Orphans' Court Division,
Cumberland County, Pennsylvania.
As a party in interest, and pursuant to Orphans' Court Rule 6.3, you are receiving
this Notice. Enclosed with this Notice are true and correct copies of the Petition for
Adjudication /Statement of Proposed Distribution, the First and Final Account for the
Trust and the First and Final Account for the Estate.
If you have minor children or any other descendants (including the unborn) who
may be or become beneficiaries of this trust, or if there are minor, unborn, or
unascertained beneficiaries whose interests are substantially identical to yours,
pursuant to the Pennsylvania Uniform Trust Act (the "Act"), Section 7723, you are
deemed to represent their interests. This constitutes the written notice of the Trustee to
you, pursuant to Section 7725 of the Act, that you are deemed to represent the interests
of another, as provided in Section 7723 of the Act. You may decline such
representation in a writing delivered to the Trustee no later than 30 days after your
receipt of this notice.
The Court has set January 10, 2012 at 9:30 a.m. in the Cumberland County
Courthouse, 4th Floor, Carlisle, Pennsylvania, as the date, time and place to audit the
Accounts and review the Statement of Proposed Distribution. Objections to the
Accounts or Statement of Proposed Distribution, or both, must be filed with the
Orphans' Court Clerk in writing by not later than 9:00 am on January 10, 2012, with a
copy of such Objections served on the undersigned.
If no Objections are filed, the Court may make a final decree confirming the
Accounts and directing distribution in accordance with the Statement of Proposed
Distribution.
