AFFIDAVIT OF NOTICE
Peter G. Howland, being duly sworn according to law, deposes and says that he is an
attorney at the offices of Wix, Wenger and Weidner, P.C., and that on December 8,
2011, he sent a true and correct copy of the Notice, attached hereto, along with all
enclosures referenced in such Notice, to the Pennsylvania Office of Attorney General,
16th Floor, Strawberry Square, Harrisburg PA 17120, by United States Certified Mail,
Certified Mail Number 7008 1300 0002 2547 3189, and the Pennsylvania Office of
Attorney General received the Notice and related documents on December 9, 2011, as
evidenced by the Certified Mail return receipt card attached hereto and marked Exhibit
A.

In re: Trust Agreement dated October 16, 1996, between Albert L. Allen, Jr., as Settlor
and PNC Bank, N.A., as Trustee (the "Trust")

VIA CERTIFIED MAIL RETURN RECEIPT REQUESTED
Ladies and Gentlemen;
Pursuant to Rule 5.5 of the Pennsylvania Orphans' Court Rules, we are providing
this Notice and the enclosures referenced herein. The lettered paragraphs below
correspond to the lettered paragraphs contained in Rule 5.5.
(a) The caption of the matter in the Cumberland County Court of Common Pleas,
Orphans' Court Division, is: "In re: Trust Agreement dated October 16, 1996,
between Albert L. Allen, Jr., as Settlor and PNC Bank, N.A., as Trustee," and the
Docket Number is : 21-09-0719.
(b) PNC Bank, N.A., as Trustee, has filed with the Court, a Petition for Adjudication /
Statement of Proposed Distribution, accompanied by a First and Final Account
for the Trust and a First and Final Account for the Estate of Albert L. Allen, Jr.,
deceased. The Petition, Statement of Proposed Distribution and Accounts are
enclosed with this Notice.
(c) The Court has set January 10, 2012 at 9:30 a.m. in the Cumberland County
Courthouse, Carlisle, Pennsylvania, 4th Floor, as the date, time and place where
the matter will be heard.
(d) The name of the Settlor of the Trust is Albert L. Allen, Jr. Albert L. Allen, Jr. died
on July 20, 2009.
(e) A copy of the Trust, with all amendments, is enclosed with this Notice.
(f) The following charities will be affected by the proceeding: (i) Harrisburg
Academy, Wormleysburg, PA; (ii) Mercersburg Academy, Mercersburg, PA; (iii)
Messiah College, Grantham, PA; (iv) New Birth of Freedom Council, successor
by merger to the Keystone Area Council, Boy Scouts of America,
Mechanicsburg, PA.
(g) Each of the above referenced charities has a 2.50% residuary interest in Part A
of the Trust. The approximate value of each such interest is .$12,492.00.
(h) N/A
(i} There are no unresolved claims or material questions of interpretation.

PA 17011 -Attn: Linda J. Lundberg.
(k) Counsel for the fiduciary is Wix, Wenger & Weidner, P.C., 508 North Second
Street, Harrisburg, PA 17101 -Attn: Robert C. Spitzer or Peter G. Howland.
(I) >No counsel for any of the referenced charities has made an appearance or
notified the fiduciary of representation of the charity.
