CHESKI, of Philadelphia, Philadelphia County, Pennsylvania, being of sound and disposing mind, memory, and understanding, and full legal age, do hereby make, publish and declare this to be my Last Will and Testament, hereby revoking all Wills and Codicils heretofore made by me. PARAGRAPH 1. I direct my personal representative to pay all of my debts and expenses of my last illness, funeral and administrative expenses as soon as conveniently may be done after my decease. PARAGRAPH 2. I give, devise and bequeath all of the balance of my estate of whatever nature and wherever situate, including but not limited to all tangible personal property owned by me at the time of my death to be divided in equal shares of twenty percent (20%) unto my brother Henry Cichaczewski of 5899 Troy Villa Blvd., Huber Heights, Ohio 45424, my niece Gloria Johnston of 57 Titus Court, Richboro, Pennsylvania 18954, my niece Phyllis Gutzmirtl of 5556 Jared Drive, Center Valley, Pennsylvania 18034, my niece Stephanie Pazienza of 60 Hines Farm Road, Cranston, Rhode Island 02921, and my niece Janine Farrell of 1323 Asper Drive, Boiling Springs, Pennsylvania 17007, if they survive me by thirty (30) days. PARAGRAPH 3. In the event that any of the beneficiaries listed in Pazagraph 2 predecease me, then I give, devise and bequeath their share of my estate of whatever nature and wherever situate to be divided equally among the surviving parties. PARAGRAPH 4. I direct that all inheritance, estate, transfer, succession and other death taxes imposed or payable by reason of my death and interest and penalties thereon with respect to all property composing of my gross estate for death tax purposes, whether or not such. property passes under this will or otherwise, shall be paid out of the principal of my residuary estate by my personal representative. PARAGRAPH 5. In addition to the powers conferred by law, I authorize my personal representative in his or her absolute discretion to compromise claims, borrow money, retain property for such length of time as he or she may deem proper; lease and sell property for such prices, on such terms, at public or private sales, as he or she may deem proper; and invest estate property and income without restriction to legal investments unless otherwise provided hereunder. My personal representative is authorized and empowered to engage in any business in which I may be engaged at my death, for such period of time after my death as seems expedient to said personal representative. PARAGRAPH 6. Any and all payment or payments of any sum or sums, whether in cash or in kind and whether from principal or income, payable to any beneficiary, shall be made upon the sole receipt of the respective beneficiary to whom the payment is made and free from anticipation, alienation, assignment, attachment, and pledge, and free from control by the creditors of any such beneficiary. No beneficiary may assign or anticipate his or her interest in any income or principal held or distributable hereunder; and no beneficiary's creditors may attach or otherwise reach any such interest. PARAGRAPH 7. I nominate and appoint my niece, Janine Farrell, Personal Representative of this my Last Will and Testament. If my niece predeceases me, fails to qualify or is unable to serve for whatever reason, then I appoint my nephew, William Mark Farrell, to be the Personal Representative of this my Last Will and Testament. PARAGRAPH 8. No person(s) shall benefit hereunder unless such beneficiary shall survive me by thirty (30) days. PARAGRAPH 9. No Personal Representative or Trustee acting hereunder shall be required to post bond or enter security in this or any other jurisdiction. PARAGRAPH 10. I recommend that my Personal Representative and any successor Personal Representative utilize the services of the Law Offices of Peter J. Russo, P.C., 5006 E.
