Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called "Bureau") created under the provisions of the Real Estate Tax Sale Law of the Commonwealth of Pennsylvania Act of July 7, 1947, P.L. 1368, as amended 72 P. S. § 5860.101 et sic. 2. On December 12, 2011 the Bureau held a continued Upset Tax Sale of forty- eighty (48) properties for the collection of delinquent real estate taxes. Of the properties offered, six (6) received bids equal to or higher than the fixed upset price, forty-two (42) properties received no bid. A list of said properties is hereto attached as Exhibit "A". 3. Notice of the original Upset Tax Sale of September 22, 2011 was sent by certified mail, restricted delivery, return receipt requested to the reputed owners of the properties as listed in Exhibit "A". 4. Notice of the original Upset Tax Sale of September,22, 2011 was also sent via regular United States first class mail to the reputed owners of the properties as listed in Exhibit "A". 5. In accordance with the Real Estate Tax Sale Law, advertisement of the Upset Tax Sale was made at least thirty (30) days prior to the original scheduled sale Page 1 of 3 date in at least two newspapers of general circulation and the Cumberland Law Journal. Proofs of publication are attached hereto as Exhibit "B". 6. The properties in Exhibit "A" were duly posted by the Cumberland County Sheriff and the Cumberland County Assessment staff. Personal service was completed on the properties that were owner occupied. . 7. Additional notification of the Continued Upset Sale for December 12, 2011 was sent via regular mail to the reputed owners. 8. Notices that the properties were sold were sent via certified mail, restricted delivery, return receipt and also regular U.S. mail to each reputed owner at their last known mailing address by the Bureau within thirty (30) days following the sale. 9. Your petitioner respectfully requests that the Court's Confirmation Nisi provide that a consolidated notice regarding properties sold on December 12, 2011 be published once in the Cumberland Law Journal, and The Patriot News within ten (10) days of the date of the Confirmation Nisi, and that any exceptions or objections thereto be filed within thirty (30) days of the Court's order. Cordeiro in 2010. 7. Manuel Cordeiro had no actual knowledge that the property was listed for upset tax sale in 2011. 8. There was an escrow account with the first mortgage for taxes on the subject tract of land and that escrow paid the school taxes for 2009 as well as all of the taxes for 2010 and 2011, amounting to $39,672.88, to the East Pennsboro Township Treasurer. 9. For reasons undisclosed to Cordeiros, the Chase Home Finance, the loan servicer inadvertently failed to pay the 2009 County/local taxes even though there were adequate funds in the escrow account to pay the taxes in 2009. 10. CORDEIRO's avers that had they known that their lender had failed to pay the balance of the 2009 taxes, they would have paid them. 11. In July of 2011 tax sale notice was sent by certified rnail, return receipt requested, separately to Manuel Corderio and Drenda S. Corderio. The return receipt card was signed and returned by "D. Corderio." The envelope sent to Manuel Corderio was unclaimed. Manuel Corderio has never provided any different address than the address of the property. Notice of the sale was also advertised in The Sentinel, the Harrisburg. Patriot, and the Cumberland Law Journal. Furthermore, the property was posted with the tax sale notice. In August of 2011 the Sheriff served both Manuel Corderio and Drenda S. Corderio by delivering the tax sale notice to the property and serving it upon Drenda Corderio. The tax sale notice served by the Sheriff was addressed to both Corderio's. In September of 2011 separate 10-day notices of the tax sale were sent to Manuel Corderio and Drenda S. Corderio at the only address available for them, the address of the property. Neither envelope was returned to the Tax Claim Bureau. The scheduled sale in September received no bids and was continued to the December sale. Although not required by law, notice of the new December sale was sent by regular mail, via a single document addressed to both Corderio's and mailed to the premises. This notice was not returned by the postal authorities. The property was then sold at the December Upset Tax Sale. 5. (Paragraph five (5) was omitted in the Exceptions filed.) 6. Denied. Notice of the Return and Claim was sent, as a single document to both Corderio's, by certified return receipt mail in March of 2010. The return receipt card is signed by Regan Corderio. 7. Denied. The averments of this paragraph set forth a factual averment which is outside the knowledge of the Tax Claim Bureau, and the facts of which are totally in the control of Manuel Corderio.
