ROSAS 1996 T~tUST has been revoked, terminated, or declared invalid for zany reason, I give the portion of the residue of my estate not taken to the executor of this will, as trustee, who shall hold, administer, and distribute the property under a testamentary!, trust, the terms of which shall bs identical to the 3 terms of the,JEANNE P. ROSAS 1996 TRUST that are in effect on the date of exec~ition of this will. ARTICLE FOUR EXECUTOR 4.1. Nomination of Executors. I nominate JOSEPH P. ROSAS, JR., my son,'', as executor of this will. If any beneficiary under this will and I d~e simultaneously, or if it cannot be established by clear and co~vincinq evidence whether that beneficiary or I died first, I shad be deemed to have survived that beneficiary, and this will sh~ll be construed accordingly. 5.4. Period of Survivorship. For the purposes of this will, a bens#iciary shall not be deemed to have survived me if that beneficiary dies within ninety (90) days after my death. 5.5. options.
